HomeMy WebLinkAbout20230750.tiffRESOLUTION RE: ACCEPT REQUEST TO WITHDRAW APPLICATION FOR A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR23-0003, FOR AN EVENTS FACILITY, NOT AGRICULTURE -RELATED, OUTSIDE OF SUBDIVISIONS AND HISTORIC TOWNSITES, IN THE A (AGRICULTURAL) ZONE DISTRICT - JOSE AND MARISELA AVILA WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 22nd day of March, 2023, at the hour of 10:00 a.m., in the Chambers of the Board, for the purpose of hearing the application of Jose and Marisela Avila, 39084 County Road 51, Eaton, Colorado 80615, for a Site Specific Development Plan and Use by Special Review Permit, USR23-0003, for an Events Facility, not agriculture -related, outside of subdivisions and historic townsites in the A (Agricultural) Zone District on the following described real estate, to -wit, and: Lot A of Recorded Exemption, RE -3786; being part of the S1/2 SW1/4 of Section 17, Township 7 North, Range 64 West of the 6th P.M., Weld County, Colorado WHEREAS, on March 22, 2023, the Board heard all of the testimony and statements of those present and reviewed the request of the Planning Staff for a continuance and, having been fully informed, continued the matter to April 12, 2023, at 10:00 a.m., to allow the case to be heard by the Planning Commission on April 4, 2023, and WHEREAS, at said hearing, on April 12, 2023, the Board was presented with an email, received on March 7, 2023, from the applicants concerning the withdrawal of the application, stating they want to resolve the issue of water before proceeding with the case, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and all of the exhibits and evidence presented in this matter and, having been fully informed, deems it advisable to grant the applicant's request and thereby accept the withdrawal of the application. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the request of Jose and Marisela Avila to withdraw the application for a Site Specific Development Plan and Use by Special Review Permit, USR23-0003, for an Events Facility, not agriculture -related, outside of subdivisions and historic townsites in the A (Agricultural) Zone District, on the parcel of land described above, be, and hereby is, accepted and the matter is dismissed. This meeting was called to order by Chair, Elijah Hatch, at 1:32 pm. Roll Call. Present: Elijah Hatch, Sam Gluck, Butch White, Michael Wailes, Pamela Edens, Michael Palizzi, Shana Morgan.
