RE: APPROVE MEMORANDUM OF UNDERSTANDING FOR TRANSLATION SERVICES
AND AUTHORIZE CHAIR TO SIGN - IMMIGRANT AND REFUGEE CENTER OF
NORTHERN COLORADO, DBA SUNRISE COMMUNITY HEALTH
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Memorandum of Understanding for
Translation Services between the County of Weld, State of Colorado, by and through the Board
of County Commissioners of Weld County, on behalf of the Department of Human Services, and
Immigrant and Refugee Center of Northern Colorado, dba Sunrise Community Health,
commencing July 1, 2023, with further terms and conditions being as stated in said memorandum
of understanding, and
WHEREAS, after review, the Board deems it advisable to approve said memorandum of
understanding, a copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Memorandum of Understanding for Translation Services
between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of the Department of Human Services, and Immigrant
and Refugee Center of Northern Colorado, dba Sunrise Community Health, be, and hereby is,
approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said memorandum of understanding.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 9th day of August, A.D., 2023, nunc pro tunc July 1, 2023.

Request Board Approval of Request Board Approval of the Department's Immigrant and Refugee Center of
Northern Colorado (IRCNoCo) dba Sunrise Community Health Memorandum of Understanding. The
Department is requesting to enter into a Memorandum of Understanding (MOU) with the Immigrant and Refugee
Center of Northern Colorado (IRCNoCo) dba Sunrise Community Health for Translation Services. Sunrise will
assist Weld County in providing client translation and interpretation in the client or service provider's home, office,
or agreed upon meeting location. The purpose of this MOU is to raise the levels of informed consent for limited -
English proficiency communities.
The term of this agreement is July 1, 2023 and is in perpetuity.

PARTIES: This Memorandum of Understanding (MOU) outlines the terms and understanding
between Immigrant Refugee Center of Northern Colorado (IRCNoCo) dba Sunrise Community
Health ("Sunrise") and Weld County Department of Human Services ("Weld County"). Each
signatory of this MOU may be referred to as "IRCNoCo dba as Sunrise," and collectively as
"IRCNoCo dba Sunrise". Upon execution this agreement will remain in effect until terminated
by either party.
Sunrise, a Community Health organization, is a federally qualified health center that provides
primary care to the population in Northern Weld and Southern Larimer Counties and is located at
2930 11`h Avenue. Evans, CO 80620. IRCNoCo is a non-profit organization serving refugees and
immigrants in the Northern Colorado region. ESL, citizenship classes, digital literacy classes,
and community navigation are our main services. We are located at 3001 8`h Avenue, Evans,
CO, 80620.
PURPOSE:
This MOU dated July 1, 2023 sets forth the understanding between Sunrise and Weld County
related to the partnership of services between parties for limited -English proficiency clients.
Sunrise will assist Weld County in providing client translation and interpretation in the client or
service provider's home office or agreed -upon meeting location. The purpose of this agreement
is to raise the levels of informed consent for limited -English proficiency communities, such that
the services they are receiving are best suited to their unique needs.
Both Sunrise and Weld County intend and understand that this MOU is not a legally binding
contract and that neither party, nor any third person, may recover damages from, or require the
performance of the MOU in the event the other agency does not act as described in this
document.
RECITALS:
Both parties are committed to performing the requirements outlined in this MOU. Any breach of
this MOU will first require a meeting for reconciliation. Any second breach of the MOU will
cause either party to terminate the agreement.
Sunrise will:
1. Collaborate with and assist Weld County by connecting a language -appropriate
Community Navigator on staff to the client in need.
2. Respond to requests for translation and interpretation within 24 hours of the request being
made, provided the request is made during the regular Sunrise work week (Monday —
Thursday, 8:00am-3:00pm).
3. Maintain strict confidentiality of protected client information between the agency serving
the client and the client.

4. Sunrise will record time spent providing translation/interpretation for clients of the
partner agency, and invoices for time spent will be sent at the end of each month.
5. Sunrise reserves the right to refuse a meeting time during the initial intake, based upon
client needs at the home campus. Sunrise understands navigators' priorities as being first
with the center and clients of Sunrise, and second to the arranged agreement.
Weld County will:
1. Reimburse Sunrise for the hours that Sunrise navigators spend assisting with client needs.
This reimbursement will be according to the fixed-rate use of hours as attached to this
MOU. All approved invoices should be sent to Sunrise accounts payable
(accountspayable@nocoha.org).
2. Act as the requester and scheduler for client meeting times. It will be incumbent upon the
partnering agency to schedule a time with their own client after arranging a time to meet
with the navigator.
3. Respect navigator's wishes to opt -out of translation and interpretation at any point if the
situation is beyond his or her level of knowledge or if the client is known to the
navigator.
4. Respect the time agreement for translation and interpretation services and not request
more services once the navigator is present.
Both parties agree that:
1. Hours and staffing patterns will be dependent upon demand and resources available and
will be determined by mutually agreed upon negotiations.
2. Neither party is responsible for the payment of fees due to the other agency by the client.
3. Both parties are legally independent of each other, and no legal arrangement exists
between both parties as either agent, employee, or servant of the other. Furthermore, each
party will provide adequate liability insurance for their employees and services.
4. The agencies will actively cooperate with each other by providing information requested
in a timely manner and assist the other agency in its efforts to provide services outlined in
the grant.
5. Interagency difficulties of a programmatic nature will be resolved through a dialogue
between the respective program directors.
6. This MOU may be terminated by either Party at any time without cause upon 90 days
advanced written notice of a Party's termination of this MOU provided to the other Party.
7. Navigators will not fill out forms on behalf of any clients.
