HomeMy WebLinkAbout20231187.tiffRESOLUTION RE: ACTION OF THE BOARD AT SHOW CAUSE HEARING, PCSC22-0013, CONCERNING MINOR AMENDED USE BY SPECIAL REVIEW PERMIT, MUSR14-0008, FOR A KENNEL TO INCREASE THE NUMBER OF DOGS ALLOWED FROM 16 TO 30 IN THE A (AGRICULTURAL) ZONE DISTRICT - SCOTT AND KRISTIN FISHER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on February 22, 2023, a Show Cause Hearing was scheduled to consider revocation of Minor Amended Use by Special Review Permit, MUSR14-0008, for a Kennel to increase the number of dogs allowed from 16 to 30 in the A (Agricultural) Zone District, issued to Scott and Kristin Fisher, 32614 County Road 23, Windsor, Colorado 80550; however, due to inclement weather conditions on February 22, 2023, the case was rescheduled to the following Wednesday, March 1, 2023, per the updated and published Agenda, and WHEREAS, Scott and Kristin Fisher are the current owners of the facility located on property being further described as follows: Lot B of Recorded Exemption, RECX15-0100; being part of the E1/2 NE1/4 of Section 23, Township 6 North, Range 67 West of the 6th P.M., Weld County, Colorado WHEREAS, at said hearing on March 1, 2023, the Board of County Commissioners heard all of the testimony and statements of staff, and having been fully informed, deemed it advisable to continue said hearing until March 29, 2023, at 9:00 a.m., to allow Mr. and Mrs. Fisher to be present, and WHEREAS, at said hearing on March 29, 2023, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the permit holder, and the recommendation of Planning staff, and having been fully informed, deemed it advisable to continue the matter to April 26, 2023, to allow the Fishers additional time to address outstanding issues, and WHEREAS, at said hearing on April 26, 2023, the Board of County Commissioners heard all of the testimony and statements of those present, and the recommendation of Planning staff, and having been fully informed, deemed it advisable to continue the matter to May 17, 2023, to allow additional time for the certified engineer to provide a letter certifying the structure, as built, and cc : PL(rP/aW /DR), CA (B6), APR-. The Department of Planning Services received a letter from Quantum dated May 1, 2023. Per the Building Official the letter from the engineer is acceptable. Staff is requesting a notarized document from the owners stating they will comply to the engineer's letter and if the usage or occupancy of the space above the barn changes in any significant way it is the responsibility of the property owner to adequately address this change with an additional permit, per adopted code and local ordinance. Building permit # CMA22-0029 for the 9x24 uncovered deck is now considered a complete application and shall continue being processed through the building department. Inspections will be schedule through the building department. Two Probable Cause hearings have been held one on August 22, 2022 and one on November 28, 2022. The Board of County Commissioners set the Show Cause hearing for March 1, 2023 and continued it to March 29, 2023, April 26, 2023, and May 17, 2023 in order to determine if the applicant is in compliance with the following Development Standards: MUSR14-0008 Development Standards #21, 26, and 27 state: 21. The operation shall comply with all applicable rules and regulations of State and Federal agencies and the Weld County Code. PCSC22-0013 I Show Cause I Fisher Page 1 of 5 26. The Use by Special Review area shall be limited to the plans shown hereon and governed by the foregoing standards and all applicable Weld County regulations. Substantial changes from the plans or Development Standards, as shown or stated, shall require the approval of an amendment of the Permit by the Weld County Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 27. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. A letter of intent was required to convert the existing residence to storage. VI -0600469 a code violation case was started due to a kennel on the site without permits. USR-1596 was approved for a 16 -dog maximum kennel and the violation was closed. BCR08-00314 Change of Use for an existing 448 sf addition to the barn. The construction was finished prior to the building permit being issued. Included 6 kennels. (Note: Ensure the 2nd house on the property has been converted to storage.) COMP13-00248 Complaint of large amounts of RVs being stored on the site and PACFA indicated that there were at least 22 dogs on which exceeded the 16 -dog limit. PCSC13-0008 land use violation opened due to the RV storage and the addition of more dogs than allowed under USR-1596. MUSR14-0008 recorded increasing the number of dogs to 30. Per the applicant the RV storage is for friends and family and they are not receiving any payment for the storage of these RVs. Recorded RECX15-0100 and reduced the size of the property to about 10 acres. PCSC21-0038 land use violation opened due to the existence of more than the allowed number of dogs on the site. Per a site inspection the number of dogs was in compliance, but it was noted that there were additional buildings and a new deck/staircase on the site. COMP21-00316 / BCV21-00061: a building violation was opened due to the construction of the deck with no building permits. Additionally, no building permits were located for the cargo containers. Per Compliance Officer's Records: A Courtesy Letter was sent to the applicant. Per Compliance Officer's Records: Notice of Violation letter was sent with a deadline of January 6, 2022. Per Compliance Officer's Records: a Notice of Intent letter was sent to the applicant. Per Compliance Officer's Records: Ms. Fisher picked up a blank building permit application form. An extension was granted to February 25, 2022. Building permits submitted and the two for the cargo containers have been issued: CMA22-0019 for a cargo container to used for the business. Not intended to be used for the