Acknowledge Colorado Liquor Sales Room Application and Authorize
Chair Pro-Tem to Sign—Rock N Roll Brewery,LLC
Whereas,the Board of County Commissioners of Weld County,Colorado,pursuant to
Colorado statute and the Weld County Home Rule Charter,is vested with the authority of
administering the affairs of Weld County,Colorado,and
Whereas,Colorado Liquor Sales Rooms are under the sole jurisdiction of the Colorado
Department of Revenue,Liquor Enforcement Division,pursuant to C.R.S.§44-3-202 and
Regulation 47-428,1 C.C.R.203-2;however,applicant(s)are required to submit a copy
of their application and associated materials to the local licensing authority for review,
and
Whereas, Rock N Roll Brewery, LLC, presented to the Board an application for a
Colorado Liquor Sales Room for the sale of malt liquors, subject to the rules and
regulations found in Article 3,Title 44,C.R.S.,for comment upon whether or not the Board
has an objection to the issuance of said Colorado Liquor Sales Room,and
Whereas,Rock N Roll Brewery,LLC,is duly licensed as a Manufacturer(brewery)and
Wholesaler(malt liquors),by the Colorado Department of Revenue,and
Whereas,the proposed Colorado Liquor Sales Room is located outside the corporate
limits of any town or city in the County of Weld at the location described as follows:
Rock N Roll Brewery, LLC, 10286 County Road 15, Longmont,
Colorado 80504;being further described as Lot 1 of Enchanted Hills Lot 11
Resubdivision, RES23-0001; being part of the SW1/4 of Section 8,
Township 2 North,Range 67 West of the 6th P.M.,Weld County,Colorado
Whereas,Weld County departmental staff reviewed said application and indicated no
concerns or objections to the issuance of the Colorado Liquor Sales Room,and
Whereas,the Board is unaware of any past violations of the Colorado Liquor Code,
Colorado Liquor Rules,or violations of local laws or ordinances at or by Rock N Roll
Brewery,LLC,10286 County Road 15,Longmont,Colorado 80504,and
Whereas,the Board has no reason to believe that issuance of said Colorado Liquor Sales
Room will result in violations of the Colorado Liquor Code,Colorado Liquor Rules,or the
laws or ordinances of Weld County.
Now,therefore,be it resolved that the Board of County Commissioners of Weld County,
Colorado,having examined said application does hereby declare that it has no objection
to the Colorado Department of Revenue granting a Colorado Liquor Sales Room to
Rock N Roll Brewery,LLC,for the sale of malt liquors,at retail at said location,provided
that said licensee operates in strict conformity to all of the laws of the State of Colorado
and Weld County,and the rules and regulations relating thereto,per Article 3,Title 44,

Sales Room.
Be it further resolved by the Board that the Chair Pro-Tern be,and hereby is,authorized
to sign said application.
The Board of County Commissioners of Weld County,Colorado,approved the above

listed conditions apply.If any of these conditions apply please contact the State Licensing Authority
immediately.
❑ Issuance of this permit would impact traffic,noise,or other neighborhood concerns in a manner that is inconsistent
with local regulations or ordinances.
❑ If granted this permit would result in violations of the Colorado liquor code or the laws of the local government.

For events lasting three consecutive days or less,the Local Licensing Authority has ten(10)
business days to submit its determination to the State Licensing Authority.

(hereafter known as lessor)and all lease signer All lease signers(tenants),agree to the following

2 No others may occupy the residence for longer than 7 days without written permission from lessor
3 Security deposit in the amount of$0 00 _shall be held by lessor until 60 days past lease end(NO VERBAL
AGREEMENTS)via tenant(s)and lessor It is tenant's responsibility to notify lessor of forwarding address to receive security
deposit upon lease termination
4 Security deposit will be held against any property damages beyond normal wear and tear and/or unpaid utility bills
Property damage is considered CAUSED BY TENANT unless a POLICE REPORT has been filed and lessor has been
contacted within 24 hours of discovery of damage
5 Security deposit is not to be used as last month's rental payment If tenant refuses to pay final month's rent,an eviction
proceeding will be initiated This may result in a Judgment and eviction on the record of the tenant
6 If lessor sells or assigns the leased property,lessor shall have the right to transfer the lease and security deposit to the new
owner or assignee and upon so doing,lessor shall be released from any and all liability to tenant

lessor Any abandonment shall be considered as breach of lease agreement This definition is subordinate to,and shall not
in any way impair the rights and remedies of lessor under this lease agreement or applicable law,except that in case of
abandonment,lessor may immediately re-take the premises abandoned by the tenants,as provided by applicable law,and

