Record of Proceedings Minutes Board of County Commissioners Weld County,Colorado Wednesday,April 23,2025 The Board of County Commissioners of Weld County,Colorado,met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building,Greeley,Colorado,April 23,2025,at the hour of 9:00 a.m. le Roll Call:The meeting was called to order by the Chair and on roll call the following members were present,constituting a quorum of the members thereof: Commissioner Perry L.Buck,Chair Commissioner Scott K.James,Pro-Tem Commissioner Jason S.Maxey Commissioner Lynette Peppier Commissioner Kevin D.Ross Also present: Acting Clerk to the Board,Houstan Aragon County Attorney,Bruce Barker Chief Financial Officer,Cheryl Pattelli El Minutes:Commissioner Ross moved to approve the below listed Minutes of the Board of County Commissioners meeting,as printed.Commissioner Peppier seconded the motion and it carried unanimously. 1. Minutes from April 9,2025 Amendments to Agenda:There were no amendments to the Agenda. Consent Agenda:Commissioner Maxey moved to approve the Consent Agenda,as printed.Commissioner James seconded the motion and it carried unanimously. Presentations and Proclamations: 1. IE University Bulldogs Day, Class 4A Girls Basketball State Championship—April 23,2025:Chair Buck read the certificate for the record. Matt Baumgartner,Coach,thanked the Board for their recognition of the team's undefeated season.He shared it has been his honor to coach the team that is comprised of tremendous athletes and upstanding students. Upon request of Chair Buck, the team introduced themselves for the record. Recognition of Services, Human Services Advisory Commission — Tammy Phillips: Chair Buck read the certificate for the record, and although Ms.Phillips was unable to be present,she thanked her for her voluntary efforts for the citizens of Weld County. 3. E Recognition of Services,Planning Commission—Pamela Edens and Cindy Beemer:Chair Buck read the certificates for the record,and although Ms. Edens and Ms.Beemer were unable to be present,she thanked them for their voluntary efforts for the citizens of Weld County. Warrants: 1. a General Warrants:Commissioner Maxey moved to approve the General Warrants,as printed.Commissioner Peppier seconded the motion and it carried unanimously. Bids: 1. a Approve Bid#B2500024,Weld County Regional Communications Center (911)Console Furniture—Department of Public Safety Communications: Toby Taylor,Purchasing Department,stated staff recommends continuation of the matter to May 21,2025,to allow for further review of the vendors that submitted bids. Commissioner James moved to continue said bid to May 21, 2025, at 9:00 a.m.,per staff's request.The motion was seconded by Commissioner Ross and it carried unanimously. 2. ,e Approve Bid #B2500036, Grounds Building Construction Services— Facilities Department:Mr.Taylor stated staff recommends selecting the lowest bidder who met specifications, WCC Construction, LLC, for a total amount of $1,198,000.00.Commissioner Ross moved to approve said bid.The motion was seconded by Commissioner James and it carried unanimously. 3. a Present Bid#B2500056,Onsite Clinic Administration—Department of Human Resources:Mr.Taylor stated six(6)bids were received and staff will make a recommendation on June 9,2025. 4. El Present Bid#B2500060, Custodial Supplies—Facilities Department: Mr.Taylor stated twenty (20) bids were receive and staff will make a recommendation on May 7,2025. 2025-1087 BC0016 Page 3 Wednesday,April 23,2025 www.weld.gov New Business—General: 1. Consider Standard Form of Agreement for Various Core and Non-Core Child Welfare Services and authorize Chair to Sign Agreements Consistent with said Form: Tami Grant, Deputy Director of the Department of Human Services, stated staff requests approval of said standardized template form to allow for contracting with vendors to provide various core and non-core child welfare services for the 2025-2026 state fiscal year.Commissioner Ross moved to approve said standard form and authorize the Chair to sign agreements consistent with said form.The motion was seconded by Commissioner James and it carried unanimously. 