HomeMy WebLinkAbout20253166 Draft Resolution Action of the Board at Probable Cause Hearing, PCSC25-0012, Concerning Use by Special Review Permit, USR15-0042, for Mineral Resource Development Facilities, Oil and Gas Support and Service (office/shop and storage of vehicles and equipment) in the A (Agricultural) Zone District — Peitz Land Investments, LLC Whereas, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and Whereas, on the 19th day of November, 2025, a Probable Cause Hearing was held before the Board to consider setting a Show Cause Hearing to determine whether or not Peitz Land Investments, LLC, 22911 County Road 39, LaSalle, Colorado 80645, was in compliance with certain Development Standards contained in Use by Special Review Permit, USR15-0042, for Mineral Resource Development Facilities, Oil and Gas Support and Service (office/shop and storage of vehicles and equipment) in the A (Agricultural) Zone District, and Whereas, the alleged violations were said to be occurring on property being further described as follows: Lot B of Recorded Exemption, RECX15-0112; being part of the E1/2 SE1/4 of Section 33, Township 3 North, Range 66 West of the 6th P.M., Weld County, Colorado Whereas, at said hearing, the applicant was present/represented by [Representative], [Representative Address], and Whereas, after hearing testimony from the Department of Planning Services, the Board finds that, pursuant to the procedure as set forth in Chapter 2 Administration of the Weld County Code, there is sufficient probable cause to schedule a Show Cause Hearing to consider whether or not said Use by Special Review Permit should be revoked for failure to comply with certain Development Standards. Now, therefore, be it resolved by the Board of County Commissioners of Weld County, Colorado, that a Show Cause Hearing be scheduled to determine whether or not Use by Special Review Permit, USR15-0042, issued to Peitz Land Investments, LLC, should be revoked. Be it further resolved by the Board that the date for the Show Cause Hearing shall be December 10, 2025, at or about 9:00 a.m., in the Assembly Room of the Weld County Administration Building, 1150 0 Street, Greeley, Colorado 80631. Be it further resolved by the Board that the issue to be considered at said Show Cause Hearing is whether or not the permit holder is in compliance with the following Development Standards: 2025-3166 PL2375 Probable Cause Hearing, PCSC25-0012, Concerning Use by Special Review Permit, USR15-0042 — Peitz Land Investments, LLC Page 2 - Draft 6) The fencing and lighting on the site shall be maintained. 7) Should noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15, Articles I and II, of the Weld County Code. 26) The property owner or operator shall be responsible for complying with the Design Standards of Chapter 23 of the Weld County Code. 28) The Use by Special Review area shall be limited to the plans shown hereon and governed by the foregoing standards and all applicable Weld County regulations. Substantial changes from the plans or Development Standards, as shown or stated, shall require the approval of an amendment of the Permit by the Weld County Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 29) The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Noncompliance with any of the foregoing Development Standards may be reason for revocation of the Permit by the Board of County Commissioners. Notification of hearing letter sent. No contact from the property owner. Notification of hearing letter emailed to the property owner. Use by Special Review USR15-0042 The current USR on the site: USR15-0042 is approved for, "A Site Specific Development Plan and Use by Special Review Permit for Mineral Resource Development Facilities, Oil and Gas Support and Service, (office/shop and storage of vehicles and equipment) in the A (Agricultural) Zone District." This USR15-0042 PCSC25-0012 — Pietz Land Investments, LLC Page 1 of 2 was approved by the Board of County Commissioners on November 4, 2015, and recorded on July 29, 2016, reception # 4223242. Summary: USR15-0042 was approved in 2015 for an office and/or a shop and storage of vehicles and equipment. The USR map shows the extent of the storage yard, set back from the road with no requirements for fencing. The buildings shown on the map were not built. In the past 2 years the site has undergone expansion without submitting or receiving an amendment to the land use permit. Despite three documented attempts to contact the property owner, there has been no response to date. Additionally, there is evidence suggesting that the site may currently be leased and used for storage purposes within a designated water quality area. Staff recommendation: The role of the Board of County Commissioner in this Probable Cause hearing is to review the property, for compliance with the terms of the USR, to determine if probable cause exists to hold a hearing on revocation of the USR permit. If it is determined at the Probable Cause hearing that there is probable cause that the property is not in compliance with the USR, the Board of County Commissioners will schedule a Show Cause hearing to consider revocation of the Permit. Per Section 2-4-40.C of the Weld County Code: "Probable cause is defined as a reasonable ground for belief in the existence of evidence supporting the allegations of violations of the Weld County Code." Per Section 2-4-40.D of the Weld County Code: "At the conclusion of the presentation of evidence, the Board of County Commissioners shall make an oral decision. The decision shall be to either dismiss the case, continue the case to a time specified in the future or to set the case for a formal show -cause or other type hearing at a time specified in the future." Department of Planning Services staff believes that probable cause has be found in this situation, that the property is not compliant with the approved USR. Therefore, Department of Planning Services recommends that a formal Show Cause hearing be scheduled to consider revocation of the USR, should compliance not be reached by the date of the Show Cause hearing. Planning staff recommends scheduling the Show Cause hearing on December 10, 2025.