Please see the below steps taken to in order to restrict sales to minors,restrict sales to visibly
intoxicated persons,and insuring that customers cannot leave the premises with an open container
of alcohol
Rock N Roll Brewery takes every measure possible to ensure no minors under the age of 21 are
served alcoholic beverages,or sales to visibly intoxicated persons
RESTRICTING SALES TO MINORS:
(1)Rock N Roll Brewery checks EVERYONE'S ID,not just younger looking individuals All
customers must show valid and(non expired)driver's licenses
(2)Once the customer is confirmed to be over 21 years of age,we require them to wear a wristband
that easily identifies the over 21 year old customers This also prevents someone over 21 to then let
a minor drink their alcoholic beverage
RESTRICTING SALES TO VISIBLY INTOXICATED PERSONS:
(1)Rock N Roll Brewery will not allow anyone that is visibly intoxicated to enter the premises,or be
served alcohol We will politely ask that person to find a ride home(and not drive)If needed,we will
give the persona safe ride home at no charge
(2)This brewery always has a security presence,with clearly identifiable security shirts
(3)This brewery will not be open to the public Any visitors are"by appointment only",and will be
required to join the brewery club which will require a background checks Most visitors will be home
brew clubs,which are responsible people that just like to sample high quality small brewery beers
INSURING THAT CUSTOMERS CAN NOT LEAVE THE PREMISES
WITH OPEN CONTAINERS OF ALCOHOL
(1)To insure that customers cannot leave the premises with an open container of alcohol,we have a
security person assigned to the gate entrance If anyone has an open container of alcohol,they
prohibited from leaving with the container There is a trained security presence at all times
(2)In addition,(unopened package beer)is only given to the customer at the exit gate This insures
that they will not open any containers while on the premises

' Case Summary,
The applicant is requesting a Zoning Permit for Certain Uses in the A(Agricultural)Zone District for a
brewery(Rock N Roll Brewery) The property owner currently brews beer in the existing outbuilding,
permitted under ASA19-0059 There will be no public allowed in the outbuilding,where beer is brewed The
purpose of the ZPAG is to allow the ability for the friends and family to come for tastings These tastings
will be held outside The events are seasonal(less than six months)and are typically held in the summer
and early fall months There are no outside full-time employees,the property owner would be considered
the one(1)full-time employee During events,the owner employs two(2)people to assist with tastings and
to help set up and take down event tents,etc The owner also employs one(1)security person for events
only
Hours of operation will be Saturdays from 2 00 p m—9 00 p m with up to one(1)special event per year
with hours of operation expanded to 10 00 p m The average number of individuals at one time on site will
be up to twenty-five(25)and up to seventy-five(75)for special events A 10 x 10 foot tent will be set up for
sales along with small ice coolers There will also be small round tables with umbrellas Food trucks may
' be present dependent on the event,if a food truck is present,it must adhere to the Colorado'Retail Food
Establishment Rules and Regulations Bottled water and portable toilets will be on site when open
The Department of Planning Services approves the ZPAG for the following reasons
1 The submitted materials are in compliance with the application requirements of Section 23-4-1220
of the Weld County Code
_2 ,The proposed request is in compliance with the ZPAG Criteria requirements of Section 23-4-1200

' Per the Department of Environmental Health Services-referral dated January 27,2025,the
' existing home on the property is served by Central Weld County Water Distnct and an onsite
wastewater treatment system(G-19721956)which is permitted for five(5)bedrooms The
applicant is proposing to use portable toilets for patrons of the brewery Portable toilets are
acceptable for facilities that are utilized six(6)months or less per year in accordance with EH
policy If the events exceed six(6)months,then a permanent water source and an OWTS must
be installed to provide for business use
Waste containers will be provided which will be emptied into a commercial dumpster after each
event Dust control will be achieved by using gravel on driveways,while field grass will be
maintained to minimize mud and dirt A separate vault will store the brew waste and will be
disposed of when it reaches capacity
Any food vendors,which includes food trucks,and catering must adhere to the Colorado Retail
Food Establishment Rules and Regulations
C Section 23-4-1200 A 4—The proposed use is compatible with the character of the
neighborhood
The Weld County Code allows a Brewery in the A(Agricultural)Zone District per Section 23-3-
55 C Per Section 23-1-90 of the Weld County Code,a Brewery is defined as "Any
establishment licensed pursuant to the'provisions of Title 44,Article 3,C R S,where malt

