Describe the purpose of the proposed Change of Zone . 12524 Weld County Road Realty 1 LLC and 12524 Weld County Road Realty 2 LLC ( d /b / a Jayhawk Trailers ) are requesting a COZ from the Agricultural ( A ) Zone District to the Light Industrial ( I - 1 ) Zone District to allow for their proposed operations . Jayhawk Trailers ' proposed use is trailer sales and service , which is a permitted SPR use in the I - 1 Zone District . 2 . Describe the current and previous use of the land . The approximately 3 . 25 - acre subject property is described as Lot A RE - 2235 , located in Part of the Northeast Quarter of Section 31 , Township 3 North , Range 66 West of the 6th P . M . , Weld County , Colorado . The site has an existing Use by Special Review ( USR) permit , case no . USR - 1385 , for slide in truck camper sales , indoor storage of slide in track camper parts , embroidery / sewing of slide in truck camper cushions , hats and jackets , and sales of hats and jackets . Proposed use of the property is trailer sales , parts sales , trailer service /repair , truck upfitting , propane sales , outdoor display , and an indoor showroom . There will also be an associated office / administrative component in the existing shop building . 3 . Describe the proximity of the proposed use to residences . There is a residence approximately 1 , 300 feet northwest , and a residence approximately 1 , 800 feet north of the site . 4 . Explain how the proposed rezoning will correct what the applicant perceives as faulty zoning , or how the proposed rezoning will fit with what the applicant perceives as the changing conditions in the area . The property is currently in the A Zone District , which no longer accommodates the proposed operations due to recent code changes . Rather than completing a minor amendment to USR - 1385 , this COZ and the concurrent SPR are required to change the use of the property from camper sales to trailer sales . The property is situated in a strip of businesses along Highway 85 . Directly north of the site is an oil and gas support and service facility for the storage and repair of oil field equipment and the storage and distribution of drilling fluid products , case no . 1MUSR17 - 06 - 1542 . Further north is an oil and gas support and service facility for storage and repair of downhole oil field tools , case nos . USR- 1216AM and subsequently SPR- 435 . Irrigated agricultural fields are to the west and south of the subject property . 6 . Does the soil report indicate the existence of moderate or severe soil limitations ? If so , detail the methods to be employed to mitigate the limitations for the uses proposed . Based upon the Geology Report completed by Substrata on February 26 , 2025 , near surface site soils consist primarily of low plasticity clay loam from the Dacono clay series . The report did not indicate the existence of moderate or severe soil limitations that would require mitigation . 7 . Explain how this proposal is consistent with the Weld County Comprehensive Plan per Chapter 22 of the Weld County Code . This proposed change of zone is consistent with the Weld County Comprehensive Plan . The change of zone achieves several of the goals and objectives of the comprehensive plan , as follows : Section 22- 4- 10 — Comprehensive Plan Map A . 1 . Areas of opportunity for commercial and industrial development. These are potentially logical areas for rezoning land to C (Commercial) , I (Industrial) , and Planned Unit Development (PUD) containing C and I uses based on transportation infrastructure of roads and railroads . The map is intended to encourage rezoning in appropriate areas . B . Weld County Opportunity Zones . if in compliance with the other provisions in this Section , zone changes to C (Commercial) , I (Industrial) , and Planned Unit Development (PUD) containing C and I uses are preferred in the following locations : 1 . Within one mile of interstates . 2 . Within one - half mile of U. S. highways . 3 . Within one - half mile of the County Highway (Weld County Road 49 between I- 76 and State Highway 392) . 4 . Within one - quarter mile of railroads . 5 . Within one - half mile of the following types of intersections : a . Collector/arterial, b . Arterial/arterial, c . Collector/highway, and d. Arterial/highway. According to the Comprehensive Plan Map , the subject property is located within an Opportunity Zone due to its proximity to transportation infrastructure , including Highway 85 , collector roadways , and the Union Pacific Railroad . It is adjacent to Highway 85 and approximately 200 feet west of the Union Pacific Railroad . The site is also within one - half mile of the intersection of County Road ( CR) 28 and Highway 85 . CR 28 classified as a collector roadway . CR 28 connects to a series of other collector roadways to the west . Page 3 of 5 8 . Explain how this proposal will be compatible with future development of the surrounding area or adopted master plans of affected municipalities . Weld County encourages ` urban development ' to occur within municipal limits . One of the key elements of ` urban development ' is the need for public water or sanitary sewer service . As the site is already developed for business uses and the well water and septic system are adequate for the proposed uses , no urban - level services are needed to change the use of the site from camper sales to trailer sales . The site is in an area where commercial development exists and is expected to continue to grow . The subject property is within the Intergovernmental Agreement Areas ( IGAs ) of the City of Fort Lupton and the Towns of Platteville , Mead and Firestone . A review of the adopted master plans of affected municipalities is below . City of Fort Lupton : According to the City of Fort Lupton ' s Comprehensive Plan ' s Future Land Use map , the subject property is located outside of the city ' s planning area . Fort Lupton returned a Notice of Inquiry ( NOI ) response stating that this site is located north of the Fort Lupton - Platteville IGA and that the applicant should contact Platteville . Samples of the subsurface materials were obtained at regular intervals using California and split - barrel sampling procedures in general accordance with ASTM specification D - 1586 . As part of the D - 1586 sampling procedure , the standard sampling barrels are driven into the substrata using a 140 - pound hammer falling 30 inches . The number of blows required to advance the samplers 12 inches is recorded and helpful in estimating the consistency or relative density or hardness of the soils and / or bedrock encountered . In the California barrel sampling procedure , less disturbed samples are obtained in removable brass liners . Groundwater was not encountered in the bore holes to the depth explored ( about 4 feet below present site grade when checked immediately after the completion of drilling . The borings were backfilled upon the completion of drilling , such that subsequent groundwater measurements could not be completed . Groundwater levels will vary seasonally and over time based on weather conditions , site development , irrigation practices and other hydrologic conditions . Perched and /or trapped groundwater conditions may also be encountered at tunes throughout the year . Perched water is commonly encountered in soils overlying less permeable soil layers and / or bedrock . ANALYSIS The existing all - weather gravel section appears to meet the minimum 4 - inch depth of aggregate surface course required for rezoning by the Weld County Charter and County Code ( Section 23 - - 2 - 40 . Additionally , based on our review of surveys provided by the client along this stretch of roadway , it appears the right - of- way requirement outlined in that section of the code of at least 60 - feet has also been met .
