The property will have several uses pertaining to the rescue. We will continue practicing Trap -Neuter -Return of feral cats that live in the subdivision and surrounding area. The cats overnight in traps, before and after surgery, in the property owner's studio. They are then transported to a clinic for surgery. After recovery they are returned home, (properties where they were trapped). We occasionally have a feral cat needing medical attention or dental, that needs to stay confined until after treatment, before returning home. Kittens may be held here or other foster homes until they have been spayed / neutered. Then they are turned over to other rescues for adoption. Time constraints limit our trappings to usually once a month, with 4-8 cats being the usual number. Sometimes, but rarely we have larger trappings. Occasionally we house a tame dumped or abandoned cat until he can be turned over to our adoption partners. Older community / feral cats that live on the property will stay as this is their home. It includes a cat enclosure, consisting of 2 8x12' sheds and a 24 x 30 utility shed. Front -Porch Felines will continue to provide for these cats. The property also has a 8 x 12 shed used to store traps and other supplies for the rescue. This property is a primarily a residence and art studio. The cat rescue is a secondary use of the property owner. What the property will not be used for. We are not a shelter. We do not accept cats or kittens from the public. We do not board cats. We do not breed cats. We do not sell or adopt out cats, except on rare occasions due to behavioral issues. We do not perform the spay/neuter surgeries here. 2 Explain the need for proposed use Our subdivision is filled with feral or what some folks call barn cats. It is the mission of FPF to make a better life for these cats and the residents who shelter them. Our mission is to have them spayed or neutered and vaccinated, ending the cycle of constant reproduction and illness. We receive grants and donations to pay for sterilizing the cats. We have a waitlist of residents who appreciate their feral cats, but don't want more. We are committed to socializing feral kittens, so they can have a better life. We also rescue cats that have been dumped in the subdivision. Dumped tame cats are spayed or neutered, then turned over to other rescues for adoption. 3 Describe the current and previous use of the land The property is a residence, consisting of a house and an art studio and several outbuildings. This property has been used to overnight trapped feral cats for 8 years when the need presented itself. The above proposed use in #1 describes how the property has been used (concerning cats) even before the rescue was formed. The art studio is used by the property owner to earn a living, with only occasional use by the rescue to overnight trapped feral cats. The house and garage and shed have normal, residential use, except for the occasional housing of kittens in a spare room. 4 Describe the proximity of the proposed use to residences The property is 1 acre. It is bordered on two sides by Henry and Caroline Streets. It also borders two other residences. One residence on the north property line has 2 pastures areas that border most of the rescue property, with a home at the front of the property next to the road. These two properties are separated by a 6 ft. wood privacy fence. The home of the adjacent property to the east is approximately 150 ft from the cat enclosure and is separated by 3 fences. Two being privacy fences. The whole property is fenced. 5 Describe the surrounding land uses of the sites and how the proposed use is compatible. The surrounding sites contain 1 acre residences, several containing home -based businesses. Most residences have assortments of horses, sheep, dogs, cats, chickens and feral cats. The proposed use for the rescue would be compatible with surrounding properties, since most cats would be indoors or stay on the fenced property. The subdivision contains many feral cats as well as at least 4 of the surrounding properties. 6 Describe the hours and days of operation. The rescue is not open to the public. There are no hours of operation. 7 Describe the number of employees, contractors, etc. There are no employees of the rescue. The property owner is the sole, unpaid caretaker. 8 Describe the maximum number of users, patrons, visitors that the site will accommodate at any 1 time. The rescue is not open to the public. Sometimes 1 or 2 volunteers come to help socialize kittens or clean and maintain the cat areas. There is a volunteer that drives cats to spay/neuter. 9 List the types and maximum numbers of animals to be on site at any given time. Cats are the only animal. The site will house up to 8 household cats, belonging to the property owner. Up to 20 cats may be held temporarily in traps in the studio waiting spay/neuter. Up to 15 feral cats outdoors sheltered in the cat enclosure or work shed. The cats ages will vary. 10 List the types and numbers of operating and processing equipment. There is none, doesn't apply. 