RESOLUTION
WHEREAS, a public hearing was held on November 27, 1972, in
the chambers of the Board of County Commissioners of Weld County,
Colorado, for the purpose of hearing the petition of Little Thompson
Valley Water District, c/o Dale Olhausen, 307 Welch Avenue, Berthoud,
Colorado, requesting approval of site for the construction of two concrete
water storage reservoirs on the following described property, to-wit:
That portion of land lying in the Northeast Quarter of
Section 4, Township 4 North, Range 68 West of the
6th P. M. , Weld County, Colorado, more particularly
described as follows:
Considering the East line of said Northeast Quarter
as bearing South 3° 34' 16" East with all bearings
contained herein relative thereto.
Beginning at the Northeast corner of said Section 4;
thence along the East line of said Section 4 South
•
3° 34' 16" East 1956. 57 feet; thence South 86° 25'
44" West 695. 00 feet to the true point of beginning;
thence parallel with the East line of said Northeast
Quarter North 3° 34' 16" West 350, 00 feet; thence
perpendicular to said East line South 86° 25'44" West
200. 00 feet; thence parallel with said East line South
3° 34' 16" East 350. 00 feet; thence perpendicular to
the said East line North 86° 25' 44" East 200. 00 feet
more or less to the true point of beginning, containing
1. 61 acres, more or less, and •
WHEREAS, the petitioner was represented by Mr. Dale Olhausen,
and
WHEREAS, there was no opposition to the request of petitioner
for the location of a water storage reservoir; and
WHEREAS, the said requested location for a water storage
reservoir is located in an agricultural zone as set forth by the Weld County
Zoning Resolutions, and
WHEREAS, according to Section 3. 3(2) of the Zoning Resolution of
Weld County, said location for the water storage reservoir may be
authorized on the approval of the Board of County Commissioners of Weld
County, and
WHEREAS, the Board of County Commissioners heard all the
testimony and statements of those present; has studied the request of the
petitioner and studied the recommendations of the Weld County Planning
Commission, and having been fully informed,
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, that the application of Little Thompson Valley Water
District, c/o Dale Olhausen, to locate two concrete water storage
reservoirs on the premises indicated above be, and it hereby is granted
under the conditions following:

1. That any water and sanitation facilities to be installed shall
be approved by the State Health Department.
2. Subject to a green belt being established around the perimeter
of premises, thus screening same with a suitable type of vegetation.
3. That the height of said contemplated structures erected on
premises shall not exceed the maximum height of 40 feet.
4. That all applicable subdivision and zoning regulations shall be
followed and complied with in accordance with the zoning resolutions of
Weld County, Colorado.

The Weld County Planning Commission held a regular meeting
Wednesday , December 6 , 1972 at 4 :45 P . M. in the office of
the County Commissioners , Court House.
Roll call was as follows :

SUBJECT : Minutes
MOTION : By Mr. Nix to approve the minutes of the last regular
meeting as mailed . Second by Mr. Rothe . A unanimous vote of
"Aye" . Motion carried.

DISCUSSION : Mr. .:Lorenson stated the planning staff' s recommendations
are for approval subject to no development of utilities , camp
sites or roads over the Boomerang siphon ,recalculation. of drain-
age based on 50% development , erosion control plan , sewage
package plant subject to approval of the State Health Dept. ,
no direct access allowed to U . S . 34 By-pass plus the following
requests of the City of Greeley : 8" water line and fire hydrants ,
10 ' utility easement around the perimeter of the site except on
County Road #58 , solid planted screen with minimum height of 20 '
within 15 years such as evergreens , a minimum of 35% of sites
with sewer facilities and dedication-lease back of the Sheep Draw
storm flood area . It agrees with Greeley ' s Comprehensive Plan
and has conditional approval by the Utility Board . Mr . Lorenson
read letters from the Soil Conservation Service , the Boomerang
Lateral , the Health Dept . and the City of Greeley stating reasons
for the requests . Greeley also requested that when sewer system
becomes available to the area , that this be hooked onto the system.
Mr. Mathews presented a resume of the need for this type of fac-
ility. It was agreed the plan will have to be redrawn to elim-
inate sites over the siphon . Mr. Shelton stated the Boomerang
has an easement and they will investigate their rights and an
agreement be worked out with them. Mr. Haley stated he didn ' t
think there are any requests that cannot be worked out agreeably.
Mr. Jim Duncan questioned the maintenance of the property. Mr.
Mathews stated this is one of the requirements of a KOA campground
franchise .