liquors or fermented malt beverages are manufactured,except BREW PUBS"Malt liquors"are
defined in C R S Section 44-3-103(30) "Fermented malt beverages"are defined in C R S
Section 44-4-103(1)"
The surrounding properties are a mix of residences and businesses The Weld County
Department of Planning Services sent notice to thirty-six(36)surrounding property owners
within 500 feet of the proposed ZPAG boundary Planning staff received nineteen(19)
responses total,with three(3)having no concerns and sixteen(16)being opposed Many of
the concerns outlined by the surrounding property owners is related to the general concept of
a business being on the site,the operation hours,disturbance of the area in general,quality of
life,intoxicated drivers,noise,traffic and property values
The property owner is required to install an opaque fence along the north side of the property,
where the proposed business will be located Furthermore,the hours and days of operation
have been reduced from the initial request to minimize the overall impact on neighboring
properties
Within a one-mile radius of the subject lot,them are approximately ten(10)businesses,with
an additional nine(9)located beyond that range These businesses include horse boarding
facilities,kennels,welding shops,a small home-based repair business,and a winery situated
about 2 5 miles northeast of the property
Development Standards will assist in mitigating the impacts of the facility on the adjacent
properties and ensure compatibility with,surrounding land uses and the region
D Section 23-4-1200 A 7--The proposed use has adequate access and street/road or highway
facilities providing access to the property are adequate in size to meet the requirements of the
proposed use
Per the Development Review referral dated February 5,2025,the applicant is proposing to use
an existing access onto County Road 15 located approximately 1,580 feet north of County „
Road 22(Sable Avenue)This portion of County Road 15 is in the Town of Firestone which
has jurisdiction over access to the road Please contact the Town to verify the right-of-way on
County Road 15 and to determine if an access permit is required The Town of Firestone did ,
not return a referral

3 The proposed request is in compliance with the Operation Standards requirements of Section 23-
4-1210 of the Weld County Code
This recommendation is based,in part,upon a review of the application materials submitted by the
applicant,other relevant information regarding the request,and responses from referral entities
The Department of Planning Services'staff recommendation for approval is conditional upon the following
1 Prior to recording the map
A The applicant shall submit a Screening Plan to the Weld County Department of Planning
Services,for review and approval At a minimum,information shall be provided concerning
the material,and height of proposed fencing
B The applicant shall acknowledge the requirements of the Central Weld County Water District
referral dated January 31,2025 Evidence of such shall be submitted in writing to the Weld
County Department of Planning Services
C A new Drainage Narrative with a qualifying exception or a Final Drainage Report and
Certification of Compliance stamped and signed by a Professional Engineer registered in the
State of Colorado is required

D The Zoning Permit Plan shall be amended to delineate the following
1 All sheets of the plan shall be labeled ZPAG24-0007
2 The attached Development Standards
3 Show and label existing and proposed structures and approximate distances to the
nearest property lines All structures to be used in conjunction with the zoning permit
shall meet current setbacks and offsets -
4 Show and label existing and proposed parking areas,including surface material,number,
and dimensions of spaces and drive aisles Parking shall comply with Article IV,Division
1,of this Chapter as applicable
5 Show and label existing and proposed landscaping and screening Buffering and/or
screening may be required to mitigate the effects of the zoning permit on adjacent
properties Buffering and/or screening may be accomplished through a combination of
berming,landscaping and fencing
6 Show and label existing and proposed signage All signage shall comply with Article IV,
Division 2,of this Chapter as applicable
7 After contacting the Town of Firestone to verify the County Road 15 right-of-way,show
and label the nght-of-way and approved access Include in the label the Town of

