RESOLUTION
WHEREAS, a public hearing was held on July 8, 1970 at 2:30 P. M.
in the chambers of the Board of County Commissioners of Weld County
at Greeley, Colorado, for the purpose of hearing the petition of Mrs. Avis
Harsh, 118 North 35th Avenue, Greeley, Colorado, requesting a change of
zone from "A" Agricultural District to "M-H" Mobile Home District, and
-. WHEREAS, the petitioner was present, and
WHEREAS, there was no one present in opposition to the change of
zone, and
WHEREAS, the Board of County Commissioners heard all the
testimony and statements from those present, and
WHEREAS, the Board of County Commissioners has studied the
recommendations of the Weld County Planning Commission as submitted,
and having been fully informed;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS, that the petition of Mrs. Avis Harsh, 118 North 35th Avenue,
Greeley, Colorado, for a change of zone from "A" Agricultural District to
"M-H" Mobile Home District, said area being more particularly described as
follows:
A parcel of land in the NW+ of Section One (1), Township Five
(5) North, Range 66 West of the 6th P. M. , Weld County,
Colorado, and more particularly described as follows:
Beginning at a point which falls 30 feet south and 30 feet east
of the Northwest Corner of said Section 1; thence south and
par-allel to the west line of said section, a distance of 1100
feet; thence southeasterly along the south side of Greeley
No. 3 Canal, a distance of 775 feet to a point on the south side
of said No. 3 Canal; thence continuing easterly 560 feet to a
point; thence northerly 1320 feet to a point 50 feet south of
-said -section line; thence West and parallel to the north line
of said section, a distance of 1320 feet to the True Point of
Beginning, containing 37. 8 acres, more or less,
i-s hereby granted under the conditions following:
1. Any water and sanitation facilities to be installed shall be approved
by the State Health Department.
2. All applicable subdivision regulations, zoning regulations and mobile
home and mobile home park regulations shall be followed and complied with to
the satisfaction of the Board of County Commissioners of Weld County, Colorado.
3. Dedication of an additional 20 feet for right of way on 35th Avenue
and on C Street.
4. That an office and park area to be constructed by the time 50 sites
are completed.
b. That city water and sewer service be provided.

Mr. Billings: I wit. call this hearing to order, the notice which was
printed as required by the zoning laws of the State of Colorado,
said hearing will be held in the Office of the Board of County
Commissioners, Weld County, Colorado, Weld County Court House,
Greeley, Colorado, at theiime specified and any person in any
manner opposed to said change of zone are requested to attend
and may be heard. This is Docket Number 37, Avis Harsh of
118 North Thirty-fifth Avenue, Greeley, Colorado. Dated
July 8th, 1970 at 2:30 P. M. The request is a change of zone
from "A" Agriculture to "MH" Mobile Home District. Mr. Telep
at this time would you like to make a record.
Mr. Telep: Thank you Mr. Chairman, let the record show that
this cause came on for a hearing this day, July 8, 1970, at
2:00 P. M. as advertised as required by law. Let the record
further show that a petition for a change of zone by Mrs. Avis Harsh
118 North Thirty-fifth Avenue, Greeley, Colorado, for a Change of
Zone from "A" Agriculture District to "MH" Mobile Home District
of a parcel of land located in the Northwest Quarter of Section
1, Township 5 North, Range 66 West of the 6th P. M. , Weld County,
Colorado, containing 37.8 acres more or less.
Jet the record further show that the petitioner
Mrs. Avis Harsh, is here in person. Let the record show that
there is on file a resolution from the Weld County Planning
Commission dated May 5, 1970, recommending favorably for the
change of zone, however with conditions and I believe these
conditions can be gone into into further detail with the

Weld CountyrPlanner who is present here to answer any questions
that the Board may have of him. Mr. Chairman I believe we are
ready to proceed. I think—maybe we may start by asking the petitioner
to state her reasons for wanting this change of zone and if anyone
else is here to talk for her let them come up and introduce themself
Mr. Billings: Mrs. Harsh at this time would you present to this Board
your reasons for requesting this zone. It would be well if you
went into specifics of how you plan to develop - such as street
utilities, water and sewer.
Mrs. Harsh: The original zoning is not faulty, diversion of land
into small tracts is limited for potential as far as agriculture
also there are a number of active gravel pits in the area. The
land has access to paved roads and near to the city limits of Greeley.
It is easily accessible to shopping centers. The smoke, smell and
fumes are at a minimum in the territory. There is an apparent
need, for parks especially the large parking areas. Adjoining Lend
would benefit through increased valuation due to the intensified use
of the land and the land would be used for residential use only.
Due to the size of the package it is difficult for farming. It
appears to be a suitable tract for a mobile park.
Mr. Billings: Mr. Thompson are you here representing Nelson, Haley
Patterson and Quirk
Mr. Thompson: Yes.
Mr. Billings: I understand you drew up the plans for this - would you
like to at this time give us the detail on the planned proposal.
Mr. Thompson: We have worked with the County Planning Commission for
several months. This is "C" Street and this is Thirty-fifth Street