RESOLUTION :
Be it therefore resolved to recommend approval to the
Board of County Commissioners subject to the revision of the
plat and meeting the requirements requested . Motion by Mr.
Weigand , second by Mr. Nix . A vote of "Aye" Anderson , Elliott ,
Nix , Rothe , Watson and Weigand . Motion carried .

DISCUSSION : Mr. Lorenson stated the replat complies with the Sub-
div` sion Regulations and it has been approved by the Utility
Board . If approved it should be subject to dedication of . 207
acres for park purposes or the value of the land . Other re-
quirements have been met . The plat shows 12 lots instead of
6 lots originally filed . Mr . Paul stated it has been approved
by his department.
RESOLUTION :
Be it therefore resolved to recommend approval to the Board
of County Commissioners subject to the requested dedication of
. 207 acres for park purposes or value of the land . Motion by
Weigand , second by Mr . Watson . A vote of "Aye" by Anderson ,
Elliu t , Nix , Rothe , Watson and Weigand . Motion carried .
APPLICANT : Bob Levi (Van Buskirk Realty)
SUBJECT : Storage of equipment
DISCUSSION : Mr. Levi stated they have a parcel of ground of 40
acres located in the northwest corner of Sec . 12 T1 R64 they
have a contract for and the buyer wishes to lease it to an in-
dividual that has carnival equipment. There are several struct-
ures on the property and he would like to store this equipment
in these buildings during the winter months . He will live on the
property and farm the remainder of the 40 acres . After further
discussion , it was agreed this would be no different than a
farmer storing his machinery.
MOTION : By Mr. Elliott to authorize Mr. Lorenson to write a letter

stating he can store the equipment there provided that it is not
stored outside and is not operated as a business . Second by Mr.
Weigand . A vote of "Aye" by Anderson , Elliott , Nix , Rothe ,
Watson and Weigand . Motion carried .
SUBJECT: Feedlots
DISCUSSION : Mr. Lorenson asked Bob Adams , Zoning Inspector, to
report on the Grant feedlots and some zoning requirements on
property at the Washington mines . Mr . Adams reported he had
talked with Mr. Grant and advised him a Special Use Permit is
necessary. The location is two miles west of Firestone . The
residents there are very much opposed to an operation of this
kind . Mr. Adams stated he had contacted Mr. Clark in the Wash-
ington mine area who was granted a change of zone and the resol -
ution required a fence to be built. Mr. Clark at this time.,
has not had the financing to construct the proposed building and
fence as yet. Zoning was conditional for 12 months which will

expire 3/8/73 .. Mr. Adams was asked the status of the Booth
feedlots , Asmus and Jacobbuci . There was discussion re-
garding what action can be taken to have compliance with the
regulations . Mr. Connell stated if individuals continue to
construct feedlots after they have been notified of the pro-
ceedure , the County Commissioners can order the Attorney ' s
office to file a cease and desist order,
MOTION : By Mr . Nix to recommend to the Board of County Commissioners
to take action to file a cease and desist order with the County
Attorney ' s office against Harold Asmus , Frank Booth , Doug Grant
and Paul Jacobucci on expansion of feed lots . Motion by Mr.
Nix, second by Mr. Rothe . A vote of "Aye" by Anderson , Elliott ,
Nix , Rothe , Watson and Weigand . Motion carried .
SUBJECT : Zone change for Thomas U. Clark
LOCATION : SW4 Sec 23 T1 R68
DISCUSSION : After further discussion , .it was agreed to notify the
County Commissio,rsthat the requirements set forth for the zone
change have not been complied with and some action should be
taken .