' A If more than one(1)acre of land is to be disturbed with this project,a Weld County Grading
Permit will be required
3 The applicant shall submit one(1)electronic copy(pdf)of the plan for preliminary approval to the
Weld County Department of Planning Services Upon approval of the plan the applicant shall submit
a ZPAG map along with all other documentation required as Conditions of Approval to the
Department of Planning Services The ZPAG map shall be recorded in the office of the Weld County
Clerk and Recorder by the Department of Planning Services prior to commencement of the use or
construction The applicant shall pay the recording fee
4 If the required documents have not been recorded within ninety(90)days from the date of approval
or if an applicant is unwilling or unable to meet any of the conditions within ninety(90)days of
approval,the Director of Planning Services may refer the_application to the Board of County
Commissioners,which may revoke the zoning permit following a public hearing The applicant shall
be notified of the public heanng at least ten(10)days prior to the hearing Pnor to said hearing,the
Director of Planning Services may grant a one-time extension of up to ninety(90)days,for good
cause shown,upon a wntten request by the applicant Before this extension has expired,the
applicant may seek a further extension from the Board of County Commissioners by written request
to the Director of Planning If the Board of County Commissioners denies the extension or if the
conditions are not met and the required documents recorded by the date specified by the Board,
the zoning permit approval shall be voided,and the application denied

5 . In accordance with Appendix 5 - J of the Weld County Code , should the map not be recorded within
the specified timeline from the date the administrative review was signed , a $ 50 . 00 recording
continuance fee shall be added for each additional 3 - month period .
6 . The Zoning Permit for Certain Uses in the Agricultural Zone District is not perfected until the
Conditions of Approval are completed and the map is recorded . Activity shall not occur , nor shall
any building or electrical permits be issued on the property , until the Zoning Permit for Certain Uses
in the Agricultural Zone District plan is ready to be recorded in the office of the Weld County Clerk
and Recorder or the applicant has been approved for an early release agreement .

13 There shall be no parking or staging of vehicles on County Road 15 On-site parking shall be utilized
14 The historical flow patterns and runoff amounts will be maintained on the site in such a manner that it
will reasonably preserve the natural character of the area and prevent property damage of the type
generally attributed to runoff rate and velocity increases,diversions,concentration and/or unplanned
ponding of stormwater runoff
15 Weld County is not responsible for the maintenance of any on-site drainage related features
16 All liquid and solid wastes(as defined in the Solid Wastes Disposal Sites and Facilities Act,30-20-
100 5,C R S)shall be store and removed for final disposal in a manner that protects against surface
and groundwater contamination

17 No permanent disposal of wastes shall be permitted at this site This is not meant to include those
wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and
Facilities Act,30-20-100 5,C R S
18 Waste materials shall be handled,stored,and disposed in a manner that controls fugitive dust,fugitive
particulate emissions,blowing debris,and other potential nuisance conditions The applicant shall
operate in accordance with Chapter 14,Article 1 of the Weld County Code
19 Fugitive dust shall attempt to be confined on the property Uses on the property should comply with the
Colorado Air Quality Commission's air quality regulations
20 Adequate drinking,hand washing,and toilet facilities shall be provided for employees and patrons of
the facility A permanent,adequate water supply shall be provided for drinking and sanitary purposes,
as applicable
21 Any On-site Wastewater Treatment System located on the property must comply with all provisions of
the Weld County Code,pertaining to On-site Wastewater Treatment Systems,as applicable
22 Portable toilets and bottled water are acceptable for facilities utilized for six months or less per year
Records of maintenance and proper disposal for portable toilets shall be retained on a quarterly basis
and available for review by the Weld County Department of Public Health and Environment Portable
toilets shall be serviced by a cleaner licensed in Weld County,contain hand sanitizers and be screened
from existing adjacent residential properties and public rights-of-way If the activities exceed the above
requirement,then a permanent water source and an On-site Wastewater Treatment System must be
established to provide for business use
23 Brew Waste shall be captured in a watertight vault and hauled off for proper disposal Records of
installation,maintenance,and proper disposal`shall be retained
24 The facility shall comply with Colorado Retail Food Establishment Rules and Regulations governing the
regulation of food service establishments,as appropnate
25 The operation shall comply with all applicable rules and regulations of State and Federal agencies and
the Weld County Code
26 All buildings shall comply with the setback from oil and gas wells per Section 23-4-700,as amended
27 Building permits shall be required for any new construction or set up manufactured structure,per
Section-29-3-10 of the Weld County Code A building permit application must be completed and
submitted Buildings and structures shall conform to the requirements of the vanous codes adopted at
the time of permit application Currently,the following have been adopted by Weld County 2018
International Building Codes,2018 International Energy Code,2023 National Electrical Code,and
Chapter 29 of the Weld County Code A Building Permit Application must be completed and two(2)
complete sets of engineered plans bearing the wet stamp of a Colorado registered architect or engineer
must be submitted for review A plan review shall be approved,and a building permit must be issued
pnor to the start of construction The property owner or operator shall be responsible for complying with
the Design and Operation Standards of Chapter 23 of the Weld County Code A Geotechnical
Engineering Report,performed by a Colorado registered engineer,shall be required or an Open Hole
Inspection
28 Building Permits issued on the proposed lots will be required to adhere to the fee structure of the County
Facility Fee,County-Wide Road Impact Fee,and Drainage Impact Fee Programs
29 The property owner or operator shall be responsible for complying with the Design and Operation
Standards of Chapter 23 of the Weld County Code
30 Necessary personnel from the Weld County Departments of Planning Services,Public Works,and
Public Health and Environment shall be granted access onto the property at any reasonable time in