this is Number Three Canal that runs along the top of the hill
going out 35th Street. We are trying to familarize you with it
- at the present time there is a mobile home, Mrs. Harsh's home,
in this area. We have been working with the Planning Commission
-for quite some time. We have a density which is very similar
to a residential district in town for houses that are being built.
The size of the lots are about that size. I think we have about
5.-8, if I remember right, units per acre and a residential area
will have about 4 to 4.5 per acre. We have large areas, we have
an acre here, there is 2 acres here and a half acre over here.
These all are open areas for the playgrounds and parks, general
open areas for the trailer parks.
Each space, except for this here, along 35th and
along "C" Street, each trailer space has -acees to these over hangs
immediate or adjacent or contiguous, except for a very few lots
area
We have a 30 foot green belt/around the trailer park and it is
set back from any public streets plus additional dedication of
for major streets
30 feet for a total half street or 50 feet We have a storage
area for boats, trailer houses or whatever might be - way back
in this area against the hill. I-think Mrs. Harsh plans a stage
development to begin with on 35th Street approximately 8 acres
in this area. I think there are 52 lots or spaces in this first
development. Her plans at this time is to complete the trailer
park in two other construction stages. It would be my thinking
that the next stage would be this area here and the final stage
would be this area, back up against the canal. As she has already
stated that on that 37 acres there is not a great deal of farming
that can be done on 30 acres of property. As far as a mobile

home park is concerned about 6 months ago I made a survey of the
area myself, and there were no mobile home spaces available at
that time and there were waiting lists. Now what has happened
in the last six months I don't know. I think I know of one
park that has been constructed and it is not quite this large.
I know of some thats tentatively going to be constructed. But
the need for a mobile home park is here. It provides - well it
is not a low cost housing, there isn't such a thing anymore.
But it provides a house that can be afforded by the low income
bracket of people I would say. The pay off period is similar
to the pay period - the can financing like you can get on an
automobiles. The need is there - the people wanting to own
homes or wanting this type of vehicle. Do you have any questions?
Marshall Anderson: What size stalls are you talking about?
Mr. Thompson: On the whole lot - 226 on 37 acres.
Mr. Anderson: There is no automobile access to that road except
on that one street.
Mr. Thompson: Thats right none whatsoever.
Mr. Anderson: Its over on 35th.
Mr. Thompson: There won't be any entrances across this -
Mr. Anderson: There won't be any that face 35th Street.
Mr. Thompson: No, the trailers all face into road in side - there will
be 2 parking spaces per trailer.
Mr. Anderson: Will they be able to hook up to city sewer2
Mr. Thompson: Yes, we intend that along on 35th to build a 4 inch main
and this has been gone through with the city and they are agreeable

to build a force main to 4th Street and then use gravity with the
force main.
Mr. Billings: What sortof utilities, telephone and power lines are
they going to be underground?
Mrs. Harsh: Underground.
Mr. Thompson: We have anticipated paving the streets within the trailer
park with all underground utilities.
Mr_ Billings: Are these streets within the trailer park - or in other
words you plan to develop them along 35th Avenue now - are you going
to put in streets and facilities, streets paved according to
specifications before you move trailers into the area?
Mr. Thompson: That would be up to Mrs. Harsh - I should think that
we had this area and these streets were paved - I should think that
it would be the logical thing to put the trailers in here.
Marsh Anderson: Are those streets going to have valley gutters in them?
Mr. Thompson: I don't know we really hadn't - Mrs. Harsh has asked
me for some engineering costs that I have not come up with yet. I
think that it would probably be the "V" type gutter.
Mr. Anderson: There will be off street parking for all lots?
Mr. Thompson: Yes everything is off street. I thought so by the size
of the street.
Mr. Billings: Who will maintain these streets?
Mr. Thompson: The owner.
Mr. Billings: Your water will be off the city water system?
Mr. Thompson: Yes.

