Cotore o 80620 Gentlemen: It has come to the attention of the Board of Trustees of the Town c,f Evans, Weld County, Colorado, that the Landfill, Inc. is presently operating its dump site within the limits of the Town of Evans. I have been instructed by the Board of Trustees of the Town of Evans to formally notify Landfill, Inc. that the operation of this dump is contrary to and in violation of the ordinances of the Town of Evans. Accordingly, demand is mania upon Landfill, Inc. to cease and desist from all further operations of the dump site within the corporate limits of the Town of Evans. D The authorization Issued by the County Commissioners of Weld County was only for the operation of the dump on lands outside of the corporate limits of the Town of Evans or within the incorporated area of the County. Therefore, Landfill, Inc. must obtain proper zoning and authority from the Town of Evans for any further operations within the Town's corporate limits. It is the present intention of the Town of Evans to enforce its zoning regulations and if necessary to apply for a permanent restraining order in preventing continued use of the land in the Town as a dump site. Are there a set of standards that must be followed by persons, county or political subdivisions operating landfill type of dumps? If so do you know if the Weld County Landfill located one observae tions of vans Solo. is meeting these standards. Prom my they appear to be violating 40-18-46 of the Colo. statues uesi of which pro- hibits dumping litter in any waters of the state' the statues states that the state, subdivisions sot . t.cacan wodesignate areas where dumping of trash is permitted, ildr but d not in elude the rivers or water courses of the state. The Weld County Landfill is operated as mostelandfills are, the trash is brought in to the dump area it is thin oompacted with track type machines then is oovered, the problem with this oper- ation is that the dump area lies on the bank of the South Platte river and the trashl after compaction is covered with river sand, as the dump area is located in the flood Oita plain of the Platte during high water and even to some extent during normal flow, the water washes the sand away from the trash and the trash washes into the river. I have observed and photographed this dhhiistoaking wn str pa aam ee. :evidence of litter can be found almost anyplace this dump that a person would oars to look.
