Buck, Pro-Tem Commissioner Scott K. James Commissioner Kevin D. Ross Commissioner Lori Saine Also present: Acting Clerk to the Board, Jan Warwick Assistant County Attorney, Karin McDougal Department of Planning Services representative, Maxwell Nader Department of Public Health and Environment representative, Lauren Light Department of Public Works, Development Review, Melissa King The following business was transacted: I hereby certify that pursuant to a notice dated May 15, 2023, and duly published May 17, 2023, in the Greeley Tribune, a public hearing was conducted to consider the request of 2936, LLC, for a Site Specific Development Plan and Rural Land Division Final Plan, RLDF23-0001, for the Creation of Four (4) Lots in the A (Agricultural) Zone District. Karin McDougal, Assistant County Attorney, made this a matter of record. Maxwell Nader, Department of Planning Services, presented a brief summary of the proposal, described the location, and explained the property is currently zoned A (Agricultural), and will remain so. He stated the property is located within the Coordinated Planning Agreement (CPA) boundaries for the Towns of Milliken and Platteville. He described the sign posting, explained 21 letters were sent out to surrounding property owners (SPOs), and noted no correspondence was received. Mr. Nader explained, per the Development Review staff, the proposed access onto County Road (CR) 36, via a proposed internal cul-de-sac road, will be required to meet the minimum access spacing criteria for intersections, and the applicant shall obtain an Access Permit. He noted the access onto CR 29 has an existing oil and gas permitted access, which will remain, but will be gated to limit use to the permit holder only. He further stated CRs 36 and 29 are local, gravel roads. which require 60 feet of right-of-way, and the Development Review Staff is requesting an Improvements and Road Maintenance Agreement for upfront and on -site improvements to the internal roadway, which shall be privately maintained. He stated the applicant has submitted Drainage Narrative and the site meets the detention exception. He explained the site is located within the three (3) mile referral areas of the Towns of Gilcrest, Milliken and Platteville; however, no referral comments were received. He described the surrounding uses, entered the favorable recommendation of the Planning Commission into the record as written, and displayed images of the site and surrounding views. In response to Commissioner Ross, Melissa King, Development Review, confirmed the distance between the internal road and the intersection of the two adjacent roads to the east is 357 feet, with minimum spacing criteria of 330 feet. Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions, explained the Central Weld County Water District provided a letter stating they could serve the lots, and stated a Septic Report indicated the septic systems will be sufficient. She stated Environmental Health has recommended several notes for the plat relating to water and sewer. Rose Netto represented the applicant and was available to answer questions. El No public testimony was offered concerning this matter. El The Board reviewed the Conditions of Approval and made no changes. In response to Chair Freeman, Ms. Netto indicated they have reviewed, and agreed to abide by, the Conditions of Approval, as presented. Commissioner Ross moved to approve the request of 2936, LLC, for a Site Specific Development Plan and Rural Land Division Final Plan, RLDF23-0001, for the Creation of Four (4) Lots in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval, as presented. The motion was seconded by Commissioner Buck, and it carried unanimously.
