USR23-0031, FOR A 5.7 MW SOLAR ENERGY FACILITY (SEF) IN THE
A (AGRICULTURAL) ZONE DISTRICT - LOUIS AND GINA FABRIZIUS,
AND STANLEY AND CAROLYN HEINZE, C/O CBEP SOLAR 32, LLC
A public hearing was conducted on December 20, 2023, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated September 12, 2023, and duly published
September 15, 2023, in the Greeley Tribune, a public hearing was conducted on October 18,
2023, to consider the request of Louis and Gina Fabrizius, and Stanley and Carolyn Heinze,
c/o CBEP Solar 32, LLC, for a Site Specific Development Plan and Use by Special Review Permit,
USR23-0031, for a 5.7 MW Solar Energy Facility (SEF) in the A (Agricultural) Zone District. At
said hearing the Board continued the matter to December 20, 2023, to allow the applicant
adequate time to modify the request and provide additional information. Assistant County
Attorney, Karin McDougal, made this a matter of record.
IR Chris Gathman, Department of Planning Services, presented a brief update of the proposal,
and stated the applicant will remove the Agrivoltaic part of the proposal. He relayed an Access
Permit has been obtained from CDOT onto State Highway 392, which would address the
Condition of Approval (COA) #1.A.
Lauren Light, Department of Public Health and Environment, stated she had no update from
the October 18, 2023, report given.
Brysen Daughton, CBEP Solar, reiterated the decision to remove the Agrivoltaic portion of
the proposal.

The Board reviewed the Conditions of Approval and Development Standards and agreed to
strike COA #1.A (CDOT requirements). In response to Commissioner Buck, Mr. Daughton
confirmed a contract with Xcel is not in place on this property.
No public testimony was offered regarding changes made to the Conditions of Approval.
In response to Chair Freeman, Mr. Daughton, on behalf of the applicants, indicated they have
reviewed, and agreed to abide by, the Conditions of Approval and Development Standards, as
amended.
Commissioner James moved to approve the request of Louis and Gina Fabrizius, and
Stanley and Carolyn Heinze, c/o CBEP Solar 32, LLC, for a Site Specific Development Plan and
Use by Special Review Permit, USR23-0031, for a 5.7 MW Solar Energy Facility (SEF) in the
A (Agricultural) Zone District. The motion was seconded by Commissioner Buck, it carried
unanimously. There being no further discussion, the hearing was completed at 11:02 a.m.
This Certification was approved on the 3rd day of January, 2024, by the newly nominated and
approved Board of Commissioners for 2024.
