BOARD OF COUNTY COMMISSIONERS
WELD COUNTY, COLORADO
MONDAY, JANUARY 23, 2023
The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity
with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration
Building, Greeley, Colorado, January 23, 2023, at the hour of 9:00 a.m.
li l ROLL CALL: The meeting was called to order by the Chair and on roll call the following members
were present, constituting a quorum of the members thereof:

!al MINUTES:
1) Commissioner Ross moved to approve the Minutes of the Board of County Commissioners meeting
of January 4, 2023, as printed. Commissioner James seconded the motion, and it carried unanimously.
ti 2) Commissioner James moved to approve the Minutes of the Board of County Commissioners
meeting of January 9, 2023, as printed. Commissioner Ross seconded the motion and it carried
unanimously.
CERTIFICATION OF HEARINGS: Commissioner Ross moved to approve the Certification of
Hearings conducted on January 4, 2023, as follows: 1) COZ22-0003 — Marty Matchett, 2) USR22-0029
— Julie Walker, and 3) USR22-0027 — CBEP Land 2, LLC, c/o CBEP Solar 2, LLC, c/o CBEP Solar 8,
LLC. Commissioner James seconded the motion, which carried unanimously.
El PUBLIC INPUT: No public input was given.
AMENDMENTS TO AGENDA: There were no amendments to the agenda.
!j COMMISSIONER COORDINATOR REPORTS: Commissioner Ross reported he met with the
Department of Public Works and reviewed several closures throughout the County due to lengthy
construction projects, and stated he had a ride along with the snow removal crew last week and
commended the team for their phenomenal job at keeping the roads as clear and safe as possible for the
citizens of Weld County, and for the Facilities Department snow removal crew for clearing snow at the

County Courthouse. Commissioner Ross met with David Springer, Director of Fleet Services, and stated
the procurement process for vehicles is still a struggle as the supply chain issues have continued to be
a problem. Commissioner James reported that he, Commissioner Saine, and Bruce Barker, County
Attorney, met with members of the Governor's Office last Friday regarding land use, and reported he
feels they are open to input concerning land use. He further stated he is a member of the Colorado
Benefits Management System Executive Steering Committee as a representative for the County
Commissioners, and explained there is a growing concern with the ability of people to access this system
due to issues with bandwidth, lack of trained personnel, and the system being down. Commissioner
James stated he wrote an email addressing the need to work together as government agencies to find
solutions, rather than pointing fingers.
RE WARRANTS:
1) GENERAL WARRANTS - JANUARY 17, AND 20, 2023: Commissioner Ross moved to approve the
General Warrants, as printed. Commissioner James seconded the motion, and it carried unanimously.

BIDS:
1) APPROVE BID #62300046, FUEL SITE CONCRETE ENTRANCE - FACILITIES DEPARTMENT:
Christie Peters, Purchasing Department, stated staff recommends selecting the lowest bidder who met
specifications, RCD Construction, Inc., for a total amount of $60,040.00. Commissioner James moved to
approve said bid. The motion was seconded by Commissioner Ross, and it carried unanimously.
ILEs 2) PRESENT AND APPROVE EMERGENCY BID #62200180, AUDIT SERVICES REQUEST FOR
PROPOSAL (RFP) — ACCOUNTING DEPARTMENT: Ms. Peters stated the current auditing firm notified
the County that they could not perform the audit for Fiscal Year 2022, therefore, staff recommends the
emergency approval of Hinkle and Company, PC, in the amount of $85,000.00. Commissioner Ross
moved to approve said bid, on an emergency basis. The motion was seconded by Commissioner James,
and it carried. unanimously.
I. 1 3) PRESENT BID #82300044, DEPARTMENT OF PUBLIC HEALTH AND ENVIRONMENT
BUILDING HEATING, VENTILATION, AND COOLING (HVAC) UPGRADE - FACILITIES
DEPARTMENT: Ms. Peters stated three (3) bids were received and staff will make a recommendation
on February 6, 2023.
4) PRESENT BID #62300047, TRAFFIC PAINT AND BEADS - DEPARTMENT OF PUBLIC
WORKS: Ms. Peters stated six (6) bids were received and staff will make a recommendation on
February 6, 2023.
1 CONSENT AGENDA: Commissioner James moved to approve the Consent Agenda, as printed.
Commissioner Ross seconded the motion, and it carried unanimously
El NEW BUSINESS:
1) CONSIDER 2022 ANNUAL REPORT FOR DISCHARGES FROM APPLICATION OF PESTICIDES
AND AUTHORIZE CHAIR TO SIGN: Tina Booton, Department of Public Works, explained this annual
report documents the herbicide applications made in 2022, under the National Pollutant Discharge
Elimination System (NPDES) requirements. Commissioner James moved to approve said report and
authorize the Chair to sign. Seconded by Commissioner Ross, the motion carried unanimously.