2. IE Consider Contract ID#9272 Memorandum of Understanding for Weld County Youth Conservation Corps Services at 2025 Weld County Fair and Authorize Chair, Department of Human Services, and Weld County Fair Board to Sign:Ms.Grant stated the memorandum of understanding(MOU)allows the Weld County Youth Conservation Corps to provide livestock setup and teardown services,amounting to 320 service hours,for the Weld County Fair from July 14, 2026, through July 18, 2025. In response to Chair Buck, Ms. Grant explained this is not a new concept between the parties but felt it was appropriate to have a formal agreement to provide clarity and expectations. Commissioner Maxey moved to approve said MOU and authorize the Chair to sign.The motion was seconded by Commissioner Ross and it carried unanimously. 3. El Consider Contract ID#9336 Agreement for Foster Care Respite Services and Authorize Chair to Sign—Elizabeth Austin:Ms.Grant stated the agreement is for a new foster care respite provider located in Milliken,Colorado,with a term from May 11, 2025,through June 30, 2027. Commissioner Peppier moved to approve said agreement and authorize the Chair to sign. The motion was seconded by Commissioner Ross and it carried unanimously. 4. a Consider Contract ID#9337 Agreement for Foster Care Respite Services and Authorize Chair to Sign—Mark Zabel and Wendy Bryner:Ms.Grant stated the agreement is for a new foster care respite provider located in Greeley, Colorado, with a term from June 1, 2025, through June 30, 2027. Commissioner James moved to approve said agreement and authorize the Chair to sign. The motion was seconded by Commissioner Maxey and it carried unanimously. 5. 0 Consider Contract ID#9338 Agreement for Foster Care Respite Services and Authorize Chair to Sign—Daniel and Elizabeth Giles:Ms.Grant stated the agreement is for a new foster care respite provider located in Milliken,Colorado, with a term from May 20,2025,through June 30,2027.Commissioner Ross moved to approve said agreement and authorize the Chair to sign. El Consider Contract ID#9349 Individual Provider Contract for Purchase of Foster Care Services in a Foster Care Home and Authorize Chair to Sign— Kimberly Dunn:Ms.Grant stated the contract is for a new provisional kinship foster care home located in Golden,Colorado,with a term from April 12,2025, through,October 12,2025.Commissioner Ross moved to approve said contract and authorize the Chair to sign. The motion, which was seconded by Commissioner Peppler,carried unanimously. 7. a Consider Contract ID#9350 Individual Provider Contract for Purchase of Foster Care Services in a Foster Care Home and Authorize Chair to Sign— Maria and Silvia Arce: Ms. Grant stated the contract is for a new provisional kinship foster care home located in Evans,Colorado,with a term from April 12, 2025,through,October 12,2025.Commissioner Maxey moved to approve said contract and authorize the Chair to sign.The motion,which was seconded by Commissioner Peppler,carried unanimously. 8. a Consider Contract ID#9361 Individual Provider Contract for Purchase of Foster Care Services in a Foster Care Home and Authorize Chair to Sign— Danielle Salazar:Ms.Grant stated the contract is for a new provisional kinship foster care home located in Greeley,Colorado,with a term from April 16,2025, through,October 16,2025.Commissioner Peppler moved to approve said contract and authorize the Chair to sign. The motion, which was seconded by Commissioner Ross,carried unanimously. 9. a Consider Contract ID#9366 Individual Provider Contract for Purchase of Foster Care Services in a Foster Care Home and Authorize Chair to Sign— Jabari Nira and Madalyn Thompson:Ms.Grant stated the contract is for a new provisional kinship foster care home located in Greeley,Colorado,with a term from April 21,2025,through,October 21,2025.Commissioner Ross moved to approve said contract and authorize the Chair to sign.The motion,which was seconded by Commissioner Peppler,carried unanimously. 10. a Consider Contract ID #9360 Amendment #2 to Memorandum of Understanding for Colorado Child Care Assistance Program(CCCAP)and Authorize Chair to Sign:Ms.Grant stated the amendment extends the term from January 1,2025,through June 30,2026.Commissioner Ross moved to approve said amendment and authorize the Chair to sign.The motion was seconded by Commissioner James and it carried unanimously. 