RE: VACATING A PORTION OF ALLEY IN BLOCK 2 AND A PORTION OF
SECOND STREET ADJACENT TO SAID BLOCK 2, FIRST ADDITION TO
TOWN OF ROGGEN, WELD COUNTY, COLORADO, BY QUITCLAIM
DEED TO PRESENT OWNERS.
BE IT RESOLVED, that the Board of County Commissioners of Weld County,
Colorado, does hereby sign a Quitclaim Deed as requested by the present owners,
thereby vacating a portion of alley in Block 2 and a portion of Second Street
adjacent to said Block 2, First Addition to Town of Roggen, Weld County,
Colorado, as shown on recorded plat and more particularly described as follows:
That portion of alley lying between Storey Street and
Interstate Highway 80-S right of way, in Block Two
(2), First Addition to Town of Roggen, Weld County,
Colorado, and
That portion of Second Street lying between Storey
Street and Interstate Highway 80-S right of way, bet-
ween Block 2 and Block 4, First Addition to Town of
Roggen, Weld County, Colorado.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote:

THIS DEED, Made this 2nd day of September, in the year of
{ our Lord One Thousand Nine Hundred Seventy, between WELD COUNTY,
o a municipal corporation and a political subdivision of the State of Colorado,
by the BOARD OF COUNTY COMMISSIONERS, for the respective interests

WITNESSETH, that the said party of the first part, and in consid-
en eration of the sum of other valuable considerations and ten dollars, to said
party of the first part in hand and paid by the said parties of the second
o part, the receipt whereof is hereby confessed and acknowledged, has
remised, released, sold, conveyed and QUIT CLAIMED, and by these
presents does remise, release, sell, convey and QUIT CLAIM unto the

demand which the said party of the first part has in and to the following

appurtenances and privileges thereunto belonging or in anywise thereunto
appertaining, and all the estate, right, title, interest and claim whatsoever,
of the said party of the first part, either in law or equity, to the only proper
use, benefit, and behoof of the said parties of the second part, their heirs
and assigns forever.

Beginning at the Southeast corner said Block 2y thence 887°16'00"W on an
assumed bearing along the South line said Block 2 a distance. of 225.00 feet
to the Southwest corner of Lot 9 said Block 21 thence N02°40 '30"W along the
West line said Lot 9 and the Northerly extension of said West line a distance
of 158. 00 feet to a point on the centerline of the alley in 'said Block 2;

We, the undersigned, being owners of 100% of the adjacent property bordering on
the platted alley in Block 2, First Addition to the Town of Roggen, Weld County,
Colorado hereby petition that said alley be vacated. Description of said alley
is described in certified boundry survey attached hereto.
Reason for request to vacate is that the alley has not been used by prior owners
in past years and the location of right-of-way for the access road to Interstate
Highway 80-s as shown on the survey makes the a4ley a dead end and it is not
possible for a vehicle to turn and use the alley. Further, the entire north half of
Block 2 and the Eh of the SZ of Block 2 is submitted for rezoning to commercial
use for erection of a gasoline retail service station and current alley would be
used for general parking area.

As owners of 100% of the adjacent property to that part of Second St. lying West
of Storey St. in First Addition, Town of Roggen, Weld County, Colorado as shown
and described on certified boundry survey attached hereto, we hereby request that
said parcel of street be vacated.
Reason for the request is that the right-of-way for the access road to Interstate
Highway 80-s took all but the portion lying north of Lots 33 thru 36 inclusive,
in Block 2, First Addition to the Town of Roggen and it therefore dead-ends against
the highway fence. The road had never been opened and in use prior to the placement
of highway 80-s and there would be no continuing need for the parcel described.
The adjacent property is being submitted for rezoning to commercial for use as a
retail gasoline service station and the vacated portion would be used for general
parking area.
