RE: ACTION OF THE BOARD AT PROBABLE CAUSE HEARING, PCSC22-0021,
CONCERNING USE BY SPECIAL REVIEW PERMIT, USR11-0004 - DONN FOSTER
AND MARY LEE HARDY, C/O FOSTER TRUCKING, INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on the 1st day of February, 2023, a Probable Cause Hearing was held before
the Board to consider setting a Show Cause Hearing to determine whether or not Donn Foster
and Mary Lee Hardy, c/o Foster Trucking, Inc., P.O. Box 513, Kersey, Colorado 80644, was in
compliance with certain Development Standards contained in Use by Special Review Permit,
USR11-0004, for an Oil and Gas Support Facility (water hauling) and any Use Permitted as a Use
by Right, Accessory Use, or Use by Special Review in the Commercial or Industrial Zone Districts
(maintenance and fabrication of new and existing trucks), provided that the property is not a lot in
an approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any
regulations controlling subdivisions, in the A (Agricultural) Zone District, and
WHEREAS, the alleged violations were said to be occurring on property being further
described as follows:
Lots A and B of Recorded Exemption, RE -4573;
being part of the N1/2 SW1/4 of Section 1,
Township 5 North, Range 65 West of the 6th P.M.,
Weld County, Colorado
WHEREAS, the Board heard all of the testimony and statements of those present and,
having been fully informed, finds the matter should be continued to July 12, 2023, 2023, at
9:00 a.m., to allow the permittees adequate time to bring the site into compliance.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the abovementioned matter be, and hereby is, continued to July 12, 2023,
at 9:00 a.m.

Site Inspection — January 25, 2023
23436 County Road 60.5, Greeley
The January 25, 2023 site inspection determined that little had changed since the October 27, 2022
inspection. The vegetation in the water quality pond was dormant knocked down by the snow events.
The asphalt millings placed over a large majority of the site assisted in limiting the mud being tracked
onto County Road 60.5.
A breach in the ditch wall approximately 200 feet east of the western property line had grown in
both width and depth, although there may have been an attempt to mitigate the erosion by placing
concrete debris in the breach to restrict furth degradation.
Three items previously identified have been addressed and are highlighted.
Based on the three aforementioned inspections a review of the Improvements Agreement According to
Policy Regarding Collateral for Improvements between the County of Weld, State of Colorado, by and
through the Board of County Commissioners of Weld County, and Foster Trucking, Inc., / Donn Foster
and Mary Lee Hardy and the recorded Corrected USR11-0004 Map, County staff finds the following non -
complaint issues:
• The site's access does not have the required 60 -foot radii.
• The site's permanent tracking control has not been constructed to include the required 100 -foot
asphalt pavement and back-to-back double cattle guards.
• The access culvert has not been addressed to allow for positive drainage.
• The stop sign is not in the specified location.
• The haul route signs have not been installed at the site's exit location.
• The pipe rail fence running parallel to CR 60.5 still encroaches into the County's right-of-way.
• The western and southern gravel truck parking areas, stall delineations, and bollards have not
been constructed per the recorded Corrected USR11-0004 Map.
• The breach of the water quality pond bank has not been properly repaired.
• Vegetation in the water quality pond still exceeds the maximum height of 12 inches specified in
the Development Standards.
• The parking stall striping, and ADA (handicap) symbol have not been installed on the concrete
pavement next to the building.
• The trash dumpster has not been screened.
• Off-street parking spaces had not been graded to prevent drainage problems.
• The new breach of the Ogilvy Ditch has not been repaired.
• Stormwater capture/quantity has not taken into consideration nor had best management
practices been provided as prescribed by the Development Standards.
• The 3,000 gallon above ground diesel fuel tank has not been removed.

