WHEREAS, pursuant to law, the Board of County Commissioners,
Weld County, Colorado, is vested with the responsibility of admin-
istering the affairs of Weld County, Colorado , and
WHEREAS, Weld County, Colorado, is the owner of voting machines
which are now used in nearly all of its voting precincts throughout
the County, and
WHEREAS , different, cheaper and more versatile voting machines
are presently being used in certain voting precincts in the County,
and
WHEREAS, the Board of County Commissioners, Weld County, Colo-
rado, has determined that it would be in the best interests of Weld
County to purchase the newer, cheaper, and more versatile type of
voting machines for use throughout the whole County; and that the
old voting machines be sold pursuant to law, and
WHEREAS, DIAMOND INTERNATIONAL CORPORATION has submitted a
purchase agreement accompanied with Exhibit A attached thereto, all
of which is attached hereto and incorporated herein by reference,
whereby the County, as customer, is desirous of purchasing from
DIAMOND INTERNATIONAL CORPORATION as supplier, the necessary voting
machines including all accompanying materials, supplies , and services
as contained within the aforementioned agreement, and
WHEREAS , after careful review and consideration of the Agreement,
the Board believes it to be in the best interest of the County to
accept the same.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County Com-
missioners, Weld County, Colorado, that the aforementioned Purchase
Agreement as submitted by DIAMOND INTERNATIONAL CORPORATION, be, and
the same is hereby approved and accepted for signature by the Board.
BE IT FURTHER RESOLVED, by the Board that Mr. Barton Buss, Chief
Accounting Officer and Purchasing Agent for Weld County, advertise the
sale of the aforementioned old voting machines pursuant to the appro-
priate statutes governing such sales; and that the monies received from
such sale be used to pay for the new voting machines , materials , and
equipment; and that any balance left over from such sale shall be de-
posited in the County General Fund.
The above and foregoing Resolution was , on motion duly made and
seconded, adopted by the following vote on the 24th day of December,
A.D. , 1974.

AGREEMENT made the 4th day of December, 1974, by and between
DIAMOND INTERNATIONAL CORPORATION ("Supplier") , and THE COUNTY
OF WELD ("Customer") .
RECITALS
1. Customer is desirous of having Supplier furnish
election materials and supplies, voting equipment and support-
ive services for the County of Weld.
2. Supplier is desirous of furnishing such materials,
voting equipment and supportive services, in accordance with the
terms and conditions set forth herein.
AGREEMENT
FOR AND IN CONSIDERATION OF the price and the mutual
covenants contained herein, the parties hereto agree as follows:
1. Supplier hereby agrees to furnish election mat-
erials and supplies, voting equipment and supportive services
in accordance with the schedule of items, prices and estimated
dates of delivery for performance as described in Exhibit A
attached hereto.
2. Supplier warrants that all election materials
and supplies furnished under this Agreement will be in accor-
dance with the laws, rules and regulations applicable to Colo-
rado election law.
3. Supplier warrants that all voting equipment fur-
nished under this Agreement has been approved by the State of
Colorado Commission on Voting Machines and Vote Tabulating De-
vices.
4. Customer agrees to pay for all election materials
and supplies, voting equipment and supportive services, schedules
on Exhibit A, thirty (30) days from the date of Supplier's invoice,
or under such other terms as may be agreed in writing by the
parties.
IN WITNESS WHEREOF, the parties hereto have executed
this Agreement on the date set forth above.