NI 2) CONSIDER CONTRACT ID #6615 PROFESSIONAL SERVICE AGREEMENT FOR
EMERGENCY VETERINARY CARE SERVICES AND AUTHORIZE CHAIR TO SIGN - PATHWAY VET
ALLIANCE, LLC, DBA PETS EMERGENCY HOSPITAL: Sonja Kohlgraf, Sheriff's Office, stated this
agreement will allow for animal control officers to take urgently sick or injured animals at -large to be
evaluated for urgent cases to PETS Emergency Hospital, located in Evans, Colorado, for the amount of
$156.00, per visit, from January 1, 2023, through December 31, 2026. Commissioner Ross moved to
approve said agreement and authorize the Chair to sign. The motion was seconded by Commissioner
James, and it carried unanimously.
i 3) CONSIDER PROGRAMMATIC AGREEMENT CONCERNING ENVIRONMENTAL REVIEW
PROCESS FOR COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) HOUSING ACTIVITIES, AND
ADMINISTRATION OF U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT (HUD)
PROGRAM FUNDS, AND AUTHORIZE CHAIR TO SIGN - TOWN OF FIRESTONE, AND COLORADO
STATE HISTORIC PRESERVATION OFFICER: Elizabeth Relford, Deputy Director of the Department of
Public Works, alongside Paula Mehle, Director of Economic Development for the Town of Firestone,
stated this agreement will allow for the Town to streamline their environmental review process for
buildings 50 years or older. In response to Commissioner James, Mr. Relford stated the County is
ensuring the Town is following the environment review process as the CDBG fund manager.
Commissioner James moved to approve said agreement and authorize the Chair to sign. Seconded by
Commissioner Ross, the motion carried unanimously.
4) SECOND READING OF CODE ORDINANCE #2023-02, IN THE MATTER OF REPEALING AND
REENACTING, WITH AMENDMENTS, CHAPTER 12 LICENSES AND PERMITS OF THE WELD
COUNTY CODE (SECURE TRANSPORTATION SERVICES): Commissioner James moved to read
Code Ordinance #2023-02 by title only. The motion was seconded by Commissioner Ross, and it carried
unanimously. Bruce Barker, County Attorney, read the title for the record and further stated there have
been no changes since the First Reading. No public testimony was offered concerning this matter.
Commissioner Ross moved to approve Code Ordinance #2023-02 on Second Reading. The motion,
which was seconded by Commissioner James, carried unanimously.
ILI PLANNING:
1) FINAL READING OF CODE ORDINANCE #2023-01, IN THE MATTER OF REPEALING AND
REENACTING, WITH AMENDMENTS, CHAPTER 24 SUBDIVISIONS OF THE WELD COUNTY CODE
(FAMILY FARM DIVISION): Commissioner James moved to read Code Ordinance #2023-01 by title only.
The motion was seconded by Commissioner Ross, and it carried unanimously. Mr. Barker read the title
for the record. Jim Flesher, Department of Planning Services, stated this was rescheduled from
January 18, 2023, and there have been no changes since Second Reading. No public testimony was
offered concerning this matter. Commissioner James moved to approve Code Ordinance #2023-01 on
Final Reading. The motion, which was seconded by Commissioner Ross, carried unanimously.
RESOLUTIONS AND ORDINANCES: The Resolutions were presented and signed as listed on the
Consent Agenda. Code Ordinance #2023-01 was approved on Final Reading, and Code Ordinance
#2023-02 was approved on Second Reading.
Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted
by the Clerk to the Board. There being no further business, this meeting was adjourned at 9:20 a.m.