Mr. Billings: You also plan to have this green belt along 35th Avenue?
wherever you develop - would you put this in as soon as the development
atarts or would it come a good many years from now?
Mr. Thompson: We are required by the ordinance to provide this setback
from the property line and the street. We have to plan the setback
from the property line to the street or the right of way line we have
to provide this setback for mobile home parks - so many feet. Maybe
a misquoted I shouldn't say green belt it is an open space. I think
it comes under this open space, there can't be anything constructed
en it, it should be grassed in. Actually at first we thought about
using it as an peen space but then we have the park and playgrounds
back here in the interior of the park.
Marshall Anderson: Is this strictly rental?
Mrs Harsh: Not it is rental - it is a trailer court.
Audience: Will there be any restricted area for say retired people?
Or and area where children will stay?
Mr. Thompson: I don't know what Mrs Harsh has in mind as far as
the people.
Mrs. Harsh: I hope to be able to set it up that way - or until we
get started.
Mr. Billings: Gentlemen, do you have any other questions of Mr. Thompson?
Harold Anderson: No. I have the picture pretty clear in my mind.
Marshall Anderson: No.
Mr. Billings: At this time the County Planner, Mr. Lorensen, would
give us the recommendation of the Planning Commission.

Mr. Lorensen: Mr. Chairman, it was approved by the Planning Commission
subject to some requirements. The requirements are as follows:
(1) it should be tapped on to city water and city sewer, we feel
that city water and city sewer if not available to them then the
development should not be allowed. The septic systems for this
type of density or package plant was unacceptable. In addition
it would require a deed for
to this although it shows on the plan/an additional right of way
of 20 feet along 35th Avenue and also 20 feet of right-of-way
- additional right-of-way along "C" Street. And if you are worried
from this
about access on to 35th or "C" Street,/we can take one-third of that
non
20 feet and deed it to the County for/roadway purposes, which stops
the acess onto the streets as shown at the opening.
The Planning Commission also recommends no more than
50 sites be developed before the park is put in - a centralized
park and office. By the time 50 sites have been developed such
a facility should be available for these people before another
site is developed.
Also they were to present a drainage survey, now as
far as I know the drainage survey has not been submitted.
Mrs. Har-H: I asked the government office and they sent me mine,
didn't they send you a copy?
Mr. Lorensen: Your right, Yes they have and I will read it
This is from the U. S. Department of Agriculture to Mrs. Avis Harsh.
"Dear Mrs. Harsh, With regard to your request for information about
a drainage sewer on your land. In 1959 this parcel you requested
was investigated by the Soil Scientists from the U. S. Soil Conservation
District with the possibility of an underground drainage tile being
installed later in the year. A design was made by an engineer

of the SCS and consequently 800 lineal feet of 10 inch bell tile
was installed, this line is parallel to what is 25th Avenue which
is located approximately 100 feet inside of the property line.
In January and February 1960 additional drain tile was installed
with the original design in the amount of 1440 lineal feet of
B inch bell tile. This line runs almost parallel to what is
commonly called Number Thee Irrigation line, which is located
approximately 200 to 250 feet north of the canal. This entire
line is functioning any other pertinent information regarding
the depth of the tile line, location, etc can be obtained in
our office from the orginal planning -design.

So I would assume that __ as given and there
is a method of draining this so I feel this is acceptable. So
to make it straight for the record, there should be some additional
requirements, nothing that they haven't already agreed to. (1)
is that is zoning is granted it shall be made clear that street
pavement, curb and gutter and sidewalk inflailed and also underground
utilities.
Mr. Billings: At this time I would ask if there is anyone in the
audience who would like to testify also in favor of granting the
change of zone from "A" Agriculture to "MH" Mobile Home District.
Audience: There is one thing I would like to know — will the
neighbors on either side be able to hook onto the sewer? To have
city water out there.
Mr. Billings: This is something you would have to check with the
city on — it will be city water and city sewer and we would have no
jurisdiction.

Mr. Billings: I assume there would be the possibility if the sewer
comes down your steet, but I would not be able to give you an
answer - you will have to check with the city on that. If there
are not any more people in the room in favor of granting this
petition, at this time we will ask for those who would like to
make any statements in opposition to this change of zone. Or if
there are any questions you would like to ask regarding this change
of zone - notnecessarily in opposition.
Audience: What is the storm sewer drainage? What is provided
there?
Mr. Thomspson: For a mobile home park it is somewhat different than
a residential ara you have lesser paved areas for streets and the
hours run-off is much smaller than the runoff from a home or ordinary
residence. With less central development we figure a 10 year storm
and half the rainfall that falls within that time concentrating its
points you go through - its cut down considerably probably to .25 or
.3 . The way the drainage - actually - distance the water :runs down
from the canal down to "C" Street we don't actually - with the mobile
home park there will be very little additional water added to "C"
Street. The same amount will be in there but it won't get there any
faster. It doesn't create a greater volumn at any one time, and the
outfall, I believe, there is a ditch that runs from "C" Street to
35th. We ran a profile on that street hoping we could get the sewers
down 26th Avenue, down to that point, so we could get the people
who live along"C" Street their sewers and it was just so flat, if
we could maintain a grade so it would be so shallow that it practically
be on top of the ground - but the water can get that way also.