11 List the types, number and uses of the existing and proposed structures. 1 residence/ used by property owner and household pets. 1 garage for cars. 1 art studio/ used for work by property owner and also for monthly trappings and housing of cats that may need extra medical care. 1 small storage shed, used to store traps and supplies for rescue. 1 older horse barn used for lawn equipment and also for shelter of outdoor cats. 1 cat enclosure consisting of 2 small sheds and wire framing between for shelter of the outdoor cats on site. No new structures will be added. 12 Describe the size of any stockpile, storage or waste area. 1 8 X 12 storage shed for rescue supplies. 13. Describe the method and time schedule of removal or disposal of debris, junk and other wastes associated with the proposed use. This does not apply to the site, there will be no debris. 14. Include a timetable showing the periods of time required for the construction of the operation. The rescue will not have any further construction. 15. Describe the proposed and existing lot surface type and the square footage of each type (i.e. asphalt, gravel, landscaping, dirt, grass, buildings). The current roof area which includes a residence, garage, horse shed, 3 small utility sheds and an art studio cover 3500 sf. There is an asphalt drive that covers 2430 sf. Inside wire cat enclosure is sandy 288 sf, no roof. Remaining 37,300 sf is in grasses. Some lawn, others native grass. 16. How many parking spaces are proposed? How many handicap -accessible parking spaces are proposed? No additional parking spaces are planned, the site is not open to the public and rarely has even volunteers, never more than 2, which is easily accommodated by the driveway. 17. Describe the existing and proposed fencing and screening for the site including all parking and outdoor storage areas. No additional fencing will be added. There is a 4 ft wire and post farm type fence with 3 gates, bordering Henry and Caroline Ave. The fence between the site and property to the north is a 6 ft wooden privacy fence, The fence between the property to the east is 6 ft white vinyl privacy fence. 18. Describe the existing and proposed landscaping for the site. No new landscaping is proposed for the site. Currently, there are 2 maintained lawn areas, front and back. A garden area, lots of large trees, lots of shrubs and flower areas on drip irrigation. The areas that have not been landscaped remain in tall grasses. There are also flagstone walkways that run throughout the residence area. 19. Describe reclamation procedures to be employed as stages of the operation are phased out or upon cessation of the Use by Special Review activity. No reclamation will be needed. 20. Describe the proposed fire protection measures. We are in the Ft. Lupton fire protection district with a fire hydrant on the corner of Caroline and Henry. There are also extinguishers in the house and art studio. Smoke detectors in residence. 21. Explain how this proposal is consistent with the Weld County Comprehensive Plan per Chapter 22 of the Weld County Code. Sec. 22-2-10. - Guiding Principles. A. Respecting agricultural heritage. This cat rescue will not infringe on agricultural land use in any way. In fact, we support our farmers and are always happy to help them manage their own barn cat population. B. Respecting private property rights. The cat rescue is located on a private property 1 acre residence and should have no impact on neighboring properties. The area is completely fenced. Most adjacent property owners have signed letters of support. (include) C Promoting economic growth and stability. We realize there is not a lot about a cat rescue that promotes economic growth, other than the fact we pay for residents spay/ neuter and vaccinating of their feral cat populations. This can also ease the burden on Weld County Humane Society. We also provide cat food to some low-income residents. D Protecting health, safety and general welfare. By our spay, neuter and vaccine programs, we help eliminate the threat of rabies in cat colonies. As far as welfare, we offer many residents peace of mind, concerning their feral cat issues. They all want to keep their cats, what stresses them out is continued reproduction. 