It is noted that an acceptable traffic study has not been received. This study may result in revisions to this referral. COMMENTS GENERAL PROJECT INFORMATION/LOCATION Project description: A Site -Specific Development Plan and Use by Special Review Permit for Event Facilities (not agriculture -related) outside of subdivisions and historic townsites in the A (Agricultural) Zone District. Parcel number: 146921000074 and 146916000056: Parcel B of AMRE-936. Access is onto CR 8 - AP22-00128 Residential. ACCESS Development Review has reviewed the application materials related to access. There is an existing permitted access point onto CR 8 — AP22-00128 Residential. The applicant shall revise the access permit from "Residential" to "Commercial." This may involve an upgrade to the access to meet design and safety criteria in Chapter 8 of the Code. Per Sec. 8-14-30, an Access Permit is required for access to Weld County maintained roadways. We strongly encourage you to discuss your access location with Development Review prior to laying out your site plan. All "preliminarily approved" accesses are subject to change during the access permitting process. Please refer to Chapter 8 of the Weld County Code for more information regarding access. ROADS AND RIGHTS -OF -WAY County Road 8 is a gravel road and is designated on the Weld County Functional Classification Map (Code Ordinance 2017-01) as a local road, which requires 60 feet of right-of-way. The applicant shall delineate on the site map the future and existing right-of-way and the physical location of the road. If the right-of-way cannot be verified it shall be dedicated. Pursuant to the definition of setback in the Weld County Code Sec. 23-1-90, the required setback is measured from the future right-of-way line. Be aware that physical roadways may not be centered in the right-of-way. This road is maintained by Weld County. Per, Sec. 8-13-30.B, a Weld County Right -of -Way Use Permit is required for any project that will be occupying, constructing or excavating facilities within, and/or encroaching upon, any County rights -of -way or easement. Right -of -Way Use Permit instructions and application can be found at https://www.weldgov.com/departments/publicworks/permits/. Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate existing utilities within the County right-of-way. TRAFFIC There are no recent traffic counts for this portion of CR 8. The applicant submitted a Final Traffic Letter stating that there will be a maximum of 260 passenger vehicle trips per event with 85% traveling east on CR 8 and 15% traveling west on CR 8. No other traffic information is needed at this time. TRACKING CONTROL Tracking control is required to prevent tracking from the site onto public roadways. For access to paved roads, tracking control devices can be double cattle guards with 100 ft. of asphalt or 300 ft of asphalt. For access to gravel roads, tracking control devices must be either double cattle guards with 100 ft. of road base, or road base on all driving surfaces. Temporary Tracking Control shall be used during construction unless permanent tracking control is installed ahead of construction activities. Recycled concrete is not allowed in County right-of-way. Tracking control for unmaintained public right-of-way is required just prior to entering publicly maintained roadways. A variance request for alternatives to the tracking control requirement can be submitted to Development Review for review and consideration. This site requires double cattle guards and 100 ft. of road base or road base on all driving surfaces IMPROVEMENTS AND ROAD MAINTENANCE AGREEMENT WITH UP -FRONT IMPROVEMENTS Development Review is requesting an Improvements and Road Maintenance Agreement for dust control, damage repairs to specified travel routes, triggered off -site improvements, and up -front improvements. The Agreement shall include the requirement for the submission of an acceptable traffic management plan to direct exiting traffic to CR 8 east to CR 19. Upfront improvements of CR 8 shall extend from 100 feet west of the access to the intersection of CR 8 and CR 19. Additionally, the finished road surface shall match the existing driveways. The up -front improvements shall include but not be limited to: • Widen CR 8 as necessary to meet the 26 -foot -wide criteria as specified in the Code; • Provide a crown on CR 8 of 3% to center of road and 3-4% in the super elevations on the curves; • Provide compacted subgrade to meet criteria as specified in the Code; and, • Finish driving surface of CR 8 with 4" of compacted RAP base with a topical application of mag chloride, as specified in the Code. The triggered improvements shall include, but not be limited to, warranted upgrades to the travel routes. Maintenance of this portion of CR 8 shall include, but not be limited to, mag chloride, as needed, in addition to the annual application provided by the County. It will detail the approved haul route(s), outline when up -front off -site improvements, designate when other off -site improvements will be triggered, and include a maintenance agreement for the haul routes. DRAINAGE REQUIREMENTS This area IS within a Non -Urbanizing Drainage Area: Non -Urbanizing Drainage Areas typically require detention of runoff from the 1 -hour, 100 -year, storm falling on the developed site and release of the detained water at the historic runoff rate of the 1 -hour, 10 -year storm falling on the undeveloped site for Non - urbanizing areas. Detention pond waived and a simple drainage narrative: The applicant has submitted an acceptable drainage narrative stating that the site meets drainage exception 11. An individual parcel with an unobstructed flow path and no other parcel(s) between the Federal Emergency Management Administration (FEMA) regulatory floodplain channel and the project. Located in Sec. 8-11-40. Drainage Policy. The stormwater discharge is proposed