HomeMy WebLinkAbout20233585.tiff HEARING CERTIFICATION DOCKET NO.2023-84 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND PLANNED UNIT DEVELOPMENT FINAL PLAN, PUDF23-0002, FOR SIX(6) RESIDENTIAL LOTS WITH E(ESTATE)ZONE DISTRICT USES AND ONE(1)NON-BUILDABLE OUTLOT WITH A(AGRICULTURAL) ZONE DISTRICT USES-AMANDA,BRANDON,LISA,AND MORIAH NGUYEN A public hearing was conducted on December 13,2023,at 10:00 a.m.,with the following present: Commissioner Mike Freeman,Chair—EXCUSED Commissioner Perry L.Buck,Pro-Tem Commissioner Scott K.James Commissioner Kevin D.Ross Commissioner Lori Saine Also present: Acting Clerk to the Board,Jan Warwick Deputy County Attorney,Karin McDougal Department of Planning Services representative,Maxwell Nader Department of Public Health and Environment representative,Lauren Light The following business was transacted: I hereby certify that pursuant to a notice dated October 17, 2023, and duly published October 20,2023,in the Greeley Tribune,a public hearing was conducted to consider the request of Amanda,Brandon,Lisa and Moriah Nguyen,for Site Specific Development Plan and Planned Unit Development Final Plan, PUDF23-0002,for six(6)residential lots with E(Estate)Zone District uses and one (1) non-buildable out lot with A (Agricultural) Zone District uses. Karin McDougal,Deputy County Attorney,made this a matter of record. El Maxwell Nader,Department of Planning Services,presented a brief summary of the proposal, stated this is the third and final step of the proposed PUD,he shared the location of the site and described the surrounding large lot platted subdivisions and varying Uses.He relayed the site is located within the City of Fort Lupton's Coordinated Planning Agreement boundary.He described the sign posting and shared staff sent Notice to 18 surrounding property owners(SPOs),and three(3)letters of concern were received regarding additional lots,additional traffic,and potential issues that more water wells could bring to the local geological water conditions.He shared,per the Development Review staff,the parcel has an existing unimproved access onto County Road (CR)31,which is under the jurisdiction of the City of Brighton and shall be upgraded to comply with standards specified by Weld County and the City of Brighton,who will issue access and right-of-way permits.He also relayed,the internal road will be used by residential,agricultural, and oil and gas traffic,and a Traffic Report will be required.Mr.Nader stated an Improvements and Road Maintenance Agreement will be required for up-front,on-site and off-site improvements required by the City of Brighton and shall include dust control and damage repair to specified travel routes.Additionally,he relayed an acceptable Drainage Narrative stating the site meets the drainage detention exception has been received.He pointed out the location of the PUD,which is located within the three(3)mile referral area of Adams County,City of Brighton,City of Fort cc:P�(ER/NtN/ti4.1f DA) 2023-3585 P L2853 O I/24/24 HEARING CERTIFICATION - AMANDA, BRANDON, LISA, AND MORIAH NGUYEN (PUDF23-0002) PAGE 2 Lupton,and Town of Lochbuie.Mr.Nader entered the favorable recommendation of the Planning Commission into the record,as written,and displayed images of the site and surrounding views. In response to Commissioner Ross,Mr.Nader confirmed the ditch crossing will not be affected, the existing home is directly east of the ditch,and the lot sizes will be approximately three(3) acres. El Lauren Light,Department of Public Health and Environment,shared the lots are sized to meet the minimum size requirement for this type of request,the County Attorney's Office has approved the source of water for the individual wells,a Septic Report,was completed by Hinkley Engineering which conveyed conventional septic systems should be feasible, and staff has recommended several notes related to water,sewer,and dust control during development,to be placed on the plat prior to recording.In response to Commissioner Ross,Ms.Light relayed the Division of Water Resources issues permits for each lot which are typically domestic wells. Chair Pro-Tem Buck reviewed the procedures to follow should the case result in a tie vote, due to four(4)Commissioners being present with Chair Freeman being excused.Lisa Nguyen, Applicant,relayed the remaining five(5)lots will be occupied by family members. No public testimony was offered concerning this matter. The Board reviewed the Conditions of Approval. In response to Commissioner Ross, Ms.Light confirmed each building permit will require its own well permit. In response to Commissioner James,Ms.Light confirmed the septic report is separate from the wells.The Board made no changes or corrections to the Conditions of Approval. ''In response to Chair Pro-Tem Buck,Ms.Nguyen indicated they have reviewed,and agreed to abide by,the Conditions of Approval,as presented. El Commissioner Saine moved to approve the request of Amanda,Brandon,Lisa,and Moriah Nguyen, for Site Specific Development Plan and Planned Unit Development Final Plan, PUDF23-0002, for six (6) residential lots with E (Estate) Zone District uses and one (1) non-buildable out lot with A(Agricultural)Zone District uses,based on the recommendations of Planning staff and the Planning Commission,with the Conditions of Approval,as presented.The motion was seconded by Commissioner James,and it carried unanimously.There being no further discussion,the hearing was completed at 10:41 a.m. 2023-3585 PL2853 HEARING CERTIFICATION - AMANDA, BRANDON, LISA, AND MORIAH NGUYEN (PUDF23-0002) PAGE 3 This Certification was approved on the 27th day of December,2023.
