WHEREAS the parties entered into an Agreement to ensure efficient communication and collaboration between the two organizations specific to the Children's Habilitation Residential Program (CHRP) and other Home and Community Based Services (HCBS) waiver services, (the "Original Agreement") identified by the Weld County Clerk to the Board of County Commissioners as document No. 2023-0021, approved on January 4, 2023. WHEREAS the parties hereby agree to amend the term of the Original Agreement in accordance with the terms of the Original Agreement and any previously adopted amendment, which is incorporated by reference herein, as well as the terms provided herein. NOW THEREFORE, in consideration of the premises, the parties hereto covenant and agree as follows: • The Original Agreement will end on December 31, 2023. • This Amendment, together with the Original Agreement, constitutes the entire understanding between the parties. The following additional changes are hereby made to the current Agreement as of January 1, 2024: 1. Term This agreement is being renewed for the second year, for the period January 1, 2024 through February 29, 2024. • All other terms and conditions of the Original Agreement remain unchanged. Human Services and Envision share the value that children with special needs, specifically children determined to have an intellectual or developmental disability (IDD) or developmental delay, should be able to access or receive services available for which they are determined to meet eligibility criteria. Envision is better able to meet the needs of these children and families when there is no indication of abuse or neglect. When there are concerns of abuse or neglect, Human Services will work to alleviate risk and partner with Envision to get the correct services in the home. 3. Human Services and Envision each have individual roles concerning the welfare of current and potential populations served. It is in the best interest of shared clients that good communication and cooperation is the standard between these programs. 4. In order to ensure efficient communication and collaboration, Envision will provide a Case Manager (CM) who will act as a liaison between Envision and Human Services staff. The CM will be co -located in the Human Services Division of Child Welfare to ensure that: a. Children identified as having or potentially having developmental delays or disabilities are referred for determination early in the assessment process, including children and families working with prevention, b. Families and caseworkers are educated about the services that may be available within the community, including but not limited to, the CHRP and/or Children's Extensive Support (CES) waivers and, c. IDD determination and eligibility for additional services, as selected for pursuit by the child's or youth's interdisciplinary team, are completed in a timely manner. 02Oca —.%),... Term of this Memorandum of Understanding This Memorandum of Understanding ("MOU" or "Agreement") shall be effective beginning January 1, 2023 and shall end December 31, 2023. This MOU may be renewed by both parties, in writing, on an annual basis. Responsibilities of Envision Case Manager (CM) Liaison Consult on application processes with the caseworker and/or family. Attend Review, Evaluate and Direct (RED) Team, Family Team (FTM) meetings, Team Decision Making (TDM) Meetings, and Group Supervision when requested and scheduled in advance to assess the needs of IDD children and families. Provide quarterly training as planned and scheduled regarding HCBS waivers, Family Support and State Supportive Living Services (SLS) when relevant. Function as a liaison between caseworkers and assigned CM, helping to troubleshoot issues when needed. Focus on issues related to Human Services children and families as much as possible when located at the county office. Set up regular times to be available for Human Services caseworkers and outreach staff to drop -in to discuss children and families on their caseloads who may be IDD. Present data, in, conjunction with the Child Welfare Liaison, to Human Services Administration at least quarterly or as requested. Participate in state meetings and trainings as requested by Human Services. Responsibilities of Human Services Child Welfare Liaison and/or Quality Assurance Staff or Caseworker Meet regularly with the CM to discuss workload. Conduct monthly staffings with the CM and Envision Quality Assurance Director to review children in various stages of referral process. Complete or assist the family in completing the Request for Determination form, including required signatures. Gather and provide all information required for Determination. Provide CM information related to the child protection/safety issues of the home. Inform the CM when a case has closed. When the Caseworker has determined that a child needs to be placed out of the home, meet with the CM to determine if foster care or CHRP placement is most appropriate and/or viable. Review the Placement Information Form to identify children who may be eligible for waiver services and provide that information to the CM. Expected Outcomes Increased collaboration between Envision Case Management and Human Services, particularly the Child Welfare and Family Resource Divisions. Early identification of children who may be IDD and who may be eligible for other IDD waivers. Reduction in the number of families who enter Child Welfare due to inability to receive necessary services and thus avoid Child Welfare involvement and keep child(ren) at home. Provision of IDD services when appropriate, instead of involvement with Child Welfare, to support parents to meet the needs of children with IDD, avoiding foster care as the only option for assistance. Reduction in length of time cases are open by providing families with the appropriate services they need to successfully support their child(ren) to return home. Streamline process for children who are aging out of foster care and entering adult IDD services. Modifications. This Agreement may be modified in writing, in whole or in part, upon approval of the signers. Termination. This Agreement may be terminated at any time by either party giving thirty (30) days written notice to the signers. No portion of this MOU shall be deemed to create an obligation on the part of the County of Weld, State of Colorado, to expend funds not otherwise appropriated, as this MOU is subject to the availability of funding. Therefore, Human Services may terminate this MOU at any time if the source of funding for the services made available to Envision is no longer available to the Department, or for any other reason. Envision reserves the right to suspend services to clients if funding is no longer available. Entire Agreement. This MOU contains the entire agreement and understanding between the parties with respect to the subject matter hereof and may not be changed or modified except as stated herein. This MOU shall be binding upon the parties hereto, their successors, heirs, legal representatives, and assigns. Envision and Human Services may not assign any of its rights or obligations hereunder without the prior consent of both parties. No Third -Party Beneficiary. It is expressly understood and agreed that the enforcement of the terms and conditions of this MOU, and all rights of action relating to such enforcement, shall be strictly reserved to the undersigned parties and nothing in this MOU shall give or allow any claim or right of action whatsoever by any other person not included in this MOU. It is the express intention of the undersigned parties that any entity other than the undersigned parties receiving services or benefits under this MOU shall be an incidental beneficiary only. Governmental Immunity. No term or condition of this contract shall be construed or interpreted as a waiver, express or implied, of any of the immunities, rights, benefits, protections or other provisions, of the Colorado Governmental Immunity Act §§24-l0-101 et seq., as applicable now or hereafter amended. Independent Contractor. Envision agrees that it is an Independent Contractor and that Envision's officers, agents or employees will not become employees of Human Services, nor entitled to any employee benefits from Human Services as a result of the execution of this MOU. Envision shall perform its duties hereunder as an Independent Contractor. Envision shall be solely responsible for its acts and those of its agents and employees for all acts performed pursuant to this MOU. Envision, its employees and agents are not entitled to unemployment insurance or workers' compensation benefits through Human Services and Human Services shall not pay for or otherwise provide such coverage for Envision or any of its agents or employees. Unemployment insurance benefits will be available to Envision and its employees and agents only if such coverage is made available by Envision or a third party. Envision shall pay when due all applicable employment taxes and income taxes and local head taxes (if applicable) incurred pursuant to this MOU. Severability. If any term or condition of this MOU shall be held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, this MOU shall be construed and enforced without such provision, to the extent that this MOU is then capable of execution within the original intent of the parties.