to North Star Reservoir. This reservoir includes a jurisdictional dam regulated by Colorado Division of Water Dam Safety. A July 31, 2023, e-mail from the CDWDS stated that the additional stormwater to the Reservoir would not impact the 100 -year rainfall routing through the North Star Reservoir spillway. No additional stormwater management information is needed, at this time. Historic Flows: The applicants will be required to maintain the historic drainage flows and run-off amounts that exist from the property. GRADING PERMIT A Weld County Grading Permit will be required if disturbing more than 1 acre. Grading Permit applications are accepted after the planning process is complete (plan recorded). An Early Release Request Form may be entertained only after the applicant, Public Works and Planning Department have reviewed the referral and surrounding property owner comments. The Early Release Request may or may not be granted depending on referral comments and surrounding property owner concerns. Contact an Engineering representative from the Development Review for more information. A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. (Development Review) Weld County Department of Public Health and Environment Memorandum To: Chris Gathman From: Lauren Light, Environmental Health Services Date: July 18, 2023 Re: USR23-0025 Applicant: Sandra Strobel Environmental Health Services has reviewed this proposal for a Site Specific Development Plan and Use by Special Review Permit for Event Facilities (not agriculture -related) outside of subdivisions and historic townsites in the A (Agricultural) Zone District. The patrons must have access to potable water, restrooms, and hand washing facilities. The residence is served by an on -site wastewater treatment system (OWTS) which is sized for 3 bedrooms (F19790026) and water is supplied by a domestic well (86911-F). The well is permitted for residential and commercial uses. The applicant is proposing to use portable toilets for the public until a commercial OWTS is installed. Portable toilets are acceptable for recreational facilities that are utilized 6 months or less per year in accordance with EH policy. If the events exceed 6 months, then a permanent water source and an OWTS must be installed to provide for business use. Waste and recycling bins will be provided for every event. Waste will be stored in a dumpster and will be emptied on a weekly schedule. Dust abatement will be provided by utilizing recycled asphalt on driveways and parking areas and adding a dust suppressant as necessary. Noise is restricted to the residential limit and is measured 25 feet from the property line. A noise study was conducted by the applicant. The study included 7 monitoring points around the property, and all indicated a noise level less than the residential level without mitigation. All food vendors, which includes food trucks, and catering must adhere to the Colorado Retail Food Establishment Rules and Regulations. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. The applicant shall operate in accordance with Chapter 14, Article 1 of the Weld County Code, and the accepted waste handling plan. 4. Fugitive dust should attempt to be confined on the property. Uses on the property should comply with the Colorado Air Quality Commission's air quality regulations and the accepted dust abatement plan. 5. This facility shall adhere to the maximum permissible noise levels allowed in in the Residential Zone as delineated in 25-12-103 C.R.S. The facility shall operate in accordance with the accepted noise study. 6. Temporary uses that are utilized for a time period of six months or less, portable toilets and bottled water are acceptable. Records of maintenance and proper disposal for portable toilets shall be retained on a quarterly basis and available for review by the Weld County Department of Public Health and Environment. Portable toilets shall be serviced by a cleaner licensed in Weld County, contain hand sanitizers and be screened from public view. If events exceed the above requirement, then a permanent water source and an On -site Wastewater Treatment System must be established to provide for business use. 7. Any On -site Wastewater Treatment System located on the property must comply with all provisions of the Weld County Code, pertaining to On -site Wastewater Treatment Systems. 8. Adequate drinking, hand washing, and toilet facilities shall be provided for employees and patrons of the facility, at all times. All "Imminent Travel Lanes" for all commercial projects will need to be 26' that is unobstructed. Gates securing the fire apparatus access roads shall comply with all of the following criteria: 1. The minimum gate width shall be 20 feet (6096 mm). 2. Gates shall be of the swinging or sliding type. 3. Construction of gates shall be of materials that allow manual operation by one person. 4. Gate components shall be maintained in an operative condition at all times and replaced or repaired when defective. 5. Electric gates shall be equipped with a means of opening the gate by fire department personnel for emergency access. Emergency opening devices shall be approved by the fire code official. 6. Manual opening gates shall not be locked with a padlock or chain and padlock unless they are capable of being opened by means of forcible entry tools or when a key box containing the key(s) to the lock is installed at the gate location. 7. Locking device specifications shall be submitted for approval by the fire code official. 8. Electric gate operators, where provided, shall be listed in accordance with UL 325. 9. Gates intended for automatic operation shall be designed, constructed and installed to comply with the requirements of ASTM F 2200. A knoxbox or knoxSwitch is acceptable for emergency access. A KnoxSwitch shall require an electrical back up system. Either a battery backup system or generator back up system.