housing of animals. This cargo container does not meet the setback from CR 23. ASN22-0053 Cargo container for personal storage. The required setback from the ditch is 75 feet and the cargo container is currently about 30 feet from the ditch. CMA22-0029 9x24 uncovered deck added to commercial building which was built in 1920. The 1920 barn is 20 feet from CR 23. The required setback is 60 feet. PCSC22-0013 land use violation opened due to the buildings requiring building permits and the possible requirement for an Amendment to the USR. The initial Probable Cause letter was sent to the applicant certified mail. The applicant called the Department of Planning Services and after a brief conversation with staff indicated that she would submit the PreApplication Request form and as of August 9, 2022, no PreApplication Request form has been received. A certified mailing receipt was received by staff on, which indicated that the initial Probable Cause certified letter had been signed for on June 30, 2022, by the applicant. The deadline on the June 27, 2022, letter was June 30, 2022. It was noted, per Google mapping program, that there is a Laser Engraving Designs business on the site. The Probable Cause notification letter was sent to the property owners to meet the notification requirements of Chapter 2, Article IV, Section 2-4-40.E.1. In a phone conversation with Ms. Fisher she indicated that she had misplaced the PreApplication form and asked that I sent it to her via email so she could fill it out. The form was sent. Probable Cause hearing. This hearing was continued to November 16, 2022. Applicant submitted a PreApplication request form. The PreApplication meeting was held on September 8, 2022. A setback exhibit was submitted that shows that the barn is outside of the right-of- way but still in the setback. Staff is requiring a Nonconforming Structure permit application be submitted for this encroachment into the setback. The two (2) building permits for the cargo containers, CMN22-0019 and ASN22- 0053, were issued. Applicant requested that the November 16, 2022 Probable Cause hearing be PCSC22-0013 I Show Cause I Fisher Page 3 of 5 rescheduled. The case was rescheduled to November 28, 2022. November 28, 2022 November 28, 2022 November 30, 2022 December 14, 2022 February 22, 2023 February 25, 2023 March 24, 2023 March 29, 2023 April 3, 2023 May 1, 2023 Background: June 10, 2014 September 11, 2014 February 29, 2016 Probable Cause hearing. The Board of County Commissioners set a Show Cause hearing date for February 22, 2023. The applicant stated that they wish to discuss the required items with staff. Staff left a voicemail for the applicant requesting a return call to set up the requested meeting and sent an email requesting the submittal of the Nonconforming Structure permit application. Staff left a second voicemail for the applicant requesting a return call to set up the meeting. Staff sent a letter via email, first class mail, and certified mail outlining four (4) separate dates that staff would be available to meet and discuss this case. Receipt of the certified letter was confirmed. No response from the applicant was received. Show Cause hearing was rescheduled to March 1, 2023 due to a weather closing of the County offices. Request from the applicant received to reschedule the Show Cause Case because they are unable to make the March 1, 2023 hearing. Hearing rescheduled to March 29, 2023. The applicant requested a meeting with staff prior to the March 29th hearing to discuss the case. The applicant met with staff to discuss the outstanding items. Staff provided the information to the applicant about the need for an as -built engineering analysis for the foundation and deck structure, a Change of Use permit and an as -built engineering analysis for the interior remodel of the upper level of the barn, and an engineered foundation for the construction trailer. The applicant submitted the Non -Conforming Structure Permit for the barn that encroaches into the setback. Show Cause hearing. The Board of County Commissioners continued the Show Cause hearing to April 26, 2023 because the applicant stated that they had called and spoken to Quantum Structural Engineering and Design, LLC and that an engineer is scheduled to visit the site. The Assistant Building Official, Mr. Adriaens, spoke to one of the engineers from Quantum and discussed County requirements prior to Quantum visiting the site. Staff has not heard back from the engineer or the applicant. Mr. Deacon Maggard, P.E. of Quantum Structural Engineering & Design submitted a stamped and signed engineering letter. Approval of MUSR14-0008 administratively by the Department of Planning Services for: A Minor Amendment to a Site Specific Development Plan and Use by Special Review Permit No. 1596 (kennel for 16 dogs of a non -specified breed) to increase the number of dogs allowed from 16 to 30. The MUSR14-0008 map was recorded under reception #4045051 Partial Vacation of MUSR14-0008 map recorded under reception #4184030 PCSC22-0013 I Show Cause I Fisher Page 4 of 5 SHOW CAUSE CODE SECTION/CONSIDERATIONS: Section 2-4-50.O. of the Weld County Code: Where the Board is considering the revocation or suspension of a permit or license, including but not limited to uses by special review and permits issued under Chapter 21, but specifically excluding liquor licenses, the Board shall consider evidence and statements in mitigation and in aggravation of the violation prior to determining the appropriate penalty. Such evidence and statements may relate to and include, but not be limited to, the following: 1. The compliance history of the party against whom the complaint was made with respect to the permit at issue or other County -issued permits. 2. Good faith efforts on behalf of the person against whom the complaint is made to comply. 3. Duration of the violation. 