The Colorado Liquor Enforcement Division recently announced the automatic conversion of Fermented Malt Beverage Off -Premises (County) Licenses to Fermented Malt Beverage and Wine Off -Premises (County) Licenses. If the licensed premises remains the same, other than adding vinous products to these licensed premises on shelves and in coolers that are already designated for alcohol products, no modifications of premises are needed. If the licensed premises is going to be physically changed or materially or substantially altered, as per rule 47-302, then a modification of premises and fees shall be filed with both the local and state licensing authorities for approval or denial. Temporary displays do not materially or substantially alter the licensed premises, therefore, do not need prior approval. Temporary displays could be end caps for a short period of time or temporary displays within the licensed premises for a minimal period of time. Please remember these temporary displays should not be placed in candy or soda isles or near licensed premises entries and exits to prevent minor access to alcohol products. If your establishment needs to file a modification of premises to accommodate new shelves or coolers designated for the alcohol products, please contact me and I will assist you further. First, in discussions held at the Southwest Weld County Administrative Office Building on August 8, 2002, staff stated that a change to the existing plextglass sign face would not be considered a substantial change to the existing Site Plan Review 241, however, any other change may constitute a subster ;t:el change and require a new Site Plan Re'alew Plat appfcation. A facsimile from the Young Electric Sign Company was received concerning a proposed modification to one of the existing dual pole Identification signs on site. This modification proposes to enlarge the present sign to approxiMately 240 square feet of face, approximately 70 square feet larger than what pa presently on site, per information relayed to std. Staff reviewed the proposal for compliance with the Weld County Code, Chapter 23 (Zoning) and Chapter 26 (Mixed Use ntioprnent). Chapter 28 takes precedence, as the facility is within the boundary of the Mixed Use Development area. Section 26-2-90 addresses Sign District Regulations. Specific to the proposal, staff reviewed three sections of the Code for conformance. Section 2E42e . D.2. a addresses Attached Signs: Size, Height and Design Limitations. This Section states: a. Awning signs shall not be larger than twenty+frve (25) square feet nor ten percent (10%) of the awning surface area, whichever is smaller, b. Marquee, canopy, overhead canopy, under -canopy, projecting or well signs: 1 Minimum height requirements: These signs shall be mounted at least fourteen (14) feet above any driveway and at least nine (9) feet above any walkway over which they are erected. 2) Maximum height requirements. The top line of these signs shall not be higher than the top of the wall, roof eaves or parapet line of the building to which it is attached It is staff's interpretation that the square foot area of sign face located on the overhead awning and the perimeter of the commercial sales facility exceeds this requirement specific to Section 26-2-90.2.2 as outlined. Section 26-2-90.D.3 addresses Detached Signs. This Section states: c On -site identification signs shall have a m i nom um setback of fifteen (15) feet and a minimum offset of ten (10) feet from the road right-of-way. d Detached signs shall have surrounding landscaping which extends a minimum of three (3) feet from alt sides of the sign base. e The total height of any monument or pole sign shall not exceed twenty-five (25) feet above the adjoining ground elevation. From the information provided, the proposed sign appears to conform to these standards. Section 26-2-90.0.4 defines Development Complex Signs: Definition, Size and Design Limitations. This Section states: a A development complex sign is a detached sign on the premises of the development which primarily identifies or directs attention to the name. symbol or location of the development complex. A development complex is a group of freestanding buildings or buildings constructed in such a way as to give an appearance of being interrelated due to architectural similarity, interconnected drives, parking areas and/or platting of the development. c -...The total height of the sign shah not exceed twenty-five (25) feet above the adjoining ground elevation. The total sign area shall not exceed one hundred fifty { 150) square feet... F From the information provided, including the attached sketch, staff concludes that the proposed sign modification exceeds the requirements of Section 26- 2- 90. D.4 . c of the Weld County Code_ Given staffs interpretation of the Code, the proposed modification proposal to enlarge the present sign to approximately 240 square feet of face. approximately 70 square feet larger than what is presently on site is not supported by the Department of Planning Services. Young Electric Sign Company does have recourse, you are afforded the due process to appeal this decision to the Weld County Board of Adjustment riling under an appeal of variance to the Weld County Code, Section 23-6.40. (The legal description is Lot 1 Star Center Minor Sub; Part of Section 10, T2 N, R6BW of the 6th P.M.; Situs Address is 10963 1-25 Access Road West) Background Information: The site is currently permitted under PR -241 for truck stop and convenience store. The applicants are proposing to install a 6000 gallon DEF (Diesel Exhaust Fluid) Underground Storage Tank and Dispensing System. Electrical will be run from the building to this underground storage tank. Stainless steel piping will be used. No expansion to the islands will take place; however the dispensers will be replaced to include the OFF dispenser. Staff stated that this project doesn't appear to require an amendment to PR -241 since there is no expansion and the operation remains the same. B i rI i nc.likmartn�, Commercial Building and Electrical permits will be required for any new construction or addition to any building on the property per Section 29-3-10 of the Weld County Code. Two (2) plot plans showing locations and distances from building to property lines and other structures will be required. Additionally, Manufacturers Specs for the Tanks and Installation requirements on Tanks and Dispensers will also be required. Two (2) sets of electrical plans showing one -line, panels, grounding, motors, hazardous locations, wire sizes, amps/loads and over -current protection, as applicable. A Fire District Notification letter shall be submitted to the Fire District with jurisdiction for review and comments and submitted with Commercial Permit application to Weld County.
