WHEREAS, a public hearing was scheduled for August 12, 1970,
at 2:00 P. M. , in the chambers of the Board of County Commissioners of
Weld County at Greeley, Colorado, for the purpose of hearing the
petition of Paco Sanchez Development Corporation, 2185 Broadway,
Denver, Colorado, requesting a change of zone from "A" Agricultural
District to "R" Residential District, and
WHEREAS, the petitioner was not present nor represented by
counsel, and
WHEREAS, there was no one present in opposition to the change
of zone; however, correspondence has been received by interested
parties in opposition to the change of zone, and
WHEREAS, the Board of County Commissioners did not hear
any testimony nor was a hearing held due to the fact that there was no
issue for the Board to decide, and
WHEREAS, the Weld County Planning Commission by Resolution
dated June 2, 1970, recommended unfavorably relative to said change of
zone.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners, that the petition of Paco Sanchez Development Corporation,
2185 Broadway, Denver, Colorado, for change of zone from "A" Agricultural
District to "R" Residential District, said area being more particularly
described as follows:
A tract of land located in the SZ of the SE4 (SZSE4) of
Section 20, Township 1 North, Range 66 West of the
6th P. M. , Weld County, Colorado, lying East of the
Fulton Ditch, being more particularly described as
follows:
Beginning at the SE Corner of said Section 20; thence
North 00° 00' 00" East on an assumed bearing along
the East line of said South Half of the Southeast One
Quarter (S'-zSE+'-) a distance of 1332. 75 feet to the
Northeast corner of said South One Half of the South-
east One Quarter (S;SE+); thence North 89° 55' 30"
West along the North line of said South One Half of
the Southeast One Quarter (SSE+) a distance of 917. 05
feet; thence Southeasterly parallel to the East bank of
the Fulton Ditch by the following courses and distances:
S26° 00' 20" E, 87. 89 feet;
S33° 27' 15" E, 89. 01 feet;
S48° 14' 55" E, 166. 85 feet;
S03° 49' 35" E, 191. 81 feet;

Gentlemen:
The Directors of the Fulton Ditch Company have been
informed that an application has been made for -a housing
development in the Southeast Quarter of Section 20, Township
1 North, Range 66 West of the 6th P.M.
Tor your information, the Fulton Irrigating Ditch
Company operates its large canal through this quarter section,
and owns a strip of land fifteen feet wide on the easterly
side of the ditch and has constructed a barbed-wire fence to
prevent livestock from tramping down the ditch bank.
Being an adjacent property owner, the Directors felt
that the Board of County Commissioners of Weld County should be
informed that the Fulton Canal has been located in this section
'/ _for over a hundred years because the priority of the Fulton
-Ditch was granted in 1865 .
Any housing development would attract many families
with small children. Unless small children are carefully super-
vised in the area of a large ditch running full of water during
the summertime, there is a great danger to the lives of such
small children. The parents of such small children who do not
properly exercise their parental duties are quick to blame a
ditch company if an accident occurs which causes grief in the
family of such a small child.
-The Board of Directors of the Fulton Ditch Company be-
lieve that in the interest of good planning, housing developments
should not be permitted along the canal of such a large ditch,
when there is such a great space available for such housing
developments a considerable distance away from such a canal.
Believing that the Board of County Commissioners of
Weld County would like to have this information, it is submit-
ted to the Board for its usefulness in guiding the Board in
reaching its decision.
