It is the purpose of petitioners to organize an irrigation district under the provisions of "An Act in Relation to Irrigation District " approved May 3 , 1905 , and amendments thereof . 2. The entire acreage of land of said proposed district is situate in "field County , Colorado . 3 . That all said lards included in said proposed irrigation district are susceptible of irri - gation from the Hardin ditch norr constructed on the south side of the South Platte River , snd the Hoover ditch now constructed and as mime is to be extended and constructed on lire now surveyed, lo- cated and staked upon the ground on the north side of said river , which ditches derive water from the South Platte River , and are lands requiring irrigation to obtainhbest results in agriculture . 6 . The means proposed to supply water 'for the irrigation of the lands embraced within said irrf gation district are as follows : The acquisition through purchase by said irrigation district from the present owners, the Hoover dam, headgate, ditch , easements and right of way therefor, with the enlargement and extension there- 1 of to be constructed by owners on line as surveyed, located and stakId to the east line of said sec- tion 7 in said irrigation district , and 20 cubic feet flow per second of tine of priority No11 , and 20 cubic feet flow per second -of time of priority No . 24, all in Water District No . 1 , Division No . 1 Weld County , State of Colorado , decreed to flow in said Hoover ditch for the ' irrigation of land; , which 40 feet of water is adequate to irrigate all the lands embraced in said proposed irrigation disteiot lying on north side of the South ' Platte River , and to so purchase the Hardin dam, headgate , ditch, rights of way and easements as the same is now constructed, and priority No . '6 for 8 cubic feet flow per second of time for irrigation of meadows; 5 cubits feet flow per second of time of prior ity No . 11 and 5 cubic feet flow per second of time of priority No . 24, all in said Water District No . 1 , and decreed to flow in said Hardin Ditch for the irrigation of lands, which 18 feet of 'water is adequate to irrigate all the lands embraced in said proposed irrigation district lying on the south side of the South Platte River . la 7 . PETITIONER Charles H . Allyn is a qualified elector in Weld County , is a resident freeholder in said proposed irrigation district and is the owner in fee simple of the SBe of NE* of Section 2, Pp . 4 N R 63 W, 30 acres of which is included within said proposed irrigation district . a- PETITIONER George Branson is „qualified elector in Weld County , is a resident freeholder in said proposed irrigation district , and is the owner in fee simple of the SW4 of Swe of section 12, Pp . 4 N . R. 63 W, 3i acres of which is within said proposed irrigation district . PETITIONER John J . Weaver is a qualified elector in Weld County, is a resident freeholder in said proposed irrigation district and is the owner in fee simple of he W of Ei of SHe of Section 27 , Pp . 5 N . R . 63 W. , 20 acres of which is within said proposed irrigation district . PETITIONER J. Henry Teach is a qualified elector in Weld County, is a resident freeholder in said proposed irrigation district , and is the owner in fee simple of the $• of NE* of Nle of section 2, Pp . 4 N . R . 63 W. , 5 acres of which is within said proposed irrigation district . Said six petitioners above named are the only freeholders residing within the boundary lines of said proposed irrigation district and constitute both the majority of the resident freeholders with- in said proposed irrigation district and owners of all the land belonging to resident qualified elec- tors freeholders within said proposed irrigation district . PETITIONER The 70 Ranch and Farms Company, a corporation, is a freeholder in said proposed irri- gation district and is the owner in fee simple of all lands embraced in said proposed irrigation dis- trict not owned by the above-named resident petitioners , as above described, and the land owned by remaining petitioners , all of whom are severally freehold owners of land within said proposed irrigs► tion district residing within the County of Weld in the State of Colorado , are qualified electors in said County under the general laws of the State of Colorado , as follows : PETITIONER CecileN . Myers is owner in fee simple of part of SWe of NW ,�'j lying south of the Union Pacific Railroad right of way, and the Ei of the NWk of SW4 of section 12, Pp . 4 N . R. 63 W. , contain ing 40 acres compfiaed in said proposed irri3tion district . PETITIONER W. E. Myers is owner in fee simple of the Ei of SWk of section 12, Tp . 4 N . R . 63 W. , containing 80 acres, 50 acres of which is included in said proposed irrigation district . PETITIONER Clarence T . Neill is owner in fee simple of all that part of section 21 , Tp . 