Mr . Anderson called the meeting to order.
ANNOUNCEMENT: John Watson announced .a meeting to the held with the
RTD on Thursday , December 14 , 1972 at 7 : 30 P . M. in the County
Commissioners office . Urged everyone to attend .
SUBJECT: Comprehensive Plan
DISCUSSION : Mr. Lorenson presented the following documents that
have been developed during the past three years : the Land Use
and Housing Inventory, in 1970 and 71 , there was a contract

with the State Planning Office to hire Allan Voqrhees and
Associates to do a Land Use Inventory and Public Facilities
Inventory. Along with that a Weld County Highway Plan was
produced and an Airport Plan . The Highway Plan was not ad-
opted but it was used as a basic idea to follow for the high-
way that will be proposed as a part of the Comprehensive Plan .
A manual of Housing Assistance was produced which is already
out of date because of the new federal regulations . At this
time , the State required a contract on a Regional Planning
Commission basis for a Regional Comprehensive Plan . Under
this plan , the Town Plans of every town were prepared. Next .
the Subdivision Regulations were prepared and adopted . These
will not be a part of the Comprehensive Plan , but these types
of documents help implement the Plan . A more complete inven-
tory on housing was done . Housing profiles were done for every
town in the County. In 1971 the Planning Commission adopted a
Land Use Policy regarding where development should occur and
under what conditions . A program with the University of Colo .
was done , land use maps were produced of the triangular area .
The Zoning Resolution has not been completed at this time which
will` be a revision of the existing regulations . A three-year
Work Program has been developed for the Regional Planning Com-
mission .
Jim Ohi presented the proposed Comprehensive Plan for Weld
County. The Plan has been developed on the basis of the Land
Use Policy. Maps were presented that will accompany the Plan .
It was agreed the members would review the proposed plan and
make comments and •suggestions at the next regular meeting.

DISCUSSION : Mr. Burrous presented the plans of the proposed feedlot
operation . The holding ponds will be constructed according to
• the A. C . S . office .. A letter from the North Weld Water Assoc .
regarding the availability of water is on file. Mr. Lorenson
stated the staff' s recommendations are for approval , it agrees
with the land use policy , is compatible with surrounding land
use and zoning , it has Health Dept. approval and water is avail -
able from North Weld Water District . If approved it should be
subject to : a sealed lagoon as recommended by SCS and increas-
ing the size to a total of 9 . 7 acre feet to meet the Colo. Water
Pollution standards as recommended by the Extension office . The
lagoons to be located at least 400 ft . from the West bank of the
Lone Tree Creek and a line installed to pump the waste up to the
walking spript er as required by the Health Dept . Construction
tm begin within 1 year of approval by the County Commissioners
and limited to the pen size as indicated by the submitted plans .
There should be screening along the entire south boundary peri -
meter adjacent to the road for vegetation . Mr. Burrous questioned
the 400 ft . requirement, stating they wanted to use the natural
depressions . Mr. Woods voiced objections to locating the screen-
ing 20 ' inside the property line , or 50 ' from the center of the
road . Mr. Lorenson stated a dike could be built in lieu the
400 ' set-back for the lagoons from the creek .

of the Planning staff and and 50 ' ROW dedication with the trees
being planted 20' inside the property line . Motion by Mr. Watson ,

DISCUSSION : Mr. Olhausen presented the proposed plans for the storage
tank to increase their facilities . Stated there will be no
habitation and is strictly a tank site . Height will be approx-
imately 30 ft. Mr. Lorenson stated he recommended approval as
additional water storage is needed to provide service to the
water district , and should be subject to screen planting around
the perimeter . Mr . Olhausen stated they have already agreed to
the planting .
RESOLUTION :
Be it therefore resolved to recommend approval to the Board
of County Commissioners subject to the screening request. Motion
by Mr. Nix , second by Mr . Clark . A vote of "A•ye" by Anderson ,
Clark , Heitman , Nix , Rothe , and Watson. Motion carried .