22. Explain how this proposal is consistent with the intent of the zone district in which it is located. (Intent statements can be found at the beginning of each zone district section in Article III of Chapter 23 of the Weld County Code.) The proposed use is a cat rescue/kennel which is allowed by special review in the Agricultural Zone District as written in 23-3-40. H. The nature of a feral cat rescue, that includes sheltering of animals in existing structures and fenced areas is consistent with the intent of the Agricultural Zone District. Maintaining and caring for the feral / barn cat population of Weld County promotes health, safety, welfare, and peace of mind of residents and the cats! 23. Explain how this proposal will be compatible with future development of the surrounding area or adopted master plans of affected municipalities. The area is completed surrounded by 1 acre home sites. No further development is planned for this area. It is currently compatible, and we are not anticipating that to change as the rescue is contained to a 1 -acre residence. 24. Explain how this proposal impacts the protection of the health, safety and welfare of the inhabitants of the neighborhood and the County. Our principal function is the trap- neuter- return -vaccinate of residents' feral cat colonies on their properties. We are a cat rescue, so the main impact on residents is peace of mind. Many residents state, they like their feral cats on the property, they just don't want more. Especially kittens. By spaying and neutering and vaccinating these cats, there will be less cats over time. The cats are also vaccinated against rabies. Less cat fights, less sick kittens. This proposal impacts the cat population as well as residents. 25. Describe any irrigation features. If the proposed use is to be located in the A (Agricultural) Zone District, explain your efforts to conserve prime agricultural land in the locational decision for the proposed use. This site is a residence and will remain a residence. The only irrigation features have no relation to the rescue. There is a sprinkler system for lawns and drip irrigation for garden and flower beds. No extra irrigation is needed for cats. 26. Explain how this proposal complies with Article V and Article XI of Chapter 23 if the proposal is located within any Overlay Zoning District (Airport, Geologic Hazard, or Historic Townsites Overlay Districts) or a Special Flood Hazard Area identified by maps officially adopted by the County. This does not apply to this site. 27. Detail known State or Federal permits required for your proposed use(s) and the status of each permit. Provide a copy of any application or permit. No additional permits are needed due to the nature of this rescue. We do not board, sell, adopt out feral cats. USE BY SPECIAL REVIEW (USR) DEVELOPMENT REVIEW QUESTIONNAIRE 1. Describe the access location and applicable use types (i.e., agricultural, residential, commercial/industrial, and/or oil and gas) of all existing and proposed accesses to the parcel. Include the approximate distance each access is (or will be if proposed) from an intersecting county road. State that no existing access is present or that no new access is proposed, if applicable. The existing access is residential. There is one driveway access to the property on Henry Street. No new access is planned as we are not open to the public. The distance from driveway entrance to CR 18 is approximately 1900 ft. 2. Describe any anticipated change(s) to an existing access, if applicable. No changes to existing access will be made. 3. Describe in detail any existing or proposed access gate including its location. There is a 10 ft gate at the main driveway, a walk-through gate north of driveway for the propane tank. There is also a 10 ft gate on Caroline, but no access to entrance to home. 4. Describe the location of all existing accesses on adjacent parcels and on parcels located on the opposite side of the road. Include the approximate distance each access is from an intersecting county road. Access to property due west is on Caroline Ave. For property due east is on Caroline Ave. Directly across the street also exits to Caroline Ave. Property directly to the north exits on Henry St. All properties are approximately 2100 ft from CR 18. 5. Describe any difficulties seeing oncoming traffic from an existing access and any anticipated difficulties seeing oncoming traffic from a proposed access. There is no problem seeing oncoming traffic. 6. Describe any horizontal curve (using terms like mild curve, sharp curve, reverse curve, etc.) in the vicinity of an existing or proposed access. There are no curves anywhere around access. 7. Describe the topography (using terms like flat, slight hills, steep hills, etc.) of the road in the vicinity of an existing or proposed access. Discuss the existing and proposed sewage disposal system. What type of sewage disposal system is on the property? If utilizing an existing on -site wastewater treatment system, provide the on -site wastewater treatment permit number. Please see attached septic permit # SP -0701103 3. If storage or warehousing is proposed, what type of items will be stored? The only rescue storage on site is a small shed holding our cat traps and supplies 4. Describe where and how storage and/or stockpile of wastes, chemicals, and/or petroleum will occur on this site. This site will have none of the above. 