BOARD OF COUNTY COMMISSIONERS
WELD COUNTY, COLORADO
MONDAY, AUGUST 14, 2023
The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity
with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration
Building, Greeley, Colorado, August 14, 2023, at the hour of 9:00 a.m.
IR ROLL CALL: The meeting was called to order by the Chair and on roll call the following members
were present, constituting a quorum of the members thereof:
Commissioner Mike Freeman, Chair
Commissioner Perry L. Buck, Pro-Tem
Commissioner Scott K. James
Commissioner Kevin D. Ross
Commissioner Lori Saine
Also present:
County Attorney, Bruce Barker
Acting Clerk to the Board, Houstan Aragon
Chief Financial Officer, Cheryl Pattelli
• MINUTES: There being no corrections to the Minutes of the Board of County Commissioners
meeting of July 31, 2023, as printed, Commissioner Buck moved to approve. Commissioner Ross
seconded the motion and it carried unanimously.
• AMENDMENTS TO AGENDA: There were no amendments to the agenda.
▪ CONSENT AGENDA: Chair Freeman called for public input regarding the following items listed
under `Consent Agenda -Miscellaneous'; however, no public testimony was offered concerning these
matters. Commissioner Ross moved to approve the Consent Agenda, as printed. Commissioner James
seconded the motion and it carried unanimously.
2) Partial Vacation, VAC23-0040, of Two -Lot Recorded Exemption, RE -142, for Removal of Lot A —
Yolks on You Chicken Farms, LLC, c/o Ryan Hostetler
3) Partial Vacation, VAC23-0045, of Two -Lot Recorded Exemption, RECX15-0087, for Removal of
Lot B — Leslie Gelvin and Jeanne Gelvin
• PRESENTATIONS:
1) RECOGNITION OF SERVICES, HUMAN SERVICES ADVISORY COMMISSION -
MELANIE WOOLMAN: Chair Freeman read the certificate for the record, and the Board thanked
Ms. Woodman for her voluntary efforts for the citizens of Weld County.

• WARRANTS:
1) GENERAL WARRANTS - AUGUST 11, 2023: Commissioner Saine moved to approve the General
Warrants, as printed. Commissioner James seconded the motion and it carried unanimously.
• BIDS:
1) PRESENT BID #B2300154, RECYCLED ASPHALT PRODUCT (RAP) - DEPARTMENT OF PUBLIC
WORKS: Rose Everett, Purchasing Department, stated three (3) bids were received and staff will make
a recommendation on August 28, 2023.
▪ NEW BUSINESS:
1) CONSIDER ACCEPTANCE OF ASSIGNMENT OF CONTRACT TO BUY AND SELL REAL ESTATE,
KNOWN AS 2139 EAST 8TH STREET, GREELEY, COLORADO 80631, AND AUTHORIZE CHAIR TO
SIGN ALL NECESSARY DOCUMENTS: Toby Taylor, Director of the Facilities Department, stated this
contract is to accept the assignment for the purchase of the stated property, in the amount of
$3,311,694.00, and has been published twice in accordance with Weld County Code, due to the amount
exceeding $2.5 Million. He explained the property will be the proposed future site for a new Department
of Fleet Services building for heavy equipment, in addition to housing the trucking division of the
Department of Public Works, and storage of vehicles for the Sheriff's Office. No public testimony was
offered concerning this matter. In response to Commissioner Saine, Mr. Taylor could not recall the date
of the work session that was held, but other members of the Board confirmed there was a work session
held pertaining to this property located close to the Greeley -Weld County Airport. Commissioner Ross
moved to approve said contract and authorize the Chair to sign all necessary documents. The motion
was seconded by Commissioner Buck, and it carried unanimously.
2) CONSIDER TEMPORARY CLOSURE OF CR 22 BETWEEN CRS 37 AND 41: Amy Mutchie,
Department of Public Works, stated this closure will begin on August 21, 2023, and go through August 31,
2023, to replace an irrigation culvert to alleviate flooding from agricultural landscaping. She stated a
majority of the detour route is paved, with water to be used as needed for the one (1) mile of gravel road
to mitigate dust, and message boards will be placed in advance of this closure. Commissioner Buck
moved to approve said temporary closure. The motion was seconded by Commissioner Ross, and it
carried unanimously.
3) CONSIDER APPOINTMENT TO HUMAN SERVICES ADVISORY COMMISSION:
Commissioner James moved to approve said appointment. The motion was seconded by
Commissioner Buck, and it carried unanimously.
IR 4) CONSIDER APPOINTMENT TO PLANNING COMMISSION: Commissioner James moved to
approve said appointment. The motion was seconded by Commissioner Saine, and it carried
unanimously.
--- 5) CONSIDER CANCELLATION OF BOARD OF COUNTY COMMISSIONERS MEETING
SCHEDULED FOR SEPTEMBER 13, 2023: Commissioner James moved to approve said meeting
cancellation. The motion was seconded by Commissioner Ross. Chair Freeman stated this is for the Ten
(10) County Budget Conference. There being no further discussion, the motion carried unanimously.

le 6) SECOND READING OF CODE ORDINANCE #2023-11, IN THE MATTER OF REPEALING AND
REENACTING, WITH AMENDMENTS, CHAPTER 7 EMERGENCY MEDICAL SERVICES OF THE
WELD COUNTY CODE (AMBULANCES): Commissioner James moved to read Code Ordinance
#2023-11 by title only. The motion was seconded by Commissioner Buck, and it carried unanimously.
Bruce Barker, County Attorney, read the title for the record. Jason Chessher, Director of the Department
of Public Health and Environment, stated there have been no comments received on this draft ordinance,
and there have been no changes since First Reading. No public comment was offered concerning this
matter. Commissioner Buck moved to approve Code Ordinance #2023-11 on Second Reading. The
motion was seconded by Commissioner Ross, and it carried unanimously.
El PLANNING:
1) SECOND READING OF CODE ORDINANCE #2023-13, IN THE MATTER OF REPEALING AND
REENACTING, WITH AMENDMENTS, CHAPTER 21 AREAS AND ACTIVITIES OF STATE INTEREST,
CHAPTER 23 ZONING, AND CHAPTER 29 BUILDING REGULATIONS OF THE WELD COUNTY
CODE (OIL AND GAS EQUIPMENT/TELECOMMUNICATION TOWERS): Commissioner Ross moved
to read Code Ordinance #2023-13 by title only. The motion was seconded by Commissioner Buck, and
it carried unanimously. Mr. Barker read the title for the record. Tom Parko, Director of the Department of
Planning Services, alongside Jason Maxey, Director of the Department of Oil and Gas Energy, reviewed
the proposed changes from First Reading, but stated there have been no changes made since First
Reading. No public comment was offered concerning this matter. Commissioner Saine moved to approve
Code Ordinance #2023-13 on Second Reading. The motion was seconded by Commissioner Buck, and
it carried unanimously.
PUBLIC COMMENT: No public comment was offered.
RESOLUTIONS AND ORDINANCES: The Resolutions were presented and signed as listed on the
Consent Agenda. Code Ordinances #2023-11, and #2023-13, were approved on Second Reading.
Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted
by the Clerk to the Board. There being no further business, this meeting was adjourned at 9:10 a.m.
These Minutes were approved on the 28th day of August, 2023.
