A public hearing was conducted on December 6,2023,at 9:00 a.m.,with the following present:
Commissioner Mike Freeman,Chair
Commissioner Perry L.Buck,Pro-Tem
Commissioner Scott K.James
Commissioner Kevin D.Ross
Commissioner Lori Saine
Also present:
Acting Clerk to the Board,Jess Reid
County Attorney,Bruce Barker
Planning Services Department representative,Diana Aungst
The following business was transacted:
`'I hereby certify that pursuant to a notice dated February 8,2023, and duly published
February 10,2023,in the Greeley Tribune,a public Show Cause hearing,PCSC22-0010,was
scheduled for February 22,2023,and rescheduled due to inclement weather and closure of
County Offices.On March 1,2023,a hearing was conducted to determine whether good cause
exists for the revocation of Use by Special Review Permit,USR-413,for Aircraft Storage and
Salvage in the A(Agricultural)Zone District, held by Paul Page.At said hearing,the Board
continued the matter to June 7,2023,to allow Mr.Page additional time to bring the site into
compliance.At the hearing on June 7,2023,the Board continued the matter to December 6,2023,
to allow Mr.Page additional time to come into compliance with the permit.Bruce Barker,County
Attorney,made this a matter of record.
(Clerks Note:While the audio was muted Chair Freeman called up the case and announced all
five(5)Commissioners were present.Bruce Barker,County Attorney,read into the record the
case number,the Conditions of Approval of which the site was not in compliance,the date of the
Notice and its publication,and the previous dates in which the case had been heard.)
fi Diana Aungst,Department of Planning Services,stated she had been in communication with
the Town of Erie,who,as of November 1,2023,purchased the property.She stated all of the
previous lessees have vacated the site and she displayed images from November 2023.She
mentioned there is still some crushed concrete/asphalt onsite,but stated the Town of Erie has a
contract with Mr.Page,to pay him the remainder of the price of the land,after all of the piles are
removed.Ms.Aungst stated the Town of Erie relayed they are going to fast-track the annexation
process and there will be nothing placed on the site,prior to annexation,that will require permits
from Weld County.

Fri Ms.Aungst confirmed that although they were expecting a representative from the Town of
Erie to attend the hearing,there was no representative present.
'=,No public testimony was offered concerning this matter.
IR In the matter of Show Cause hearing,PCSC22-0010,Commissioner Ross moved to dismiss
the Show Cause hearing and was seconded by Commissioner Saine.Discussion ensued among
the Board as to whether or not the site,even though purchased by the Town of Erie,is considered
in compliance,since there is still crushed concrete/asphalt on the site.After a suggestion from
Mr.Barker,the Board unanimously agreed to dismiss the case with the finding that the Town of
Erie has purchased the property and plans to annex it soon.There being no further discussion,
the hearing was completed at 10:25 a.m.
This Certification was approved on the 20th day of December,2023.