11. a Consider Contract ID#9367 Professional Services Agreement for Pipe and Drape at 2025 Weld County Fair, and Authorize Chair to Sign — Flexx Productions, LLC: Mikayla Gabel, Weld County Fair Coordinator for CSU Extension Services of Weld County, stated the Weld County Fair Board recommended the agreement which provides the pipe and drape backdrops for various exhibits and 4-H projects at the Weld County Fair.Commissioner Ross 2025-1087 BC0016 Page 5 Wednesday,April 23,2025 www.weld.gov moved to approve said agreement and authorize Chair to sign.The motion was seconded by Commissioner James and it carried unanimously. 12. a Consider Declaration of Certain Equipment as Surplus Property,Approve Sale of Same at Auction with Roller and Associates,and Delegate Authority to Controller to Sign Any Necessary Documents:Rusty Williams,Weld County Controller,stated the Department of Fleet Services has identified three(3)pieces of equipment as surplus,marked as Exhibit A in the record,which are scheduled for auction on May 7, 2025. Commissioner James moved to approve said declaration of certain equipment as surplus property, approve sale of same at auction with Roller and Associates,and delegate authority to Controller to sign any necessary documents.The motion was seconded by Commissioner Ross and it carried unanimously. 13. Consider Establishing 2025 County Commissioner Redistricting Advisory Committee: Matthew Conroy,Assistant County Attorney, stated the Resolution establishes the Redistricting Advisory Committee with various appointed representatives listed on said Resolution,who will coordinate with the Board's Office Manager,Karla Ford,to schedule an introductory meeting to kick off the process.Commissioner Maxey commended staff for their efforts and further moved to approve said Resolution. The motion was seconded by Commissioner James and it carried unanimously. 14. eConsider Appointment to Building Trades Advisory Committee: Commissioner Maxey moved to approve said appointment. The motion was seconded by Commissioner James and it carried unanimously. 15. a Consider Reassignment to Weld County Building Code Board of Appeals:Commissioner Maxey moved to approve said reassignment.The motion was seconded by Commissioner Ross and it carried unanimously. New Business—Planning: 1. a Consider Request to Extend Time to Record Map for Use by Special Review Permit,USR24-0014,for the Construction of a 1041 Major Facility of a Public Utility, Including a Solar Energy Facility (SEF) Outside of Subdivisions and Historic Townsites in the A(Agricultural)Zone District— Magnum Feedyard Co., LLC, c/o Taelor Solar 1, LLC: Diana Aungst, Department of Planning Services, stated Use by Special Review Permit, USR24-0014,was conditionally approved on October 20,2024,and explained, pursuant to Section 23-2-200.H of the Weld County Code,applicants shall submit a plat map within 120 days of approval of said permit.However,she indicated due to the size,scope,and complexity of the project,the applicant has requested to extend the timeline to June 30, 2028, for the recording the related plat map. Ms.Aungst stated staff is supportive of the request and recommends approval.In 2025-1087 BC0016 Page 6 Wednesday,April 23,2025 www.weld.gov response to Commissioner Maxey,Andrew`Drew' McMahon and Erica Goad, applicant representatives,were present and addressed the concerns by clarifying the utility interconnection process with Xcel Energy has been the largest factor for the delay in the project's timeline.Commissioner James expressed his frustrations with the difficulties in the process for compliance with the State's mandate concerning clean energy,and commented it appears the state is over promising and under delivering. Commissioner Ross concurred with disappointment of energy options being taken away prematurely while the companies are unable to proceed with the mandates.Commissioner James moved to approve said request. The motion was seconded by Commissioner Ross and it carried unanimously. El Public Comment:No public comment was offered.