4. Economic benefit of noncompliance to the person against whom the complaint is made. 5. Impact on, or threat to, the public health or welfare or the environment as a result of the violation. 6. Malfeasance. 7. Whether legal and factual theories were advanced for purposes of delay. In addition to the factors set forth in this Subsection, the following circumstances shall be considered as grounds for reducing or eliminating penalties: 8. The voluntary and complete disclosure by the person against whom the complaint is made of such violation in a timely fashion after discovery of the noncompliance. 9. Full and prompt cooperation by the person against whom the complaint is made following disclosure of the violation, including, when appropriate, entering into a legally enforceable commitment to undertake compliance and remedial efforts. 10. The existence and scope of a regularized and comprehensive environmental compliance program or an environmental audit program. 11. Substantial economic impact of a penalty on the violator. 12. Other mitigating factors. Where a civil penalty in lieu of suspension is available, the Board shall first impose the revocation or a term of suspension. The amount of the civil penalty shall then be determined on the basis of imposing an economic penalty equivalent to the loss which would have occurred had the facility not operated during the term of the suspension. A portion of the civil penalty may be deferred on the condition that certain actions to correct the violation be taken. The failure to pay the civil assessment will result in imposition of the suspension. I have in the past found that people have been walking dogs on my property without permission. If you have noticed, all the neighbors to the Fishers have posted Private Property, Do Not Trespass signs on their properties. I had to post signs to keep people from using private property in the country as for public use. People seem to no longer respect other people's property. Even by closing gates on my lane, people just go through the gate and walk their dogs. Recently, have not had much problem, but it could be because the winter has had more cold and snow than we have had in the past couple of years. I am against the fishers increasing the number of dogs at their kennel. At times, you can hear a number of dogs barking that comes from their place. This always makes me think that there are problems when you have dogs barking. My client(s) own the farm land immediately to the west of the Applicants property and have strong concerns about their request for expanded use. These concerns regard a pattern of trespassing by the Applicants or their clients as they exercise and walk their dogs. The owners have "interacted" frequently with the trespassing individuals and believe that this will only become a greater problem if their use is expanded to double of what their apparently permitted occupancy levels are. While we respect their business and could agree that expansion could, (under the proper sanitation, density, and safety conditions) be beneficial to the community at large. That "benefit" would only occur, in our view, if strict and enforceable restrictions were placed on their activities outside of their own property lines. We ask that if the Commissioners approve this application, that the approval be conditioned upon no incursions on adjacent properties. We believe such a condition is not only respectful of neighbors and the community but also fairly respects the Applicants' rights of use of their own property. While on site, I observed the items of concern voiced by the county official which included the wood deck, the support system within the barn for the second floor, and the storage and mobile units nearby. • The exterior deck seems to be supported adequately with the existing support system that had been previously installed and the additional lateral support that was added just after I visited the site which you showed me digitally. • The second floor of the barn during the visit was being used to kennel a handful of dogs (10 or less) and it seems that only a few people are in that space at any given time. It should be noted that the existing structure supporting the second floor of the barn with its present light -weight usage and low human occupancy should be sufficient in theory however if the usage or occupancy of this space changes in any significant way, it is the responsibility of the property owner to address this change adequately per adopted code and local ordinance. • The single metal storage container adjacent to the barn and the three mobile building units south of the barn which were not affixed to any anchors or foundation during the observation needed to be anchored to the ground. I mentioned to you that I would feel comfortable with adding a few 30 inch screw anchors to the shorter ends of each unit. I recommended a few options and you showed me digitally that each of the mobile units received one installed anchor per end. The smaller metal unit received one anchor per corner. This anchoring system seems to be adequate to resist movement during high wind scenarios. Should the owner desire more factors of safety in this field, more screw anchors can be added at the owner's will. For a much stronger, resistive, and permanent solution, the mobile units can be fixed to an engineered concrete or masonry foundation system at the owner's discretion at a future date. This visual site observation was performed at the request of you (the owner) and via Weld County Building Department officials. It is intended to provide a professional overview of the items in question and ensure current code and safety compliance. Any items not discussed or observed during the site visit or afterward, or any changes made by the property owner that were/are not addressed, are the sole responsibility of the property owner. Any hardware that was installed in the systems in question prior to or after the site observation are to be installed following the manufacturer's instructions.