APPEARANCE : Lou Gaskins and John Lange
DISCUSSION : Mr. Gaskins explained the necessity of the spindle field
facility to take care of about 40 wells . Mr . Lorenson stated he
is recommending approval of the application as it agrees with
the land use policy and is compatible with surrounding land use
• and zoning . Mr. Lorenson .stated the Health Department may have
some requirements . Mr . Paul stated they will need to get a per-
mit to operate from the Pollution office and the State Pollution
Control . Mr . Lange stated the items they will have on this are
exempt under existing air pollution statutes and they have
applied •to the State Air Pollution Commission and they were granted
an exemption . Mr. Lorenson recommended a planted screen around
the perimeter and construction to begin within one year of
approval by the Board of County Commissioners and limited to the
items shown on the submitted plan . Mr . Gaskins voiced some ob-
jection to the screening requested .

DISCUSSION : Mr . Lorenson stated a letter from the North Weld Water
District of their intent to serve water to this dairy. The
staff recommends approval as it agrees with the land use policy,
is compatible with surrounding land use 'and zoning , the design
is judged adequate by the Extension agent . If approved it should
be subject to any conditions required by the Health Dept. ,
construction of a lagoon as proposed , construction to begin
within 1 year of approval by the Board of County Commissioners
and limited to the pen size (159 ,000 sq . ft. ) and facilities as
shown on the submitted plan .

of County Commissioners subject to the conditions of the planning
department. Motion by Mr . Nix , second by Mr. Watson . A vote of

SUBJECT : Rehearing of application for dog kennel

DISCUSSION : Mr. Miller reviewed the original application and the
recommendation of the planning staff which was recommended
for approval , however the motion of the Planning Commission
recommended denial to the County Commissioners . Mr. Miller
stated according to his interpretation of the zoning regu-
lations , dog kennels are a permitted use in an "A" zone .
The kennel would be several hundred feet in all directions
from any other house and a half-mile from the chicken oper-
ation . Mr. Bailey was question"whether he will dwell on
the property. He stated he would .
MOTION: By Mr. Heitman to take the matter under advisement. Second
by Mr . Rothe. A vote of "Aye" by Anderson , Clark , Heitman ,
Nix , Rothe and Watson . Motion carried .
SUBJECT: Utility Instal1atton Agreement
DISCUSSION : Miss Telep stated that after revtewtng the proposed
agreement , she felt it should be considered at some other level.,
and perhaps a public hearing held . Mr. Anderson stated he felt
it is something that could. be handled by the utilities themselves .
MOTION : By Mr. Heitman to reject the proposal that the Utilities
Installation Agreement be handled through the Planning Commission .
After further discussion , Mr. Heitman withdrew his motion .
MOTION : By Mr. Clark that no action be taken at this time and it is
immature at this time . Second by Mr. Watson . A vote of "Aye" by
Anderson , Clark , Heitman , Nix, Rothe and Watson . Motion carried .
SUBJECT : Model Subdivision Ordinance for Incorporated Towns .
DISCUSSION : Mr . Ohi presented the Model Subdivision Ordinance that
would allow the incorporated towns to adopt , by reference . The
ordinance is based on the Weld County Subdivision Resolution so
that subdivision regulations will be as uniform as possible

throughout the county. The model ordinance should be approved
by both the Weld County Planning Commission and Board of County
Commissioners as an official publication of Weld County to en-
able towns in the county to adopt it by reference, . Miss Telep
stated she would like to review the ordinance ,

Be it therefore resolved to recommend approval subject to
to the legality of such ordinance being approved by Miss

DISCUSSION : Each member had received a letter from Mr. Bigbee asking
review of .single family housing tracts in place of the proposed
mobile home park which he has previously submitted . The Com-
mission instructed Mr . Lorenson to inform Mr. Bigbee in order to
appear before the Planning Commission , an application and plat
in the proper form would have to be submitted .

