1 . Describe the purpose of the proposed Change of Zone .
We would like to zone the property C3
2 . Describe the current and previous use of the land . The land is mostly undeveloped with a single family
residence in the south west corner .
3 . Describe the proximity of the proposed use to residences . There is a residence near the southwest
corner of the site . here is another residence across W 392 to the south . f he north boundary and most
of the west boundary are adjacent to farm land . The eastern boundary is formed by CR 47 . he south
boundary is HW 392 .
4 . Explain how the proposed rezoning will correct what the applicant perceives as faulty zoning , or how
the proposed rezoning will fit with what the applicant perceives as the changing conditions in the area .
he site is becoming commercial / industria in nature because of the Weld County Highway and HW
392 Intersection adjacent to this site . here is an existing stoplight at that intersection . The area is
becoming less conducive for residential uses due to the traffic on these roads .
5 . Explain how the uses allowed by the proposed rezoning will be compatible with the surrounding land
uses . Include a description of existing land uses for all properties adjacent to the subject property .

BOCC has identified as a potential site for changing the zone to Industrial and or Commercial Zoning .

adopted master plans of affected municipalities . The site if it gets rezoned would be rear existing
Greeley Industrial Zoning which is south of the site . he Greeley Weld Airport is just over a mie away
from the site .
9 . Explain how this proposal impacts the protection of the health , safety and welfare of the inhabitants of
the neighborhood and the County .
his site would likely have less impact on the health , safety and welfare of Weld Inhabitants than the
roads that they are adjacent to now currently .

10 . Explain how this proposal complies with Article V and Article XI of Chapter 23 if the proposal is located
within any Overlay Zoning District ( Airport , Geologic Hazard , or Historic Townsites Overlay Districts )
or a Special Flood Hazard Area identified by maps officially adopted by the County .
The site does not appear to be to be in any overlay Zoning District . The site is vvithin a flood hazard area and
the applicant w ' shes to have ( 2 ) access locations off of CR 47 so that they won ' t have to place a bridge over
Lone Tree Creek on the flood plain on their property .

1 . Discuss the existing and proposed potable water source . If utilizing a drinking water well , include either
the well permit or well permit application that was submitted to the State Division of Water Resources .
If utilizing a public water tap , include a will serve letter from the Water District , a tap or meter number ,

" a new on - site wastewater treatment system is proposed . " Only propose portable toilets if the use is
consistent with the Department of Public Health and Environment ' s portable toilet policy .

commercial / industrial , and / or oil and gas ) of all existing and proposed accesses to the parcel . Include
the approximate distance each access is ( or will be if proposed ) from an intersecting county road . State
that no existing access is present or that no new access is proposed , if applicable .
he app icant would ike to have 2 access locations onto CR 47 . The new northern location would be
very close to the northern property line to access the northern side of the property north of the ditch .
he southern location would be approximately 400 ' south of the northern access w iich is close to the
existing oil and gas access . Two Access locations are requested so that a bridge would not have to
be constructed within the property in the Lone Tree Creek lood Plain . The flood plain would limit
travel access to the bridge within in the property .
2 . Describe any anticipated change ( s ) to an existing access , if applicable . here is an existing access on
HW 392 for the residence that will rema ' n uncha iged . There is an existing oil and gas access that wil be
rev ' sed to one of the new commercial accesses .

4 . Describe the location of all existing accesses on adjacent parcels and on parcels located on the

Northern Colorado Geotech Project No . 045 - 25
Northern Colorado Geotech has been asked to provide a mineral and aggregate evaluation for a
proposed change of zoning for a parcel located on the north side of Highway 392 , east of
Lucerne , Colorado . The property is located at the northwest corner of Highway 392 and County
Road 47 . It is our understanding that the site is roughly 35 acres in size .
Northern Colorado Geotech has completed a site reconnaissance , literature search and historical
soils exploration review for the property that has a proposed change of zoning . Northern
Colorado Geotech performed a septic system design for the residence located near the southwest
corner of the site in 2024 . The soils encountered at this site consisted of silty clayey sand ( USCS
classification SC - SM ) that is underlain by silty sand ( SM ) to a depth of 8 feet . This material would
be considered overburden in an aggregate pit and would have to be removed if aggregate was
found below . Based on The Soil Survey of Weld County performed by the United States
Department of Agriculture Soil Conservation Service ( September 1980 ) , the shale bedrock at the
site is relatively shallow . Our search of previous jobs within a 1 - mile radius of the site showed
shale bedrock encountered at depths of 9 to 17 feet . Based on the anticipated depths to the
bedrock and the surficial layers of overburden material , it is our opinion that there are no
economically viable deposits of aggregate at the site .
The proposed change of zone property is located within the Great Plains physiographic province .
The Colorado Piedmont is located near the western border of the Great Plains province and was
formed during Late Tertiary and Early Quaternary time ( approximately 2 , 000 , 000 years ago ) . The
Colorado Piedmont is a broad , erosional trench which separates the Southern Rocky Mountains
from the High Plains . Structurally , the site lies near the axis of the Denver Basin . During the
mountain building of the Laramide Orogeny ( approximately 70 , 000 , 000 years ago ) , intense
tectonic activity occurred , causing the uplifting of the ront Range and associated downwarping of
the Denver Basin to the east . Due to the erosional action of wind and streams , relatively flat
uplands and broad valleys characterize the present - day topography of the Colorado Piedmont in
this region . The site is underlain by the Cretaceous Fox Hills Sandstone . The Fox Hills is

primarily composed of sedimentary sandstone and siltstone shale deposits . The Fox Hills is not
known to contain economic deposits of quarry rock or minerals . Based on a review of geologic
maps , we are unaware of coal mines in the immediate vicinity of the site .
Therefore , it is our opinion that the property at 22795 Highway 392 does not contain economic
deposits of sand and gravel aggregate , quarry rock or minerals .
