Brief description of the problem/issue:
The Greeley fuel site which provides the majority of diesel and unleaded fuel to the county fleet is under
construction. Construction was anticipated to be completed in December 2022 but has been pushed back to
the first week of January 2023 and could possibly be further due to subcontractor issues.
We have established alternatives for fueling in Greeley during construction but are interested in leasing a
temporary diesel fuel tank for Public Works. The fuel tank, stationed at the Public Works facility, would allow
Public Works to fuel their fleet on site to start the day rather than going to one of our alternative stations, and
allow for snow desk operations to function without interruptions. The snow desk operation is 24 hours once
snow starts to fall. Having the tank onsite would assure there are no issues keeping the plows fueled for the
24 -hour operational periods.
The County attorney's office has already reviewed and approved the language in the lease. Hill Petroleum is
the vendor that was awarded the current county fuel bill.
What options exist for the Board? (Include consequences, impacts, costs, etc. of options):
Leasing the temporary fuel tank would ensure there is no disruption to Public Works snow removal operations
and allow Public Works to fuel on site. Not leasing the tank would require Public Works to use the alternative
fueling options we have established, which could cause a disruption in the snow desk operation.
The cost of the tank lease would be $1200 a month.
Recommendation:
We would recommend entering into the agreement with Hill petroleum to have the diesel tank on site through
the end of January 2023.

Senergy Petroleum
Equipment Lease and Indemnification Agreement
This Equipment Lease and indemnification Agreement (hereinafter referred to as the "Agreement") is entered
into this A- day of January , 2023 , by Senergy Petroleum Company, Inc., with its principal place of
business at 6301 W. 58th Ave., Arvada, CO 80002 (hereinafter referred to as "Senergy") and Weld County
(hereinafter referred to as "Customer"). Senergy and Customer are jointly the
parties to the Agreement (hereinafter referred to as the "Parties").
WHEREAS, Customer desires to purchase petroleum products from Senergy and further, Customer desires to
lease from Senergy appropriate equipment to be used in the sale, storage, and distribution of said petroleum products
from a location/facility at

WHEREAS, Senergy desires to lease to Customer the below -described equipment for the purpose of sale, storage, and/or
distribution of petroleum products:

NOW, THEREFORE, in consideration of the mutual covenants agreement and indemnification contained herein, and for
good and valuable consideration, the Parties agree as follows:
It is expressly understood and agreed that the above -describe equipment and all appliances attached
thereto or used in connection therewith (hereinafter referred to as the "Equipment") are and shall at
all times remain the sole property of Senergy. Senergy hereby agrees to lease said Equipment to
Customer subject to the terms of this Agreement as described more fully below.
Customer hereby agrees to keep the Equipment in good order and repair and shall be solely
responsible for all licensing fees, taxes or other charges levied or imposed on or associated with the
installation, existence, use, maintenance, condition, repair, alteration, or removal of said Equipment
during term of this Agreement. Customer is solely responsible for obtaining necessary permits or other
authorizations and for providing legally required notification to any federal, state or local agency
arising out of or related to the installation, existence, use, maintenance, condition, repair, alteration,
or removal of said Equipment. Parts and labor warranty for any supplied equipment is one year from
the date of this agreement. Customer is responsible for any ongoing maintenance costs of operating
the equipment after that date. Service fees will be charged for trip charges and repairs and
maintenance to said equipment. Customer understands that there will be an initial set up and delivery
fee for the loaned equipment. Labor and trip charges will be billed at $200.00 per hour port to port.
Above ground petroleum storage tanks are regulated by the Colorado Division of Labor and
Employment, Division of Oil and Public Safety. Attached are two forms and one letter explaining the
regulation and exemptions. The first form is an above ground petroleum storage tank installation and

upgrade form In order for you to legally install on above ground regulated tank, it is state law that you fill
this out and submit it to the State Oils There is no cost for an installation permit. The second is an above
ground Storage Tank registration form. Each regulated tank must be registered with State Oil The cost td
register a tank is $35 annually These rules apply to every above ground tank that has a total capacity of
between 660 and 39,999 gallons There are specific exemptions to these requirements that have also been
attached. If a tank is exempt, it is not necessary to submit an installation apphcation nor register the tank If
you have questions about whether or not your tank is exempt or regulated, call State Oils at 303-318-8525.
Customer further agrees that it shall place no product into the Equipment other than that which has
been purchased directly from Senergy At no time shall Customer cause or allow, by way of its own
acts or the acts of a third party, products other than those purchased from Senergy to be placed into
said Equipment
Senergy Petroleum or customer may terminate this Agreement at any time with thirty (30) day written
notice Notice, as provided for herein, shall be considered properly given as of the date of mailing or if
sent by customer hereto by certified mail, duly addresses to Senergy Petroleum at the address shown
below
Upon termination of this Agreement by cancellation or otherwise, Senergy shall have the right at any
time after the effective date of said termination to enter Customer's property and remove all or any
part of the Equipment, using such means and for such purpose as hill deems appropriate and suitable
Customer shall not remove the Equipment form the above-escribed location without Senergy's express
written consent
Any equipment owned by Senergy not described above, at whatever time delivered and in whatever
form presented by Senergy tdCustomer, shall be subject to the terms of this Agreement
To the extent allowed`under Colorado law, Customer hereby forever releases, indemnifies and
covenants not to sue and agrees to hold harmless Senergy, and where applicable, Senergy's parent,
subsidiaries, affiliates, shareholders, directors, officers, employees, agents, representatives, successors
and assigns with respect to all federal, state or local law claims or counterclaims, arising out of or
resulting from the installation, existence, use, maintenance, condition, repair, alteration, or removal of
said Equipment by Senergy, its parent, subsidiaries, affiliates, shareholders, directors, officers,
employees, agents, representatives, successors or assigns Said indemnification shall survive
termination of this Agreement
It is Senergy's express recommendation that Customer shall install and utilize secondary containment
apparatus in conjunction with the use of the Equipment in order to prevent environmental
contamination Customer is encouraged to obtain guidance from an accredited installation company or
other engineer regarding the`design for secondary containment Equipment will not be supplied if
regulatory approved secondary containment is not installed (fuel systems)
Other than as set forth herein, no representations have been made, nor any warranties given by
Senergy to Customer concerning the Equipment, neither shall any be implied
None of the terms of this Agreement may be changed, except by a written modification signed by all
Parties This Agreement shall be construed according to the laws of the State of Colorado Any actions

