RESOLUTION
WHEREAS, Duane Claassen, Star Route, Box 131B, Hudson,
Colorado, has requested permission for expansion of a hog operation
on the following described property, to-wit:
All that part of the East half of the Southeast Quarter of
the Northwest Quarter (EZSE+NW'-) of Section Twenty-
four (24), Township Two (2) North, Range Sixty-five
(65) West of the 6th P. M. , Weld County, Colorado,
West of the Half-Section Road, and
WHEREAS, the said requested expansion of an existing hog
operation is located in an agricultural zone as set forth by the Weld
County Zoning Resolution, and
WHEREAS, according to Section 3. 3(3)(c) of the Zoning Resolution
of Weld County, said hog operation or any expansion thereof may be
authorized upon the approval of the Board of County Commissioners of
Weld County, and
WHEREAS, the Weld County Planning Commission, by resolution,
has recommended that expansion of this hog operation be approved;
NOW, THEREFORE, BE IT RESOLVED, that the petition of
Duane Claassen, Star Route, Box 131B, Hudson, Colorado, for expansion
of an existing hog operation on the following described property, to-wit:
All that part of the East half of the Southeast Quarter of
the Northwest Quarter (EZSEj'--NW4) of Section Twenty-
four (24), Township Two (2) North, Range Sixty-five
(65) West of the 6th P. M. , Weld County, Colorado,
West of the Half-Section Road, and
as provided by Section 3. 3(3)(c) of the Zoning Resolution of Weld County,
Colorado, is hereby granted under the conditions following:
1. Any water and sanitation facilities to be installed shall be
approved by the State Health Department.
2. That all applicable subdivision regulations and zoning
regulations shall be followed and complied in accordance
with the Zoning Resolutions of Weld County, Colorado.

Mr. Anderson: We will call this hearing to order. This is
Docket Number 13, Duane Claassen of Star Route Box 131 B, Hudson, Colorado,
March 3, 1971 at 11:15 A. M. The request is for a Land Use Permit for a
hog operation. I think it should read an expansion for a land use operation.
At this time Mr. Telep will you please make a record.
Mr. Telep: Thank you Mr. Chairman. Let the record show that
this cause came on for a hearing this day, March 8, 1971, at 11:15 o'clock
A. M. on the application of Duane Claassen of Star Route, Box 131B, Hudson,
Colorado, for a Land Use Permit on an expansion of an existing hog operation
on a parcel of land located in the East Half of the Southeast Quarter of
the Northwest Quarter (EZSE4NW*) of Section Twenty-fourt (24) , Township
Two (2) North, Range Sixty-Five (65) West of the 6th P. U., Weld County,
Colorado, West of the Half Section Line Road.
Let the record show that this hearing was duly published
as required by law in the Greeley Booster on February 5 and February
26, 1971 respectively.
Let the record still further show that there is contained
in the file reciepts signifying that notices of this hearing today
were sent to the adjacent landowners.
Let the record further thow that there is on file a resolution
of the Weld County Planning Commission reporting favorably as to the
expansion of the site approval of this hog operation with conditions and
limitations as will be gone into detail by the Planning Director.
Let the record still further show that Mr. Claassen is still
present in person. Mr. Chairman I believe we are ready to proceed.
Mr. Anderson: At this time Mr. Claassen would you like to
state your request.
Mr. Claassen: I live at Star Route, Box 131-B Hudson,
Mr. Telep: If you will tell the Commissioners why you
want this expansion of this hog feeding operation.

