RE: APPROVE AMENDMENT #1 TO LEASE AGREEMENT FOR SATELLITE OFFICE
SPACE FOR STATE EMPLOYEES OF DIVISION OF VOCATIONAL REHABILITATION
(DVR) AND AUTHORIZE CHAIR TO SIGN AND SUBMIT ELECTRONICALLY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with Amendment #1 to the Lease Agreement
for Satellite Office Space for State Employees of the Division of Vocational Rehabilitation (DVR)
between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of the Department of Human Services, and the
Colorado Department of Labor and Employment, commencing upon full execution of signatures,
and ending June 30, 2026, with further terms and conditions being as stated in said amendment,
and
WHEREAS, after review, the Board deems it advisable to approve said amendment, a
copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that Amendment #1 to the Lease Agreement for Satellite Office Space
for State Employees of the Division of Vocational Rehabilitation (DVR) between the County of
Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on
behalf of the Department of Human Services, and the Colorado Department of Labor and
Employment, be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to electronically sign and submit said amendment.

Brief description of the problem/issue: In an effort to keep program units together, Employment Services of
Weld County (ESWC) has requested that Division of Vocational Rehabilitation (DVR) employees move from
office space 28-225 to 2B-226. DVR is agreeable to this move and has issued Amendment #1 to the original
Lease Agreement known to the board as Tyler ID# 2023-0660. No other terms have changed.
What options exist for the Board?
Approval of the Office Space Lease Amendment #1 with the DVR acting through Colorado Department
of Labor and Employment (CDLE).
Deny approval of the Office Space Lease Amendment #1 with the DVR acting through CDLE.
Consequences: Amendment #1 would not be executed.
Impacts: DVR employees would not move to the new office space and ESWC program units would not
remain together.
Costs (Current Fiscal Year / Ongoing or Subsequent Fiscal Years):
No funding changes from original Lease Agreement.
Recommendation:
• Approval of the Amendment #1 and authorize the Chair to sign electronically.

Automatic Low Risk Categories
Contract and contract modifications that fall within the following categories shall always be determined to be low
risk unless it also falls within a high risk or no risk category.
Amendments that restate a contract to include all prior amendments and modifications in one updated document, that make

not apply if any of the parties are separate authorities or other governmental entities or political subdivisions.
Undetermined Risk Contracts and Contract Modifications
Any contract or contract modification that is not automatic high risk, automatic low risk or automatic no risk contract shall be considered
to be undetermined risk.
If a contract or contract modification is considered to be undetermined risk, PCS should work with the program to complete either the
"Risk Analysis for All New Contracts and Agreements" or the "Risk Analysis for all Modifications" form. PCS should make a final risk
determination on the basis of the completed Risk Analysis form and include copies of both this form and the completed Risk Analysis
form in the contract file.

FIRST AMENDMENT TO LEASE
The printed portions of this form, except bold additions, have been
approved by the State of Colorado Attorney General
THIS FIRST AMENDMENT TO LEASE, made and entered into by and between WELD COUNTY,
a body politic and corporate whose principal place of business is 1400 N. 17th Avenue, Greeley, CO
80631, hereinafter referred to as "Landlord", and THE STATE OF COLORADO (the "State"(, acting by and
through the Department of Labor and Employment, whose address is 633 17t'' Street, Suite 1200,
Denver, Colorado 80202, for the purpose of amending that certain lease dated March 21, 2023, (the
"Lease"), relating to the leasing of a portion of the building located at 315 N. 11t'' Avenue, Building B
Greeley, CO,comprised of one hundred twenty (120) rentable square feet.
WHEREAS, Authority to enter into this Lease exists in the Law, and funds have been budgeted,
appropriated and otherwise made available and a sufficient unencumbered balance thereof remains
available for payment. Required approvals, clearance and coordination have been accomplished from and
with appropriate agencies.
WHEREAS, Landlord has requested CDLE to move from office 2B-225 to 2B-226; and
WHEREAS, offices 2B-225 to 2B-226 are next to each other and identical in size and shape ; and
WHEREAS, CDLE is agreeable to this move, which will not affect its business needs or otherwise
modify any others terms of the lease.
NOW, THEREFORE, Landlord and Tenant in consideration of the mutual promises contained herein,
hereto agree to amend the Lease as follows:
1. PREMISES, TERM, RENT.
(A) Landlord hereby leases and demises unto Tenant the Premises, hereinafter referred to as
"Premises" within the Employment Services of Weld County building located at 315 N 11 Ave B
Greeley, CO 80631, hereinafter referred to as "Building" (including land, improvements and other
rights appurtenant thereto). The Premises, known and described as Office 2B-226, includes
approximately One Hundred and Twenty (120) rentable square feet; the Premises as attached and
incorporated by reference as "Exhibit A" in the original lease.
2. Order of Precedence. The provisions of the Lease shall govern the relationship of the
State and Landlord. In the event of conflicts or inconsistencies between the Lease and the First
Amendment such conflicts or inconsistencies shall be resolved by reference to the documents in
the following order of priority:
i. The'provisions of the First Amendment to Lease,
ii. The provisions of the main body of the Lease,
Except as modified by the provisions of this First Amendment to Lease, all other terms and
conditions in the Lease are hereby ratified and confirmed and remain in full force and effect.
The effective date of this First Amendment to Lease is September 1, 2023 or the date signed by the
State Controller or his/her designee, whichever is later. In accordance with the requirements of 24-
30-202 (1) C.R.S., as amended, this First Amendment to Lease shall not be deemed valid until it has
been approved by the State Controller, or such assistant as he or she may designate.
