WHEREAS, it is the desire of the Board of County Commissioners,
Weld County, Colorado, to lease purchase from Power Equipment
Company, 500 East 62nd Avenue, Denver, Colorado, the following
equipment:
1 - New KOEHRING Model 1066C Hydraulic
Hoe, Serial No. C16183, Engine No.
12VA29109,
including all attachments, as per invoice and lease agreement attached
hereto and made a part hereof by reference, for a total purchase price
of One Hundred Sixty Thousand and no/100ths ($160, 000. 00) Dollars,
and
WHEREAS, it is the further desire of the Board to rent from
Power Equipment Company, said hereinabove mentioned equipment
for a seven (7) month rental period at a rental price of Four Thousand
and no/100ths ($4, 000. 00) Dollars per month, and
WHEREAS, the County of Weld has been given the option to
purchase said equipment, with all monthly rental payments to be applied
to the purchase price.
NOW, THEREFORE, BE IT RESOLVED, that the County of Weld,
State of Colorado, agrees to lease purchase from Power Equipment
Company, 500 East 62nd Avenue, Denver, Colorado, the above-mentioned
equipment, with all attachments, all as hereinabove recited.

LEASE CONTRACT
This Agreement made and entered into this 10th day of
April, 1974 by and between POWER EQUIPMENT COMPANY, 500 East 62nd Ave . ,
P. 0. Box 28 , Denver, Colorado 80201 , hereinafter called Owner, and THE
BOARD OF COUNTY COMMISSIONERS OF Weld County , Colorado , hereinafter
called County.
WITNESSETH:
In consideration of the payments to be made by the County to
Owner as hereinafter provided, it is agreed as follows :
1 . Owner agrees to deliver to the County at Greeley, Colorado
the following described equipment:
F_Qne - New KOEHRING Model 1066C Hydraulic Hoe , Serial No .
C16183, Engine No. 12VA29109 . — __
2 . The Owner shall provide operating and maintenance instruc-
tions to County employees , sufficient to fully acquaint such employees
with special or unusual features of the equipment .
3. On delivery of the above described equipment to the County
by the Owner, the County will pay to Owner the sum of Four Thousand
Dollars ($4 ,000 . 00) .
4. In addition thereto , the County shall pay to the Owner
for the use of said KOEHRING Model 1066C Hydraulic Hoe the sum of Four

Thousand Dollars ($4 ,000 . 00) per month for &te- (6-) consecutive months ,
beginning — / — 7 Y , followed by one (1) payment of One Hun-
dred Thirty-Two Thousand and Fifty-Six Dollars ($132 ,056 .00) due by
January 25 , 1975 .
5 . The County agrees to maintain said equipment at its own
expense in good order and repair and acknowledges that it has received
such equipment in good order and repair . It is expressly understood
and agreed that the Owner shall not be liable for damages of any kind
or nature whatsoever, whether to person , and/or property , and/or for
loss of time , and/or any other loss arising from the use of/or any way
connected with the said equipment herein leases , or any part thereof .
The County hereby assumes all risks of fire or other casualty , and
agrees to indemnify Owner for all damage or loss to said equipment from

fire or other casualty .
THIS AGREEMENT shall inure to and be binding upon the parties ,
their successors and assigns .
IN WITNESS WHEREOF the parties have caused their names to be
hereunto subscribed the day and year first above written.