Audience: The water would come down "C" Street instead of the Northwest.
Mr. Thompson: Yes it would go north to "C" Street them go east.
Mr. Billings: Are there any more questions?
Audience: No it all probably go don in my yard.
Mr. Thompson: We won't have that.
Audience: I have another question, I would like to ask - are they
-going to pave "C" Street?
Mr. Billings: This is something that would be pretty hard to answer
also it is a county road and if this park develops to a point where
traffic survey indicated that it was a necessity for "C" Street - well

automobiles and the roads at a certain given time through the day
to automatically establish this.

Mr. Billings: I would assume that if it develops at all it would
faciltate something being done on "C" Street. Here again this is
all established on a traffic count and the use of the road during
a particular number of day and certain lengths of time. Undoubtlyr
as Greeley grows west, north and south the overall plans - not
necessarly plans but engineering studies - there will be considerable
growth in the next few years and the street would probably be built
up and asphalted. We have certain standards, certain vehicles per
day on these roads, and bring them up to standard. This would all
come about by increased traffic. Are there any otherquestion?

Mr. Billings: Mrs. Spomer, maybe sh-e could elaborate on this a little
tit, how mobile homes are taxed now -through her; department. She
can probably answer this question; -a little bit better than I could.
Mrs. Spomer: -This come under House Bill 1300, that was enacted this
last session. Taxes are based on the cost of the mobile home and
set
also the site as/by state law. And that is why it is put into the
various political subdivisions.
Mr. Billinqt: Mrs. Spomer, this is similar to taxation on a similar
home, i3 it not
Mrs. Spomer: Yes, in fact it was Palmer Burches idea that mobile homes
should pay their just -fair tax for services received.
Mr. Billings: Are there any other questions? If there are not I think
this Board would like to study this a little further and we will make
a final decision at such time in the very near future when we do make
a decision on this, Mrs. Harsh you will be notified and those of you
who live in the immediate vacinity will be notified by certified mail
of the approval or denial. If there is not further business to come
before the Board regarding this hearing I would entertain a motion
to adjourn.

DISCUSSION: Mr. Lorenson stated this case has been requested much earlier for

rezoning, there is one thing missing. The applicant is required to notify
all the people livi.n€° within 5001. There are 3 or 4 signatures but not- a
list of the people living in the area. It is also required that a tentative
. time schedule for construction be proposed by the developer. A 200 sq. ft.
recreational area for a mobile home par s required. This proposal does
not meet this requirement. `There is sup sed to be 3. 3301 minimum width.
This lot does have 3501, however, if they dedicate the additional 201 that
would be required on the road, they do come down to the dead minimum. As
a result, we have a. very poor design. Based on those recommendations and
primarily on the design, .i.t cannot be recommended. It has a density of 6.6
units. Mobile homes do not provide the services on a tax base that is re-
quired of them. These services should be provide for within the design
.as -much as possible. This design is very much short in the way of recrea-
tion area. Mr. Lorenson recommended disapproval. Mr. Thomason stated re-
tarding the sewer system, there waula be a pneumatic ejector at 35th and C
-street. Mr. Cruse has been contacted and is sure they will enter into a
contract with the City. Mr. Lorenson suggested these services to be con-
tracted should be in writing. Mr. Thomason stated another lot could be
-given to the recreation area. The lots are good sized and felt the owner
does have some prerogative in the way they want to develop their land,from
the dollar standpoint they can't give up too much. The sanitary system
will cost from 415,000 to $20,000. This win. be served by North Weld Water
System. Mr. Heitman inquired of the need. Mr. Thomason stated he had made
a survey and at the time there wasn't a space available and there were
waiting lists et each park. Mr. Lorenson stated. he is not opposed to the
mobile home park, but to the poor design.
MOTION: By Mr. Bowles that the matter be tabled until the next meeting. Written
items should be furnished regarding the utilities and if the applicant
wishes to submit the same design with more park design, it will be approved
or disapproved on the basis of the design. Justification of need should be
established. Second by Mr. Watson. A unanimous vote of "Aye". Motion
carried.
