WHEREAS, it has been determined by the Board of County
Commissioners, Weld County, Colorado, that a proposed sale of a
tract of land more particularly described as follows, to-wit:
The North Half (NZ) of the Northeast Quarter (NE-41) and
the South Half (Si) of the North Half (Ni) of the Northwest
Quarter (NW-,D of Section 27, Township 4 North, Range 65
West of the 6th P.M. , Weld County, Colorado, being
more particularly described as follows:
Beginning at the Northeast Corner (NE Cor) of said Sec-
tion 27, and considering the North line of said Section 27,
as bearing North 90°00' 00" East, with all other bearings
contained herein relative thereto;
Thence South 00°03'34" West, along the East line of said
Section 27, 1321. 32 feet; thence North 89°58'18" West
2634. 01 feet; thence North 89°58'16" West, 2649. 82 feet
to a point on the West line of said Section 27; thence North
00°07'15" West, along the West line of said Section 27,
659. 34 feet; thence South 89°59'08" East, 2648. 75 feet;
thence North 00°12'51" West, 660. 01 feet to a point on the
North line of said Section 27; thence North 90°00'00" East,
2637. 57 feet to the Northeast Corner (NE Cor) of said
Section 27, said point being the point of beginning;
Said described parcel of land contains 120. 034 Acres, more
or less, including a strip of ground 30 feet in width along
the North, East, and West lines of said Section 27, reserved
for County Road Right-of-Way purposes and is subject to
any rights-of-way or other easements as recorded by instru-
ments of record or as now existing on said parcel of land,
by Benjamin R. Bohlender of Weld County, Colorado, does not come within
the purview of the definition of the terms "subdivision" and "subdivided
lands" as set forth in CRS 106-2-33 (a) and (b) 1963, as amended, and
WHEREAS, the Board of County Commissioners of the County of
Weld, State of Colorado, desires to exempt this particular division of
land upon the recommendation of the Weld County Planning Director for
the reasons as stated and pursuant to its authority under CRS 106-2-33
(d), 1963, as amended, and
NOW, THEREFORE, BE IT RESOLVED, that the proposed sale
of the hereinabove described tract of land by Mr. Benjamin R. Behlender
be exempted from the definition of the terms "subdivision" and "subdivided
land" as provided for in the new Weld County Subdivision Regulations at
Section 2-1, A. , (3) adopted August 30, 1972.
The above and foregoing Resolution was, on motion duly made and
seconded, adopted by the following vote on the 30th day of October, A. D„
1974, nunc pro tune as of October 16th 1974.

Dear Sirs:
The attached letter, application, plat of the proposed land division and
other items are in reference to a request by Mr. Benjamin R. Bohlender for
a Recorded Exemption under Section 9 of the Weld County Subdivision Regu-
lations.
Based upon the information and Weld County requirements, the Planning
Commission staff recommends that this request for a Recorded Exemption be
approved for the following reasons:
1 . It is the opinion of the staff that the proposed Recorded
Exemption is in compliance with the Weld County Comprehensive
Plan. Also, it satisfies the intent clause, Section 9-2 of the
Weld County Subdivision Regulations in that the proposed parcel
B is in fact marginal as productive agricultural land.
2. The proposed Recorded Exemption application satisfies all
requirements set forth in Section 9-4 of the Weld County
Subdivision Regulations for a recorded exemption.

Gentlemen:
Mr. Benjamin Bohlander, a Weld County resident, owns the following
described real property:
North one-half (NZ) of the Northeast one-quarter (NE4)/
South one-half (Si.) of the North one-half (ND of the
Northwest one-quarter (NW+) of Section 27, Township
4, Range 65
Mr. Bohlander has farmed this property for the last 40 years and the total
acreage of his land is approximately 116. 5 acres. He desires, at this time,
to sell off approximately seven to eight acres to a Mr. Frank Gonzales who,
in turn, desires to build a single family residence on the property for his
own use. It appears that the planning board for Weld County cannot consider
an exemption for Mr. Bohlander to divide this property because his total
acreage does not meet minimum size requirements. Therefore, we are
requesting the Board of County Commissioners to allow the Planning
Commission to consider an exemption in this case.

The parcel of seven to eight acres that Mr. Bohlander desires to sell to Mr.
Gonzales borders Weld County Road 43. This property has not been farmed
for many years and a residential structure had been previously built on the
property but was destroyed by fire many years ago. Further, there is a well
on the property although it has not been actively used for several years.
Considering the size of the property, its location, and the existence of a well
on the property, we cannot forsee any problems with water, sewer, or access.
In light of the above, we feel that good cause exists for the Board of County
Commissioners to allow the Weld County Planning Commission to consider
the above described property for a recorded exemption.

Gentlemen:
Mr. Benjamin Bohlander, a Weld County resident, owns the following
described real property:
North one-half (Ni-) of the Northeast one-quarter (NE1)/
South one-half (Si) of the North one-half (ND of the
Northwest one-quarter (NW4) of Section 27, Township
4, Range 65
Mr. Bohlander has farmed this property for the last 40 years and the total
acreage of his land is approximately 116. 5 acres. He desires, at this time,
to sell off approximately seven to eight acres to a Mr. Frank Gonzales who,
in turn, desires to build a single family residence on the property for his
own use. It appears that the planning board for Weld County cannot consider
an exemption for Mr. Bohlander to divide this property because his total
acreage does not meet minimum size requirements. Therefore, we are
requesting the Board of County Commissioners to allow the Planning
Commission to consider an exemption in this case.

The parcel of seven to eight acres that Mr. Bohlander desires to sell to Mr.
Gonzales borders Weld County Road 43. This property has not been farmed
for many years and a residential structure had been previously built on the
property but was destroyed by fire many years ago. Further, there is a well
on the property although it has not been actively used for several years.
Considering the size of the property, its location, and the existence of a well
on the property, we cannot forsee any problems with water, sewer, or access.
In light of the above, we feel that good cause exists for the Board of County
Commissioners to allow the Weld County Planning Commission to consider
the above described property for a exemption.