5. If there will be fuel storage on site, indicate the gallons and the secondary containment. State the number of tanks and gallons per tank. There is a 500 gal propane tank for heating the residence. 6. If there will be washing of vehicles or equipment on site, indicate how the wash water will be contained. There is occasional hosing down of cat traps in drive. No containment, just water, nothing toxic. 7. If there will be floor drains, indicate how the fluids will be contained. This does not pertain to the site. 8. Indicate if there will be any air emissions (e.g. painting, oil storage, etc.). No emissions will come from this site. 9. Provide a design and operations plan if applicable (e.g. composting, landfills, etc.). Not applicable to the site. 10. Provide a nuisance management plan if applicable (e.g. dairies, feedlots, etc.). The site will not need nuisance management. 11. Additional information may be requested depending on type of land use requested. DRAINAGE NARRATIVE / BRENDA HART A Drainage Narrative is required with the application answering the following questions. A. Any existing and proposed improvements to the property. There will be no improvements or changes made to the property. B. The exception being requested for consideration. #10 Parcels with total area less than, or equal to, one (1.0) gross acre. C. Where the water originates if it flows onto the property from an off -site source. No water flows onto the property from elsewhere. D. Where the water flows as it leaves the property. In a heavy rain, the water flows down the driveway and onto Henry St E The direction of flow across the property. The flow for the most part is east to west. The property sits on a small incline. F Previous drainage problems with the property, if any. There have been no drainage issues with this property. G The location of any irrigation facilities adjacent to or near the property. No irrigation facilities are near or adjacent to the property. H Any additional information pertinent to the development. No other info concerning drainage. Traffic Narrative: 1. Describe how many roundtrips/day are expected for each vehicle type: This site will not be open to the public. There is usually 1 round trip daily by passenger car by the property owner and deliveries twice weekly by Fed -Ex or other delivery service. Occasional trips by volunteers to pick up cats for clinic. 2. Describe the expected travel routes or haul routes for site traffic. There is no hauling done. Most traffic comes down Henry or Caroline Ave. after entering on CR 18 or 16. 3. Describe the travel distribution along the routes (e.g. 50% of traffic will come from the north, 20% from the south, 30% from the east, etc.). Most traffic comes from the south, probably 80%, with 20% coming from the north. 4. Describe the time of day that you expect the highest traffic volumes. There will never be a high traffic volume. It is not open to the public. Most days there will be no traffic, other than the property owner. We have lived in Aristocrat Acres for almost 23 years. When we moved there, properties, including ours, were literally overrun with domestic and feral cats, including unfortunately, many litters of kittens. The area seemed to be a dumping ground for unwanted felines and the issue was out of control. We took care of as many cats as was possible (at one point having 13!), first getting them spayed, neutered, and vaccinated and successfully adopting out many of them.- But we both worked extremely long hours, had very limited resources, and seemed to have little impact on the problem. We were thrilled to find out about the formation of Front Porch Felines Trap/Neuter/Release (TNR) program eight years ago. Brenda Hart's non-profit has had an immense and positive impact on the area. Her stets include processing over 500 cats through her TNR program, as well as rescuing over 300 kittens. Considering that a female cat can produce five litters or up to 150 kittens a year, that is an ENORMOUS reduction in the potential number of domestic and feral cats roaming Aristocrat Acres. Although unwanted cats continue to be dumped or abandoned in the area, the number of homeless felines has been reduced to a trickle compared to what it was 23 years ago. The TNR program is a far more humane method of dealing with the issue than shooting or poisoning cats, both of which we have witnessed. Living near Ms. Hart's property, we can verify that it is and has been maintained in a clean and neat manner and have no reason to think that state of affairs will not continue. To be clear, we've had no formal association with Front Porch Felines and are not affiliated with Brenda Hart in any fashion. But we feel it is critically important to approved of and encourage anyone who steps up to address a long- standing problem and provide a workable solution.