Range 65 W). As you know, our firm represents the Ogilvy Land and Irrigating Company ("Ogilvy"), which
owns and operates the Ogilvy Ditch.

unaware of any agreement, verbal or otherwise, authorizing the drainage of surface flows directly into the

• The site's access does not have the required 60 -foot radii.
• The site's permanent tracking control has not been constructed to include the required 100 -foot asphalt
pavement and back-to-back double cattle guards.
• The access culvert has not been addressed to allow for positive drainage.
• The stop sign is not in the specified location.
• The pipe rail fence running parallel to CR 60.5 still encroaches into the County's right-of-way.
• The western and southern gravel truck parking areas, stall delineations, and bollards have not been
constructed per the recorded Corrected USRII-0004 Map.
• The breach of the water quality pond bank has not been properly repaired.
• The parking stall striping, and ADA (handicap) symbol have not been installed on the concrete
pavement next to the building.
• Off-street parking spaces had not been graded to prevent drainage problems.
• The new breach of the Ogilvy Ditch has not been repaired.
• Stormwater capture/quantity has not taken into consideration nor had best management practices been
provided as prescribed by the Development Standards.
• The 3,000 gallon above ground diesel fuel tank has not been removed.

Additionally, the inspections have determined that the site is currently not in compliance
with the following Development Standards contained in the BOCC recorded resolution
and listed on the recorded Corrected USRII-0004 Map:
Development Standard No. 1
The Site Specific Development Plan and Use by Special Review Permit, USRII-0004, is
for an Oil and Gas Support Facility (water hauling) and any Use Permitted as a Use by
Right, Accessory Use, or Use by Special Review in the Commercial or Industrial Zone
District (maintenance and fabrication of new and existing trucks), provided that the
property is not a lot in an approved or recorded subdivision plat or part of a map or plan
filed prior to adoption of any regulations controlling subdivisions, in the A (Agricultural)
Zone District, as indicated in the application materials on file and subject to the
Development Standards stated hereon
Development Standard No. 16
The operation shall comply with all applicable rules and regulations of state and federal
agencies and the Weld County Code
Development Standard No. 18
Pursuant to Chapter 15, Articles I and II, of the Weld County Code, if noxious weeds exist
on the property, or become established as a result of the proposed development, the
applicant/landowner shall be responsible for controlling the noxious weeds. All vegetation,
other than grasses, needs to be maintained at a maximum height of twelve (12) inches
until the area is completely developed.

Development Standard No. 20
1 _ he historical flow patterns and runoff amounts will be maintained on the site in such a
manner that it will reasonably preserve the natural character of the area and prevent
property damage of the type generally attributed to runoff rate and velocity increases,
diversions, concentration, and/or unplanned ponding of storm runoff
Development Standard No. 21
The applicant must take into consideration stormwater capture/quantity and provide
accordingly for Best Management Practices.
Development Standard No. 22
Weld County will not maintain on -site drainage related areas or medians. This must be
addressed by the owner.
Development Standard No. 24
The applicant is required to comply with all Colorado Department of Public Health and
Environment, Water Quality Control Division, regulations regarding stormwater quality,
permitting and protection, and construction of stormwater discharges.
Development Standard No. 35
Weld County shall not be responsible for the maintenance of on -site drainage related
facilities.

development Standard No. 43
The property owner or operator shall be responsible for complying with the Design
Standards of Section 23-2-240 of the Weld County Code.
Development Standard No. 44
The property owner or operator shall be responsible for complying with the Operation
Standards of Section 23-2-250 of the Weld County Code.
Development Standard No. 46
The Use by Special Review area shall be limited to the plans shown hereon and
governed by the foregoing standards and all applicable Weld County regulations.
Substantial changes from the plans or Development Standards, as shown or stated, shall
require the approval of an amendment of the Permit by the Weld County Board of County
Commissioners before such changes from the plans or Development Standards are
permitted. Any other changes shall be filed in the office of the Department of Planning
Services.
Development Standard No. 47
The property owner or operator shall be responsible for complying with all of the foregoing
Development Standards. Noncompliance with any of the foregoing Development
Standards may be reason for revocation of the Permit by the Board of County
Commissioners.
