RESOLUTION
WHEREAS, by virtue of 119-3-12, C.R.S. 1963 (1969 Perm. Supp.) ,
a county contingency fund is available under the conditions set forth in
that section, and provides as follows:
"County contingency fund--creation. There is
hereby created a county contingency fund which
may be expended to supplement county expendi-
tures for public assistance, county welfare
administration, and child welfare services in
counties which have levied a property tax, in
the fiscal year preceding the request for funds
from this account, for support of the county
welfare fund and which tax is equal to or in
excess of the maximum property tax levy per-
mitted by statute for the support of the county
welfare fund; but no county shall be eligible
for assistance under this section until the •
state board of social services shall have caused
the financial condition of the county to have
been examined and shall have determined that
the resources available to the county to meet
its welfare needs are inadequate. The degree
of assistance to be furnished any county under
this section shall be determined by the state
board of social services with due regard to
funds available and the relative needs of the
various counties."

WHEREAS, the Board of Social Services on July 1, 1971, adopted
the attached Resolution setting out certain criteria for determining which
counties shall be eligible for assistance from this Fund; and
WHEREAS, Weld County has requested that assistance be furnished
to it from this Fund; and

WHEREAS, said County has levied a property tax in the fiscal
year preceding the request for funds from this Fund for the support of
the county welfare fund and which tax is equal to or in excess of the
maximum property tax levy permitted by statute for the support of the
county welfare fund; and
WHEREAS, said County, as of August 31, 1971, has a deficit balance
in its county welfare fund of $13,682.43; and
WHEREAS, said County had a contingency fund balance of approxi-
mately $346,158.29 as of August 31, 1971; and
WHEREAS, said County does not have an average per capita income
below the seventy-five percentile figure adopted by this Board as reflect-
ing those counties which do not have adequate resources with which to pay
their welfare costs; and
WHEREAS, the county's share of expenditures for the month of
October, 1971, is estimated to be $94,961.82; and
WHEREAS, due consideration has been given to the funds available
from the county contingency fund and the relative needs of the various
counties and possible future needs of all counties for the remainder of
1971.
NOW, THEREFORE, BE IT RESOLVED that, in view of the foregoing,
the County of Weld shall not be granted funds for the month of October,
1971, from the County Contingency Fund created under 119-3-12, C.R.S.
1963 (1969 Perm. Supp.). •

ALLOCATION OF COUNTY CONTINGENCY FUND
ti
WHEREAS several counties will in the immediate future exhaust
their county welfare funds, the following procedure shall apply in allocating
the County Contingency Fund among the said counties:
Under 119-3-12 C.R.S. 1963, as amended, the County
Contingency Fund is available to counties who have
•
levied a property tax for the support of the county
welfare fund equal to or in excess. of the minimum
_ property tax levy permitted by 119-3-6.
The Board of Social Services must also determine
that the resources available to the county to meet
its welfare needs are inadequate before a county is
eligible for county contingency funds.
•
The Board shall determine the degree of assistance
to any county (found to be eligible as provided above)
• after regarding funds available. and the relative needs
of all so eligible counties.
In determining allocation from County Contingency Fund in 1971,
the Department of Social Services staff shall take into account, in addition
to basic needs of counties for state help in paying their 20 percent cost
of certain public welfare expenditures, such analysis of county budgetary
action in 1970 compared with amounts requested by county welfare departments,
and•the relative ability to pay of counties as gauged by their per capita
income compared with other counties and the statewide average per capita
income.
• Because funds in the County Contingency Fund are limited, and are
less than the $1.3 million reported as needed by counties to get them
through the 1971 fiscal year, it becomes necessary to develop an objective
method of determining relative needs of the various counties needing help.
As a first decision,' therefore, the 'Board directs the Department
to allocate money as needed, within available funds, to those counties
whose average per capita income for 1970 is less than 75 percent of the
• average per capita income of $2,687 statewide for 1970. Such dividing
point would be $2,015 of per capita income as shown on the attached
tabulation. •
• Beyond that, if some funds are still available, the amounts
allocated to counties which are at or over their statutory mill levy as
required by 119-3-12 C.R.S. 1963, Chapter 276 Session Laws 1969, for 1970,
shall be equally prorated to counties determined to be in need.
After completion of the above procedures the Department shall
recommend and the Board shall at that time determine the degree of
• assistance under 119-3-12 C.R.S. 1963, as amended, to any and all eligible
counties. • •
