Home My WebLink About20233222.tiffRESOLUTION RE: APPROVE AGREEMENT REGARDING CONSENT FOR PHOTOGRAPHS OF CHILDREN IN LEGAL CUSTODY OF WELD COUNTY AND AUTHORIZE CHAIR TO SIGN - LIFE STORIES CHILD AND FAMILY ADVOCACY, AND COURT APPOINTED SPECIAL ADVOCATES (CASA) OF WELD COUNTY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with an Agreement Regarding the Consent for Photographs of Children in the Legal Custody of Weld County among the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, Life Stories Child and Family Advocacy, and Court Appointed Special Advocates (CASA) of Weld County, with further terms and conditions being as stated in said agreement, and WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Agreement Regarding the Consent for Photographs of Children in the Legal Custody of Weld County among the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, Life Stories Child and Family Advocacy, and Court Appointed Special Advocates (CASA) of Weld County, be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said agreement. Photos will be limited to the use of court reports, sharing with case parties in between hearings, CASA staff or the child's guardians. What options exist for the Board? • Approval of the Consent Agreement. • Deny approval of the Consent Agreement. Consequences: Photos of the children will not be allowed to be taken. Impacts: WCDHS would not be incompliance with National CASA Standard 8.F.10.a.i.ii. and 8.F.10.b policies. WHEREAS CASA desires for their volunteers/staff be able to take photographs of children in the legal custody of the Weld County Department of Human Services. NOW THEREFORE, the parties mutually agree as follows: Photos are limited to the use of the court reports, sharing with case parties in between hearings, the CASA staff, or child's guardians; and comply with National CASA Standard 8.F.10.a.i.ii. and 8.F.10.b CASA will not distribute any photos of children assigned to our program without written consent of a Legal Guardian or Judge. It is up to the court's discretion who receives CASA court reports with or without photos. The CASA will not use pictures for personal use, post on social media or other platforms. All photos of children on any devices (phones or computers) will be deleted by the appointed CASA at the closure of the case. A copy of this waiver shall be put into the CASA case file on optima. No other use is authorized. CASA of Weld County volunteers and staff will follow policies set out by National CASA and by CASA of Weld County. This Agreement will commence upon the date of the last signature and will run for one (1) year with automatic renewals every year for up to five (5) years. Changes in the Agreement may be made in writing at any time by mutual consent and either party may terminate the agreement with or without cause at any time upon 90 days written notice of its own convenience. 2.0 -3- 3222.
