r r RESOLUTION WHEREAS, a public hearing was held on March 25, 1974, in the chambers of the Board of County Commissioners, Weld County, Colorado, for the purpose of hearing the petition of Gordon E. Lacy, Route 1, Box 4, Ault, Colorado, requesting approval to locate a commercial egg production operation on the following described property, to-wit: Beginning at the Southeast Corner of Section 24, Township 8 North, Range 66 West of the 6th P. M. , Weld County, Colorado; thence North along the East line of Section 24, a distance of 2, 250' to a point which is the true point of beginning; thence continuing North along the East line of said line of said Section 24, a distance of 1, 200' to a point; thence West and parallel to the South line of said Section 24, a distance of 1, 980' to a point on the Pierce Ditch Lateral; thence Southwesterly along the Pierce Ditch Lateral a distance of 1, 250' to a point; thence East and parallel to the South line of said Section 24, a distance of 2, 050' to the true point of beginning, containing 60 acres, more or less, and, WHEREAS, the petitioner was present, and WHEREAS, there was no opposition to the request of petitioner for the location of a commercial egg production operation, and WHEREAS, according to Section 3. 3(3) (c) of the Zoning Resolution of Weld County, said request to locate a commercial egg production operation may be authorized upon the approval of the Board of County Commissioners, Weld County, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioner and studied the receommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of Gordon E. Lacy, Route 1, Box 4, Ault, Colorado, to locate a commercial egg production operation on the premises indicated above be, andit hereby is granted under the conditions following: 1. That any water and sanitation facilities to be Installed shall be approved by the State Health Department. 2. That petitioner shall proceed with due diligence to construct said commercial egg production operation and that he shall have up to one year from date hereof to begin construction thereof. 3. " "Class III Soils have severe limitations that reduce the choice of plants , require special conservation practices or both . Planning to put on a home of some type (mobile or modular) , then later on , build a permanent home for one of the family . There was some question as to the exact amount of land that should be used on the S . U . P . application . Mr . Lacy stated that he did not want the entire 171 acres used for the S . U . P . Planning staff recommends approval as it agrees with the Weld Co . Comprehensive Plan in perpetuating the use of agricultural land ; Extension Office states the operation is well -designed and they observe no pollution problems of any kind ; and Town of Pierce has no objections . SUBJECT : Western Hills Fire Protection District Tape 520 DISCUSSION : Mr . Lorenson noted that the application had been sub- mitted before the end of 1973 . There was a change in the law at the beginning of the year which changed procedures that a fire district has to go through . However , our attorney has informed us that the application is acceptable under the old law . Their plan of operation , however , does not comply with the State requirements under Section 89 , and it was our job ( Planning Commission ) to take each and every item stated qnder the law and give it serious con- sideration . It was recommended to table any action until the full information satisfying the State Law has been presented . MOTION : By Mr. Elliott , To table this application with the notation that this is a petition that 'will be allowed under the old law . Seconded by Mr . Anderson . Our records do not contain the detail we had hoped for. However, they do give a fairly accurate picture of the original design and pumping capability. The well, located in the SE4 of the SE4 of Section 24, Township 8 North, Range 66 West, was originally drilled in 1943 to a maximum depth of 400 feet with a bailed pumping capacity of 16 gallons per minute from 310 feet. The maximum yield and other important data are missing from our records.
