Response regarding ZONING PERMIT FOR CERTAIN USES IN AG ZONE (ZPAG) APPLICATION submitted by DPR Greeley, LLC (Dane Roche) Opposition submitted by Barbara M. Flores and Tansi M. Flores, 2045 Cherry Avenue First of all, I question that this zoning application has been incorrectly submitted as a "permit for certain uses in AG ZONE (ZPAG)" as the majority of this property and all surrounding properties are not zoned AG, but are zoned R-1. See attached zoning maps. Why does the "Notice of Inquiry" Municipality with CPA or IGA as the Town of Kersey? Traffic on this section of Cherry Avenue has increased significantly since this lot became occupied and used in a commercial/industrial manner. The increase is mostly pickup trucks, some of which seem to deliberately disrespect the speed limit. As our street has no sidewalks and is used by children walking to and from school, joggers and walkers, families with young children and individuals walking dogs, this creates a very dangerous situation. The small portion of the 2120 Cherry lot is zoned C-1, while all surrounding parcels are zoned R-1. Therefore, it would be reasonable for all of that parcel to revert to R-1 and for any commercial or industrial uses be banned. In item #1 of the PLANNING QUESTIONNAIRE, Roche states: The shop will be used for storage, maintenance and assembly/preparation of flooring and roofing tiles. Equipment for landscaping and snow removal such as plows, aerators and lawn mowers will be stored in the shop. The business owners also hope to use the shop to assemble gutters...a maximum of 10 trucks will be parked outside at any one time. Yet in question #11 he states that the size of any stockpile, storage or waste area is "None proposed." He has already admitted to storage and there are vehicles and at least one large trailer that has not moved since he moved in. The "assembly ...of flooring and roofing tiles" and the use of the shop to "assemble gutters" sounds more like an industrial use. "Opaque fencing" wil not make this blight more acceptable, but will fully block our views to the East. A small segment of this property is zoned C-1, with all immediately surrounding parcels zoned R-1, not commercial or ag. We ask that you not set the precedent of converting this parcel to C-1 and destroying our neighborhood.