Mr. Claasson: We bought this hog feeding operation for this
purpose and coming from Nebraska this is new to me I didn't every have
to do anything like this before. It bothers me in a way but I guess I
can see it is a necessity with the population growing the way it is.
This parcel of land is all set up for hogs - we bought it for this
purpose.
Mr. Telep: Who did you buy this from Mr. Claassen.
Mr. Claassen: Mr. Sprague.
Mr. Telep: Did he feed hogs on the place?
Mr. Claassen: Yes.
Mr. Telep: You bought it specifically to continue in the
hog business.
Mr. Claassen: Right.
Mr. Anderson: All you asking for is to make it bigger - is that
right?
Mr. Claassen: Yes.
Mr. Telep: I guess if there are no more questions - I suppose
the Planning Director testifies in detail on the matter more so the Board
can be more sufficiently advised for rendering it decision.
Mr. Anderson: Is that over along the interstate at the Hudson
Keenesburg cut-off about a mile.
Mr. Claassen: Well north and west of the Hudson-Keenesburg
cut-off. It is north of 80-S about a mile north and a little west
Mr. Anderson: Down in there on the old _ place
or west of there. Is it northwest of that old feedlot?
Mr. Claassen: Yes.
Mr. Anderson: I know where it is then down over the hill.
Is this going to have lagoons to keep water from running into the Box
Elder Creek?
Mr. Claassen: Right now it has 2 buildingswith sanitation
pits in that we plan on having hauled out onto our fields later on as
they fill up.
Mr. Anderson: I know where it is now - it is back off the
road about one-half of a mile. Do you have any questions Burman?
Mr. Lorensen: No I have no questions.

Mr. Ashley: No questions.
Mr. Anderson: Is there anyone else here to support the
application? Are you in favor of the application? Would you please
come up here to the microphone.
Jess Powers: Henderson, Colorado, and I own the land just
west - just across and I have no objections whatsoever because we have
to have some kind of livestock to keep the economy going and if we
of business.

to know is that there be no sewage dumped in the Box Elder - it is
just a few hundred feet that it comes under the fence and this is a
small portion of it and my cattle drinkout of there - so in the summer
to pump the water.

they water out of that and I have for many many years. Just so that
the drainage from the hog ranch - if we get a storm or something
you've got to over look that but just a straight drain storm I wouldn't
want that . I wouldn't want that to happen.
Mr. Anderson: I think that was agreed here with Mr.
Claassen - he will have to conform with the health rules and regulations.
Mr. Powers: I don't want to stand in anybody's way in this
kind of business if we are going to make it we all have to work together
with the feedlots - thats what they are trying to do to me.
Mr. Anderson: Is there anyone else here for the application?
Is there., anyone who is against the application? At this time Mr. Lorensen
what is the recommendation of the Planning Commission?
Mr. Lorensen: The Planning Commission recommended favorably
on this sight approval and the reason being the application was reviewed
by the Extension Office and was approved by the Weld County Health Department,
however, they did make it subject-to the-Planning Commisio❑ - did make it
subject to pits being concreted - for the pollution of Box Elder and
leeching into the soil. The soils there are extremely porus. It is
felt that he would have to have something that would not leech through.
and so their recommendations did indicate that approval subject to this
type of construction to prevent pollution.
Mr. Anderson: Would that be under the rules and jurisdiction
of the Health Department? For them to follow through with them.
Mr. Lorensen: Yes sir.

Mr. Anderson: Is there anybody else who has anything they
would like to say.
Mr. Olson: Mr. Chairman, may we have a correct spelling
of this name - we have two different spellings on it.
Mr. Anderson: Would you give us a correct spelling Mr. Claassen?
Mr. Claassen: C - 1 - a - a - s - s - e - n
Mr. Anderson: Is there anything else to come before the Board?
Mr. Billings: Mr. Chairman, I would like the record to show
that there was nobody here objecting to this application. Mr. Claassen
you do know once that it is approved it is subject to these lagoons being
sealed? So there is no drainage into the Box Elder Creek.
Mr. Claassen: There are no lagoons.
Mr. Billings: Well the sanitation pits. Mr. Lorensen brought
that out that it would be subject to no drainage into the Box Elder Creek.
Mr. Anderson: What is your pleasure gentlemen?
Mr. Billings: This is in your area if you have no objections
I see no objections to it - I would move approval of this expansion of a
-hog operation for Duane Claassen of Hudson, Colorado.
Mr. Ashley: I second the motion.
Mr. Anderson: The chair votes yes.
Mr. Billings: I vote yes on the motion
Mr. Ashley: Yes.