5 N . R . 63 W. , lying south of the center line of the Hoover ditch as surveyed and located through said section, excepting therefrom the SWe of SWe and a strip of land Iwo rods wide off the west side of the SF* of the S1W of said section 27 , containing 51 acres of land, all of which is within said pro- posed irrigation district . PETITIONER Frank Loustalet is owner in fee simple of the SWe of SW4 and a strip of land two rods wide off the west side of the SF* of SWe of section 27 , Tp . 5 N . R. 63 W. , containing 41 acres of land , all of which is within said proposed irrigstion district . Said petitioners in the aggregate constitute all qualified electors within said proposed irri- gation district and in the aggregate own all the lands comprised in said proposed irrigation^and each has paid property taxes upon real property located in said proposed irrigation district during the past year . 10 . On presentation4f said petition to said Honorable Board of County Commissioners the same will be accompanied by a good and sufficient bond to be approved by said Board of County Commission- ers in double the amount of the probable costs of organizing such district , conditioned as required by statute in that! behalf . And petitioners respectfully pray that said Honorable Board do forthwith proceed, pursuant to statute in that behalf , after due publication of notice as required by law, to define and establish the boundaries of said proposed irrigation district and submit the question of the final organiza- IItion of the same to a vote of the resident freeholders of agricultural lands within said proposed I- 423 district and of those persons two are the owners of lands to the extent of forty acres or more With- in said proposed irrigation district and residents within the County of Weld, in-the State of Colora- do , and who are qualified electors in said County under the general laws of the State and iho shall have paid property taxes upon property located within said district during the year preceding such election. IN THE RATTER OF THE FORMATION OF WOODSDALE IRRIGATION DISTRICT . an a.cliourgocL At A regular meeting of the Board of County Commissioners of the County of Weld, in the State of Colorado , held at the office of said Board at the Court House in Greeley , in said county, on the 14th day of March , A .D . 1910 , a petition was presented to said Board, praying for the organization of cer- tain territory situate in the County of Weld and State of Colorado , into an irrigation district un- der the name of Woodsdale Irrigation District , pursuant to the provisions of an Act of the General Assembly of the State of Colorado , entitled "An Act in Relation to Irrigation Districts" approved May . 3rd , 1905 and acts amendatory thereto and other Acts pertaining to t same subject . Holliday having filed his affidavit that , on June . 14th 14th 1875 Daniel Hawks became the purchaser of tax sale certificate at said sale of lots • 1 , 2 and 3 of the NE* of NE* of sec . 6 Tp . 5 N . R. 65 West said certificate being number 81 sales , of 1875- for the taxes of 1874 , said certificate was assigned to J . T . Holliday and that said tax sale certificate has since been lost and after diligent search he is still unable to fine the same that said tax sale is a cloud on the title to said property and he asks that the Board , by proper order entered of record , authorize the County Treasurer of Weld County to issue his certificate of redemption from said sale . It further appearing to the Board that W. L . The Chairman of the Board , E . J . Estes , stated that the meeting had been regularly called pursuant to the requirements of the statutes for the purpose of canvassing the votes oast at the election held ' on Saturday , the 9th day of April , A , D. 1910 , in the proposed Woodsda.le Irrigation District , and in the several divisions and voting preciencts thereof , as ordered by the Board , notice of which was duly given and advertised in the County of Weld pursuant to said order , as required by law, and for the further purpose of transacting such other business as may properly come before the board , Thereupon it was moved by Commissioner P . G . Bolander , and unanimously carried , thud the Board proceed to examine the proofs and determine whether or not the notice Lif said election has been properly advertised and given in the County of Weld as required by law and as commanded in the order of the Board calling said 'election . Thereupon the Board proceeded to examine ttormesedour the proof of publication of the notice of said election, and from said examination it was found and determined that the order of the Board calling said election was duly and regularly given in the County of Weld as required by law, and that all. mat tors and things necessary to be