HomeMy WebLinkAbout20231190.tiffNOTICE OF INTENT TO REQUEST RELEASE OF FUNDS FOR TIERED PROJECTS AND PROGRAMS On or after April 30, 2023, the County of Weld, Colorado will submit a request to the HUD CPD, Region VIII, Denver Office for the release of Weld County CDBG Program funds under Title I of the Housing and Community Development Act of 1974, as amended to undertake the following project: Tier 1 Broad Review Project/Program Title: Firestone Housing Rehab Program Purpose: The Town of Firestone, Colorado, will implement a Single -Family Housing Rehabilitation Program for the benefit of low- to moderate -income households located within the Town of Firestone with the objective of housing preservation. Location: The project will take place at various locations to be determined within the Town of Firestone. Project/Program Description: Single -Family Housing Rehabilitation Program consisting of minor home repairs and/or maintenance (not to exceed $12,500 per household) on single-family, owner -occupied residences of low- and moderate -income residents of the Town. Improvements addressing health and safety issues will be a priority, then code violations and maintenance to follow and be carried out by appropriately licensed and insured contractors. Tier 2 site specific reviews will be completed for those laws and authorities not addressed in the tier 1 broad review for each address under this program when addresses become known. Level of Environmental Review Citation: Rehabilitation Program of homeowner occupied single-family homes 24 CFR § 58.35(a)(3)(i). Tier 2 Site Specific Review: The site -specific reviews will cover the following laws and authorities not addressed in the Tier 1 broad review: Flood Insurance (Flood Disaster Protection Act of 1973 and National Flood Insurance Reform Act of 1994 [42 USC 4001-4128 and 42 USC 5154a]; Floodplain Management (Executive Order 11988, particular section 2(a); 24 CFR Part 55) Historic Preservation (National Historic Preservation Act of 1966, sections 106 and 110; 36 CFR Part 800); Contamination and Toxic Substances (24 CFR 50.3(i)(2)) Environmental Justice (Executive Order 12898) Mitigation Measures/Conditions/Permits (if any): 1. Flood Insurance Site specific reviews will be conducted, and a FEMA-Issued Flood Insurance Rate Maps (FIRMs) flood map prepared for each activity site. If the site is located in a floodplain, proof of flood insurance will be required before the project can be carried out in that location. 2. Floodplain Management Site specific reviews will be conducted using HUD policies to find compliance for each site. CDBG funds will not be used to rehab structures located in a floodway. 3. Historic Preservation Site specific reviews will be conducted using the Weld County, Town of Firestone, and Colorado SHPO Programmatic Agreement (PA) and/or SHPO policies to find compliance for each site. 6)11~ "esal:elue_) 5-/-ao3 2023-1190 Road? 4. Contamination and Toxic Substances Site specific reviews will utilize the EPA mapping program NEPAssist, along with visual inspections to identify any contamination issues. If contamination issues are present, the County will determine if the project can be made compliant or if the project cannot proceed. 5. Environmental Justice If no adverse environmental impacts are identified during the conduct of a site -specific review, the project can continue at that site as proposed. Adverse impacts, if any found, must be evaluated to determine if they are disproportionally high to low-income and minority persons and, if so, must be mitigated. If the adverse impacts cannot be mitigated, the project cannot proceed at that site. Estimated Project Cost: HUD funding $225,000; total estimated project cost $250,000 The activity/activities proposed are categorically excluded under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act (NEPA) requirements per 24 CFR Part 58.5(a)(3)(i). An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at Weld County Administration Building, 1150 O St., Greeley, CO 80632, and may be examined or copied weekdays 8:00 A.M. to 5:00 P.M. or at https://www.hudexchange.info/programs/environmental-review/environmental-review-records/. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to the Weld County CDBG Program, 1150 O St., Greeley, CO 80632. All comments received by April 27, 2023, will be considered by the County of Weld prior to authorizing submission of a request for release of funds. ENVIRONMENTAL CERTIFICATION The County of Weld certifies to HUD that Elizabeth Relford, Certifying Officer, in her capacity as CDBG Manager, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the County of Weld to use HUD program funds. OBJECTIONS TO RELEASE OF FUNDS HUD will accept objections to its release of funds and the County of Weld's certification for a period of fifteen (15) days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the County of Weld; (b) the County of Weld has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted via email in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to Noemi Ghirghi, CPD Region VIII Director, at CPD COVID-19OEE- DEN@hud.gov.