31 The Zoning Permit area shall be limited to the plans shown hereon and governed by the foregoing
standards and all applicable Weld County regulations Changes from the plans or Development
Standards,as shown or stated,require the written approval of an amendment of the Permit by the Weld
County Planning Services Department before such changes from the plans or Development Standards .

32 The property owner or operator-shall be responsible for complying with all of the foregoing Development
Standards Noncompliance with any of the foregoing Development Standards may be reason for
revocation of the Permit by the Board of County Commissioners
33 The property owner,operator or successor shall be responsible for acknowledging and complying with
Section 23-4-1240 of the Weld County Code
34 Construction or use pursuant to issuance of a zoning permit shall be commenced within three(3)years
from the date of approval of the permit A one-time extension of one hundred twenty(120)days may
be granted by the Department of Planning Services for good cause shown by written request Before
this extension has expired,the applicant may seek a further extension from the Board of County
Commissioners by written request to the Director of Planning Services If the Board of County
Commissioners denies the extension or if construction has not commenced by the date specified by
the Board,the zoning permit approval shall be voided,and the application denied
35 Any zoning permit may be revoked by the Board of County Commissioners for violation of any of the
terms of this Division 17 or conditions of approval of the zoning permit following a Probable Cause
Hearing as outlined-in Section 2-4-40 of this Code If the zoning permit is revoked,the property owner
shall cease operation of the use immediately Continued operation of the use after a zoning permit has
been revoked shall be a violation of this Code
36 The Director of Planning Services may revoke a zoning permit if the use is discontinued for a period of
three(3)consecutive years Should the Department of Planning Services observe or receive credible
evidence of such a discontinuance,the Department shall notify the property owner by first-class mail
If the property owner objects to the revocation of the zoning permit within thirty(30)days,the Director
of Planning Services-may schedule a public hearing before the Board of County Commissioners for its
review and decision The applicant shall be notified of the public hearing at least ten(10)days prior to
the hearing
37 The Department of Planning Services may permit minor amendments to an approved zoning permit
without a complete application for a new zoning permit,notification to surrounding property owners,or
referral to agencies The applicant shall provide a written summary of the proposed amendment(s)and
any other documentation required by the Department of Planning Services An increase of ten(10)
percent or more in impervious surface area or an increase of ten(10)percent or more in traffic shall
not be considered a minor amendment If the Director of Planning Services determines the proposed
amendment does not qualify as a minor amendment,the proposed amendment shall require a new
zoning permit

The Colorado Department of Revenue,Liquor Enforcement Division(LED),solely reviews and issues
Manufacturer's Licenses for the manufacture of various alcohol products.However,when an existing
manufacturer applies for a`Sales Room',which allows them to serve alcohol to the public,LED allows the local
licensing authority the chance to review the application.
Last summer,Rock N Roll Brewery,LLC,applied for a Sales Room and,upon the Department of Planning Services'
review,was instructed to apply for a ZPAG.Because the applicant didn't have the proper land use permitting in
place,the Board objected to the issuance of a Sales Room.The ZPAG has since been issued(attached)and now
the applicant is resubmitting a Sales Room Application for your review.LED requested we expedite our review
since it is the second time we have gotten to review the application(albeit a new application).I've also attached
the application from last year for your comparison.
I am aiming to list this on the Agenda on Wednesday,April 30,2025,at 9:00 a.m.,because the applicant has
planned an opening for May 3rd.
