MEMORANDUM TO: Matthew VanEyll, Planning Services �861 r4� .� FROM: Mike McRoberts, P.E., Development Review 1 0 r ri-7, DATE: August 22, 2025 L G u SUBJECT: COZ25-0008 12524 Weld County Realty 1 LLC The proposal has been reviewed by Development Review on behalf of the Weld County Department of Public Works and the Department of Planning and Zoning. Staff comments made during this phase of the application process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS GENERAL PROJECT INFORMATION/LOCATION Project description: Change of Zone from the A(Agricultural)Zone District to the I-1 (Light Industrial)Zone District. This project is south of County Road 28 and is east of and adjacent to County Road 25 '/2. Parcel number: 121131100051. Access is from County Road 25 '/2. ACCESS Development Review has reviewed the application materials related to access and determined that the subject parcel has one (1) existing, unpermitted, residential and commercial access onto County Road 25 '/ located approximately 2,370 feet south of County Road 28. The site also has one (1) existing, gated access onto US Highway 85 located at milepost 249.76. Per CDOT's referral, this access shall be closed and reclaimed with the associated site plan review land use case. ROADS AND RIGHTS-OF-WAY County Road 25 '/2 is a gravel road and is designated on the Weld County Functional Classification Map (Code Ordinance 2017-01)as a local road, which requires 60 feet of right-of-way. Pursuant to the definition of setback in the Weld County Code, Section 23-1- 90, the required setback is measured from the future right-of-way line. Be aware that physical roadways may not be centered in the right-of-way. This road is maintained by Weld County. The applicant has provided satisfactory documentation demonstrating County Road 25 '/2 meets the physical road requirements specified in Section 23-2-40.B.4., of the Weld County Code. No further roadway information is needed. CONDITIONS OF APPROVAL The plat shall be amended to delineate the following: A. County Road 25 '/2 is a gravel road and is designated on the Weld County Functional Classification Map as an local road which requires 60 feet of right-of-way. The applicant shall delineate and label the existing right-of-way (along with its creating documents) and the physical location of the road. All setbacks shall be measured from the edge of right-of-way. This road is maintained by Weld County. (Development Review) B. Delineate and label the US Highway 85 right-of-way, the physical location of the road, and the existing gated access located at mile marker 249.76. Label the access, "TO BE CLOSED AND RECLAIMED". (Development Review) DEVELOPMENT STANDARDS (NOTES ON THE PLAT) A. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant to Chapter 15, Article I and II, of the Weld County Code. (Development Review) B. The access to the site shall be maintained to mitigate any impacts to the public road, including damages and/or off-site tracking. (Development Review) C. There shall be no parking or staging of vehicles on public roads or within public rights-of-way. On-site parking shall be utilized. (Development Review) D. The historical flow patterns and runoff amounts will be maintained on the site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to runoff rate and velocity increases, diversions, concentration and/or unplanned ponding of stormwater runoff. WE - 26 - 0005 Dear Matthew : At your request ( July 23 , 2025 ) , the Colorado Geological Survey has reviewed the COZ25 - 0008 referral . I understand the applicant proposes a change of zone from A ( Agricultural ) to I - 1 ( Light Industrial ) to accommodate a trailer sales and service operation on approximately 3 . 25 acres platted as Lot A , Recorded Exemption No . 1211 - 31 - 1 - RE2235 . The site does not contain , nor is it exposed to , any known geologic conditions that would preclude the proposed zone change and use . Mineral resource potential . The applicant ' s consultant , Substrata LLC ( Geology Report , Proposed Jayhawk Trailers Facility - Parcel # 121131100051 , Part of the Northeast 'A of Section 31 , T3N , R66W of the 6th P . M . , 12524 County Road 251/2 , Weld County ( Fort Lupton ) , Colorado , Substrata Project # 25 - 1051 , February 26 , 2025 ) is correct that the USDA Natural Resource Conservation Service ( NRCS ) rates the site soils as a poor source of gravel and a fair source of sand . NRCS soil survey data is valid for only the uppermost 5 - 6 feet below the ground surface . According to the Atlas of Sand , Gravel , and Quarry Aggregate Resources , Colorado Front Range Counties ( Schwochow et al , Colorado Geological Survey Special Publications 5 - A , Plate 1 , and 5 - B , Platteville Quadrangle , 1974 ) , the subject property is within a mapped " T3 " resource area . T3 is described as stream terrace deposits , potentially containing a fine aggregate resource consisting of " Sands : includes sands ranging from coarse gravelly stream sands to fine - grained wind - deposited dune sands . " A determination regarding whether the property contains an economic mineral resource is outside the scope of CGS review . A site - specific investigation , lab testing , and market analysis would be required to verify the presence or absence of an economically viable mineral resource . However , even if a resource were determined to be present , the site ' s small size likely precludes economic extraction . Additionally , the proposed zone change does not necessarily preclude future extraction if a mineral resource is determined to be present . CDOT will have comments in the planning phase including but not limited to: • Per State Highway Access Code there can be no direct access to highway category E-X. The gated access at milepost 249.76 must be closed. CDOT standards for access closure include removal of pavement and re-seeding (which is the visual queue to the maintenance team for that area to see that it is no longer in use).
