RE: APPROVE TEMPORARY ACCESS AND CONSTRUCTION EASEMENT AGREEMENT
FOR BRIDGE 54/13A RECONSTRUCTION PROJECT, AND AUTHORIZE CHAIR TO
SIGN - DUSTIN AND JAMIE CHRISTENSEN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Temporary Access and Construction
Easement Agreement for the Bridge 54/13A Reconstruction Project between the County of Weld,
State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf
of the Department of Public Works, and Dustin and Jamie Christensen, commencing upon full
execution of signatures, with further terms and conditions being as stated in said agreement, and
WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy
of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Temporary Access and Construction Easement Agreement for
the Bridge 54/13A Reconstruction Project between the County of Weld, State of Colorado, by and
through the Board of County Commissioners of Weld County, on behalf of the Department of
Public Works, and Dustin and Jamie Christensen, be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said agreement.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 12th day of June, A.D., 2023.

TEMPORARY ACCESS AND CONSTRUCTION EASEMENT AGREEMENT
THIS TEMPORARY ACCESS AND CONSTRUCTION EASEMENT AGREEMENT
("Temporary Easement") is entered into this Ztt1day of du it, 2023, by and between the
County of Weld, a body corporate and politic of the State of Colorado, through its Board of
County Commissioners, whose address is 1150 'O' Street, Greeley, CO 80631 ("Grantor"), and
Dustin C. Christensen and Jamie A. Christensen, whose address is 6504 County Road 54,
Johnstown, CO 80534 (collectively "Grantee"). Grantor and Grantee are collectively referred to
herein as the "Parties."
WHEREAS, Grantee is the owner of real property located in Weld County, Colorado,
described on Exhibit A attached hereto and incorporated herein ("Grantee's Property"); and
WHEREAS, Grantor obtained a fee conveyance from Grantee of certain property
described on Exhibit B attached hereto and incorporated herein ("Right of Way") for the
reconstruction of Bridge 54-13A on Weld County Road 54 crossing the Big Thompson River;
and
WHEREAS, Grantor desires to grant Grantee temporary rights of access for ingress and
egress across the Right of Way to Grantee's Property and on and along the Right of Way for
purposes of the Work (defined below), to permit Grantee to reconstruct an internal roadway on
Grantee's Property necessitated by the conveyance of the Right of Way to Grantor.
NOW, THEREFORE, for good and valuable consideration, the receipt and sufficiency of
which are hereby acknowledged, Grantor hereby grants to Grantee and to its employees, agents,
contractors, licensees, permittees, successors, and assigns, a non-exclusive and temporary
easement on, along and across the Right of Way for the purposes of providing access and
accommodating the movement and use of equipment, materials and personnel as may be
necessary, in Grantee's sole discretion, for Grantee to reconstruct an internal roadway on
Grantee's Property (the "Work").
This Temporary Easement shall be subject to the following terms and conditions:
1. Use by Grantee. Grantee shall have the full right and authority to enter and use the
Right of Way for purposes of the Work.
2. Use by Grantor and Restriction. Grantor shall retain the unrestricted right to use
the Right of Way, insofar as such use and occupancy is consistent with and does not impair
Grantee's full enjoyment of the rights herein granted. Grantor and Grantee shall use best efforts
to schedule their uses of the Right of Way to minimize conflict. However, in the event of a
conflict between the use of the Right of Way by Grantor and Grantee that cannot be resolved, the
right of Grantor shall take precedence.
3. Mutual Use. The Parties shall use reasonable efforts to minimize any interference
with any of the activities of the other Party, its employees, agents, contractors, licensees and
permittees on the Right of Way, and shall not undertake any actions regarding its use of the
Right of Way that would endanger the health, safety or welfare of either Party or their
employees, agents, contractors, licensees, or permittees, or that would damage its equipment,
materials or property.
4. No Additional Uses. Grantee, its employees, agents, contractors, licensees and
permittees, use of the Right of Way shall be for the sole and exclusive purposes contained herein,
and this Temporary Easement shall not be construed as a permanent conveyance of the Right of
Way or a grant of uses beyond those contemplated herein.
5. Removal of Equipment. Prior to the expiration of this Temporary Easement,
Grantee shall promptly remove all materials, debris and equipment utilized to perform the Work
from the Right of Way.
6. Restoration and Repair. If improvements to the Right of Way made by Grantor
are disturbed solely by the Work of Grantee, Grantee shall restore and repair the Right of Way to
a substantially similar condition as it was before the Work as is reasonably practicable.
7. Mechanic's and Materialmen's Liens. Grantee covenants and agrees not to suffer
or permit any lien of mechanics or materialmen or others to be placed against the Right of Way
with respect to the Work or services claimed to have been performed for, or materials claimed to
have been furnished to, Grantee pursuant to this Temporary Easement.
8. Compliance with Laws. Grantee shall cause all Work and activities on the Right
of Way to be performed in compliance with all applicable laws, rules, regulations, orders and
other governmental requirements.
9. Term. The duration of this Temporary Easement becomes effective upon the date
of entry for the Work, remains in effect during the Work, and terminates ten (10) days after the
conclusion of the Work, which termination will be evidenced by written notice from Grantee to
Grantor of termination.
10. General Provisions:
a. Controlling Law. The interpretation and performance of this Temporary Easement
and these terms and conditions shall be governed by the laws of the State of Colorado.
b. No Third Party Beneficiaries. This Temporary Easement is between Grantor and
Grantee, is solely for the benefit of Grantee and its respective successors and assigns for the
purposes set forth herein, and does not create rights or responsibilities in any third parties beyond
Grantor and Grantee.
c. No Waiver of Governmental Immunity. Grantor, its commissioners, officials,
officers, directors, agents and employees, are relying on, and do not waive or intend to waive by
any provision of this Temporary Easement, the monetary limitations or any other rights,
immunities and protections provided by the Colorado Governmental Immunity Act, §§ 24-10-
101 to 120, C.R.S., as amended.
d. Successors and Assigns. This Temporary Easement and these terms and
conditions shall extend to and be binding upon the heirs, successors and assigns of the Parties
hereto and shall run with the land.

Sixty-seven West (R.67W.) of the Sixth Principal Meridian (6th P.M.), County of Weld, State of