to enforce the terms of this Agreement shall be brought in Weld County District Court. In the event of
any provision of this Agreement shall not be affected and shall remain in force.
This Agreement may be executed in counterparts, all of which together shall constitute one original
Agreement. Electronic signatures are acceptable as part of the original Agreement.

Notices To Customer
Execution of this Agreement shall affect termination of and supersede any previous agreements, other
instruments, or arrangements, whether written or verbal between the Parties hereto or their
predecessors in interest relating to the Equipment above listed or other equipment of whatever kind.
IN WITNESS WHEREOF, an authorized representative of each Party warrants that he/she is duly authorized
to execute this Agreement and to bind the party on whose behalf he/she is acting.

Upon arrival, called James to let him know I was here and proceeding on tank testing. The tank is a
modular tank (trailer mounted), is not in service yet, all plugged up and sealed off. I removed the
gauge that was on the interstice, installed my gauge, pressured tank to 1.25 PSI. Tank held
pressure, test passed. Released pressure, switched gauges back, checked out with James.

o r operator or current property owner did not install, has never operated or leased to another for operation, and had
n o reason to know was present on the site at the time of site acquisition.
(2) (a) "Aboveground storage tank" means any one or a combination of containers, vessels, and enclosures,
including structures and appurtenances connected to them, constructed of nonearthen materials, including but not
limited to concrete, steel, or plastic, which provide structural support, used to contain or dispense fuel products and
the volume of which, including the pipes connected thereto, is ninety percent or more above the surface of the ground.
(b) "Aboveground storage tank" does not include:
(I) A wastewater treatment tank system that is part of a wastewater treatment facility;
(II) Equipment or machinery that contains regulated substances for operational purposes;
(III) (A) Farm and residential tanks or tanks used for horticultural or floricultural operations.
(B) Nothing in sub -subparagraph (A) of this subparagraph (III), as amended by House Bill 05-1180, as enacted at the
first regular session of the sixty-fifth general assembly, shall be construed as changing the property tax classification
o f property owned by a horticultural or floricultural operation.
(Iv) Aboveground storage tanks located at natural gas pipeline facilities that are regulated under state or federal
n atural gas pipeline acts;
(v) Aboveground storage tanks associated with natural gas liquids separation, gathering, and production;
(VI) Aboveground storage tanks associated with crude oil production, storage, and gathering;
(VII) Aboveground storage tanks at transportation -related facilities regulated by the federal department of
transportation;
(vial) Aboveground storage tanks used to store heating oil for consumptive use on the premises where stored;
(Ix) Aboveground storage tanks used to store flammable and combustible liquidsat mining facilities and construction
and earthmoving projects, including gravel pits, quarries, and borrow pits where, in the opinion of the director of
the division of oil and public safety, tight control by the owner or contractor and isolation from other structures
make it unnecessary to meet the requirements of this article;
(X)
Any other aboveground tank excluded by regulation.

Rule —
(b) Per C R S § 8-20 5-101(2)(b), the following ASTs or AST systems are excluded from these AST regulations
(1) Notwithstanding requirements listed in (a)(1) of this section, any AST whose capacity is greater than 39,999
gallons or less than 660 gallons,
(2) Any AST system that contains a de minimis concentration of regulated substances,
(3) Any AST systems containing radioactive material that are regulated under the Atomic Energy Act,
4) Any AST system that is part of an emergency generator system at nuclear power generation facilities,
(5) ASTs used to store liquefied petroleum gases that are not liquid at standard temperature and pressure, 61
(6) ASTs used to store liquids whose fluidity is less than that of 300 penetration asphalt when tested in
accordance with ASTM Standard D5, "Test for Penetration for Bituminous Materials"
(7) A wastewater treatment tank system that is part of a wastewater treatment facility,
(8) Equipment or machinery that contains regulated substances for operational purposes,
(9) Farm and residential ASTs directly used for horticultural or floricultural operations
(10) ASTs located at natural gas pipeline facilities that are regulated under state or federal natural gas pipeline
acts,
(11) ASTs associated with natural gas liquids separation, gathering, and production,
(12) ASTs associated with crude oil production, storage, and gathering,
(13) ASTs at transportation -related facilities regulated by the federal department of transportation,
(14) ASTs used to store heating oil for consumptive use on the premises where stored,
(15) ASTs used to store flammable and combustible' liquids at mining facilities and construction and earthmoving
projects, including gravel pits, quarries, and borrow pits where, in the opinion of the Director, tight control by
the owner or contractor and isolation from other structures make &unnecessary to meet the requirements of
this article and (16) ASTs owned
