A public hearing will be held before the Weld County Planning
Commission (PC) and a subsequent hearing will be held with
the Board of County Commissioners (BOCC). Both hearings
tk will be held in the Hearing Room, Weld County Administration
Building, 1150 O Street, Greeley, Colorado. Please note the
hearing dates and times listed on the other side of this card for
the proposed project. The Agenda will be posted one week
prior to the hearing. The hearings will also be live -streamed at
https://www.weldgov.com/departments/commissioners/
If you would like more information regarding this proposal and the conditions that must
be met, the file is public information and is available for review at our office. You may
also view the file online at https://accela-aca.co.weld.co.us/citizenaccess/ by inserting
the case number. Comments or objections related to the request should be submitted
in writing to the Weld County Department of Planning Services, 1555 N 17th Ave,

To Whom It May Concern,
This letter is being prepared on behalf of Monarch Mountain Minerals and Aggregates, LLC, who plans to mine to sand and
gravel on approximately 544.06 acre parcel of land. The site is located west and north of the intersection of Weld County
Road 22 and 26 Highway 60, approximately 1 mile west of the Town of Gilcrest. More specifically, the mine is within pads of
Sections, 18, 19 and 30, Township 4 North, Range 66 West and Section 36, Township 3 North, Range 68 West of the 6th
Principal Meridian. The site is 1,200 feet east of the South Platte River at its closest point. Land uses in the area include
agricultural, oil and gas production, active gravel mines, gravel mines reclaimed as below grade reservoirs, and residential
housing. The site and vicinity are shown on Figure 1. A Division of Reclamation Mining and Safety (DRMS) permit has been
approved and a proposed Use By Special Review has been submitted to Weld County.
Per Colorado Revised Statute, C.R.S. 24-65.5-103 (adopted as pad of H.B.01-1088) we are required to notify all mineral
estate owners 30 days prior to any public hearing. Confirmation of the hearing date was not set until February 9th, 2023, past
the 30 -day notice period. Monarch Mountain Minerals and Aggregates, LLC. is requesting a waiver from this rule to allow for
25 -days prior notice to allow for the February 7th Planning Commission Hearing date to proceed.

on the property and is required to be notified that a Planning Commission Hearing has been set for March 7th at 1:30
PM. We were informed that the hearing was scheduled today, which puts us past the 30 -day notice requirement.
Monarch Mountain is requesting that Oxy accept a waiver of the 30 -day notice requirement and accept this notice at 26 -

Attached is the mine plan that we discussed on the phone. It looks like your wells and surface facilities are in the north
east quarter section and are called out on the plans. The wells will be located south of cell 3 which is about 3 years out
from slurry wall construction. Cell 4 is about 5 % years out.
The minimum mining setback depicted is a 150' radius from each of the wells but the final mine limit will depend on a
surface use agreement between the miner and Noble.

Thanks for getting back to me. Yes, the maps were submitted to the county prior to the SUA. I am working with Eric on
incorporating the pad into the Cell layout and once it is finalized we will need to update the DRMS and USR maps
accordingly. I have attached the current iteration(not final) showing a 30' offset from the edge of your pad to the mine
highwall with a 3:1 mine/reclamation slope, which was determined to be adequate setback in a dewatered cell from the
attached stability analysis report for the site. Let me know if you have any comments or questions.
Since we are within the 30 -day notice limit required by statute, is PDC willing to waive the 30 -day requirement in lieu of
a 26 -day notice so that the Planning Commission hearing on March 7th can move forward?

I have talked to KPK, PDC, Noble and they have all agreed. I am waiting to hear back from Oxy. I was sent an email chain
from the guy at PDC which includes notice that you sent out in November. Did you notify Oxy as well and if you did, does
that plus the DRMS notice not suffice? It is not as if this is the first time these companies are hearing about this project.

Attached is the mine plan that we discussed on the phone. It looks like your wells and surface facilities are in the north
east quarter section and are called out on the plans. The wells will be located south of cell 3 which is about 3 years out
from slurry wall construction. Cell 4 is about 5 1/2 years out.
The minimum mining setback depicted is a 150' radius from each of the wells but the final mine limit will depend on a
surface use agreement between the miner and Noble.

Thanks for getting back to me. Yes, the maps were submitted to the county prior to the SUA. I am working with Eric on
incorporating the pad into the Cell layout and once it is finalized we will need to update the DRMS and USR maps
accordingly. I have attached the current iteration(not final) showing a 30' offset from the edge of your pad to the mine
highwall with a 3:1 mine/reclamation slope, which was determined to be adequate setback in a dewatered cell from the
attached stability analysis report for the site. Let me know if you have any comments or questions.
Since we are within the 30 -day notice limit required by statute, is PDC willing to waive the 30 -day requirement in lieu of
a 26 -day notice so that the Planning Commission hearing on March 7th can move forward?