done prior to the holding of said election had been done performed as required by law, a copy of the notice of said election as ordered by the board and as required by law having been duly published in the Weld County Republican, a newspaper of general circulation published and printed in t he County of 161d in the State of Colorado , for more that three weeks , the period of time prior to said election and in the manner as by law provided , a copy of such notice being piled with the Board and now on file herein ; and due proof of the regular publication of the notice aforesaid by the affidavit of one of the publishers of said the Weld County Republican in all respects as required by law being on file herein . Whereupon, on motion of Commissioner P . G . Bolander , and unanimously carried , the Board proceeded to open the returns and canvass the votes cast at the election held in the proposed ?.'bodsdale Irrigation District , to determine the question of whether or not the territory embraced within the exterior boundaries of said district and the lands included therein and comprising said district , as in said notice and the order of the Board set forth , should be organized into an irrigation distort-cis to be known as oodsdale Irrigation District , and for the election of a board of Directors in and for the verious divisions or precincts of said District . N . Then and there the returns were opened and the votes cast at said election so noticed and . advertised in the County aforesaid in the manner aforesaid , and held on the 9th day of April, A. D. V 444 1910 , were canvassed knd counted , from which it was found that ten ( 10 ) were marked with cross oppott site the words " Irrigation District - Yes " , and none of said votes were marked with / Pacrossoppoeite a_�,e.ac2, nd x Qn;e CeCrart 41 the words " Irrigation District - No " , tram which it appeared to the Board that t majority of all the resident freeholders whe• are legal electors in said proposed irrigation district and have paid property taxes in the last year, preceding said election have voted and did vote " Irrigation District - Yea " ; and thereupon the proceeded to canvass the votes cast in said district for direc- tors , found the following results : For Director in and for Division number 1 , W. F . Myers received ten ( 10 ) votes ; For Director in and s , Division number 2 , Charles H . Allyn received ten ( 10 ) votes ; For Director in and for Division number 3 , Clarence T . Neill received ten ( 10 ) votes . And no persons other than those above named received any votes for the office of Director in and for any division in said District . Commissioner Bolander thereupon presented the following resolution and order for the consider~ ation of the Board and moved Um adoption by the Board , to-wig . WHEREAS , heretofore and on the 14th day of March , A. D, 1910 , at a regular meeting of the Board of County Cor®istioners of Weld County , State of Colorado , them was presented by Charles H . Allyn , • George Branson and John J . Teaser , a petition signed by said persons and others , praying for the establishment , organization and creation of an irrigation district to be known as woodsda le Irrigation District , which said proposed District as described by the said petition embraced and comprised lands in the County of Weld and State of Colorado , at which time in pursuance of the petition afore- , said due pu lication in the county of Meld of the notice of presentation of said petition to said Board was duly given and publication of said petition was duly had and made ; and , HEFEAS , on the 14th day of March , A. D. 1910 , the said Board did fully and carefully consider the said petition, the bond filed by the petitioners , the proof of publication of said petition and notice of presentation of the same , and all matters pertinent to the inclusion of lands in said District , and all matters and things pertinent to and concerning the said petition for the formation of said irrigation district , and at such time said Board did duly fix , determine and establish the boundaries of said district and the lands to be included within said district , and tha said Board did at said time , to wit , on the 14th day of march , A . D . 1910 ,order an election to benof ail the qualified electors of said district as by the statute in such casesmade and provided , for the purpose of voting upon the determining whether or not said proposed irrigation district mould be organized as an irrigation district , as by law provided , to be held on Saturday , the 9th da, o f .NO. April , A . S. and the line of road as prayed for be and the same is hereby declared a public highway . It- is also further ordered that all the road petitioned to be vavated be and they nap is 'hereby declared vacated and abandoned from and after this date .