DISCUSSION : There was further discussion regarding the location of
the dog kennel applied for. It was agreed there should be a
condition that the owner live on the property.
RESOLUTION :
Be it therefore resolved to recommend approval to the
Board of County Commission subject to the permit be issued for
the kennel after Mr. Bailey' s home is constructed and occupied .

c The location of the site for this proposed two million gallon concrete
w storage reservoir is at the "twin mounds" in Section 4, which is
m w approximately one mile west of Interstate 25 and immediately south of
O State Highway 60, and approximately four miles east of Campion.
ce < I previously called your office regarding requirements on this site.
Mr. Adams thought that a special use permit was required, because
Central Weld had been required to do this on the tank site near Greeley.
The Central Weld tank site was located in the "E" Estate Zoning, not
"A" Agricultural Zoning, as this site is. I have been involved with
eight or ten storage tank sites in Weld County in "A" Zoning, and have •
not been required to obtain anything except a regular building permit

U re o on any of them. If you feel that we are in need of something additional
w on this site, I would appreciate your contacting me promptly. We are
• ? proceeding to advertise for bids on this project assuming that it is

GENERAL
The following report presents the results of a subsurface soil
investigation for the proposed water storage tanks located in the Northeast
Quarter of Section 4, Township 4 North, Range 68 West of the 6th Principal
Meridian, Larimer County, Colorado.
The purpose of this investigation was to obtain the technical information
i
and soil property data necessary for the design and construction of foundations
for the structures. The conclusions and recommendations presented in this
report are based upon analysis of field and laboratory data and experience
with similar soils in the general vicinity.
FIELD INVESTIGATION
The field investigation consisted of four test borings at the site. All
borings were made with a 4 inch continuous flight power auger.
Complete logs of the boring operation are shown on the attached plates
and include visual classification of each soil , locations of changes,
standard penetration test results and water table measurements.
As the boring operations advanced, an index of soil relative density
and consistency was obtained by the use of the standard penetration test.
The penetration test results listed on the logs are the number of blows
required to drive a 2 inch split-spoon sampler 1 foot into undisturbed
soil by a 140 pound drive hammer dropped 30 inches. The soils encountered
are considered to be such that they respond well to the standard penetration
test, and that data has been collected for design use.
LABORATORY INVESTIGATION
Extensive laboratory testing was not undertaken. Sufficient index
tests were made in the laboratory to verify field classification of soils .
SUBSURFACE SOIL CONDITIONS
The subsurface soils at the site were considered to be fairly uniform
consisting of sandy to very sandy clays and silty clays extending to depths
in excess of 16 feet. No groundwater was encountered in this investigation.

CONCLUSIONS AND RECOMMENDATIONS
The basic control available to us in selecting foundation type and
allowable loads for this investigation is the standard penetration test.
The ultimate bearing capacity will depend, to a certain extent upon size
and shape of the foundation element, depth below the surface, and physical
characteristics of the supporting soils. The stiff sandy clays underlying
the site would appear to satisfy the requirements for foundation soils for
the structures.
The upper sandy clay soils generally exhibit a presumptive bearing value
in the range of 5,500 lbs/sq. ft. They are inclined to weaken in shear
strength when wetted, and therefore precautions should be taken to insure
positive drainage away from the foundation elements.
It is recommended that the structure be founded. on pads or conventional
continuous spread type footings. Footings should be designed against a
maximum allowable bearing capacity of 5,500 lbs/sq. ft. All footings should
extend a minimum of 30 inches below finish grade to protect against frost
action and in addition should be placed below upper organic soils when they
occur.
GENERAL RECOMMENDATIONS
Finish grades should be sloped away from the structures on all sides to
give positive drainage. A minimum• of 6 inches of fall in the first 10 feet
is recommended. All footings should be founded on undisturbed soil .- In
no case should footings be supported in fill material . Backfill around
the outside perimeter of the structures should be compacted at optimum
moisture to at least 90% of Proctor density as determined by ASTM Standard
Test D698-70.
In the course of preparing this report, it has been assumed that the
soil conditions do not vary greatly between test borings; however, since
soil conditions have been known to change radically within short distances ,
we recommend that a soils engineer inspect all excavations prior to placing
concrete.
