Buck, Chair Commissioner Scott K. James, Pro-Tem Commissioner Jason S. Maxey Commissioner Lynette Peppier Commissioner Kevin D. Ross Also present: Acting Clerk to the Board, Houstan Aragon County Attorney, Bruce Barker Chief Financial Officer, Cheryl Pattelli Minutes: Commissioner Maxey moved to approve the below listed Minutes of the Board of County Commissioners meeting, as printed. Commissioner James seconded the motion and it carried unanimously. 1. Minutes from June 2, 2025 Read Ordinances by Audio: Commissioner Ross moved to read the below listed Code Ordinances by audio. The motion was seconded by Commissioner James and it carried unanimously. 1. Code Ordinance #2025-08 2. Code Ordinance #2025-10 2025-1649 BC0016 Page 2 Monday, June 16, 2025 www.weld.gov Certification of Hearings: Commissioner Ross moved to approve the below listed Hearing Certificate. Commissioner Maxey seconded the motion, which carried unanimously. 1. Special Event Permit — Wish Ride of Colorado, fbo Make -A -Wish Foundation of Colorado, Inc. IE Amendments to Agenda: There were no amendments to the Agenda. El Consent Agenda: Commissioner Maxey moved to approve the Consent Agenda, as printed. Commissioner James seconded the motion and it carried unanimously. Warrants: 1. a General Warrants: Commissioner Ross moved to approve the General Warrants, as printed. Commissioner Peppler seconded the motion and it carried unanimously. Bids: 1. a Approve Bid #62500076, Department of Human Services and Sheriff's Office Building Renovation Design and Engineering Services at Southeast Weld (Fort Lupton) — Facilities Department: Toby Taylor, Purchasing Department, stated staff recommends selecting the lowest bidder who met specifications, Crumpton and Associates Architects, for a total amount of $24,624.00. Commissioner Ross moved to approve said bid. The motion was seconded by Commissioner Peppier and it carried unanimously. 2. a Present Bid #B2500053, Dell Maintenance and Support — Department of Information Technology: Mt. Taylor stated two (2) bids were received and staff will make a recommendation on June 30, 2025. New Business — General: 1. a Consider Contract ID #9551 Task Order Contract for Title X Family Planning Program and Authorize Chair to Sign: Jason Chessher, Director of the Department of Public Health and Environment, stated the contract provides funding, in the amount of $232,857.00, for various preventative services offered to uninsured and underinsured Weld County residents, such as contraception, cancer screening, sexually transmitted infection (STI) testing, and other related care services. Commissioner James moved to approve said contract and authorize the Chair to sign. Ei Consider Contract ID #9558 Independent Contractor Agreement and HIPAA Business Associate Agreement for Structured Mental Health Consultation Services, and Authorize Chair to Sign — North Range Behavioral Health: Mr. Chessher stated the agreements provide structured mental health consultation services for the public health nursing and community outreach staff to help prevent `compassion fatigue', for the amount of $120.00 per hour, which is accounted for in the department's budget. Commissioner Maxey moved to approve said agreements and authorize the Chair to sign. The motion was seconded by Commissioner Peppier and it carried unanimously. 3. a Consider Contract ID #9569 Amendment #2 to Task Order Contract for Tuberculosis Prevention and Control Program and Authorize Chair to Sign: Mr. Chessher stated the amendment allows the County to continue providing current levels of tuberculosis prevention and treatment services to residents in Weld County, for the amount of $65,000.00. Commissioner James moved to approve said amendment and authorize the Chair to sign. The motion was seconded by Commissioner Peppler and it carried unanimously. 4. Consider Intergovernmental Agreement for Use of Weld County Department of Oil and Gas Energy Staff to Assist with 1041 Oil and Gas Location Assessment Enforcement, and Authorize Chair to Sign — Town of Severance: Brett Cavanaugh, Director of the Department of Oil and Gas Energy, stated the agreement with the Town of Severance allows for County staff to assist with enforcement of 1041 Oil and Gas Location Assessment (WOGLA) enforcement. Commissioners Ross and Maxey commended Mr. Cavanaugh for working diligently with officials at the Town of Severance to offer supportive services regarding pre -application meetings, inspections, and compliance pursuant to the Weld County Code. Commissioner Ross moved to approve said agreement and authorize the Chair to sign. The motion was seconded by Commissioner Maxey and it carried unanimously. 5. El Consider Extension to Temporary Closure of County Road 29 Between County Road 74 and State Highway 14: Amy Mutchie, Department of Public Works, requested an extension to the temporary closure of County Road (CR) 29, between CR 74 and State Highway (SH) 14, from July 2, 2025, to July 25, 2025, due to inclimate weather conditions delaying the culvert replacement and roadway construction. She indicated the detour route remains the same. Commissioner Maxey moved to approve said extension to temporary closure. The motion was seconded by Commissioner James and it carried unanimously. 6. Consider Temporary Emergency Closure of County Road 36 Between County Roads 49 and 53: Ms. Mutchie requested retroactive emergency approval for temporarily closing CR 36, between CRs 49 and 53, which began June 10, 2025, and will go through June 27, 2025, as the result of an emergency replacement of a collapsed culvert. She stated the detour route is paved. 2025-1649 BC0016 Page 4 Monday, June 16, 2025 www.weld.gov Commissioner James moved to approve said temporary closure, on an emergency basis, retroactively effective June 10, 2025. The motion was seconded by Commissioner Peppier and it carried unanimously. 7. a Consider Contract ID #9570 Memorandum of Agreement to Purchase Property Interest for Acquisition of Right -of -Way and Easements for County Roads 13 and 54 Intersection Roundabout Project and Authorize Chair to Sign Any Necessary Documents — Coulson Excavating Company, Inc.: Clay Kimmi, Department of Public Works, stated the agreement is for the acquisition of approximately 2.893 acres of right-of-way, 3.238 acres of permanent easements, and 2.959 acres of temporary construction easements for the northeast corner of CRs 13 and 54 Intersection Roundabout Project, in the amount of $577,000.00. Commissioner Ross moved to approve said agreement and authorize the Chair to sign. The motion was seconded by Commissioner James and it carried unanimously. 8. IR Consider Declaration of Certain Equipment as Surplus Property, Approve Sale of Same at Auction with Roller and Associates, and Delegate Authority to Controller to Sign Any Necessary Documents: Cheryl Pattelli, Chief Financial Officer and Director of the Department of Finance, referenced listed items (ExhibitA in the record) that are no longer in use and requested to sell them at auction on July 9, 2025. Commissioner Ross moved to approve said declaration of certain equipment as surplus property, approve sale of same at auction with Roller and Associates, and delegate authority to the Controller to sign any necessary documents. The motion was seconded by Commissioner James and it carried unanimously. New Business — Ordinances: 1. a Final Reading of Code Ordinance #2025-05, In the Matter of Repealing and Reenacting, with Amendments, Chapter 8 Public Works of the Weld County Code (DRMS Agriculture Mining Permits): Commissioner James moved to read Code Ordinance #2025-05 by title only. The motion was seconded by Commissioner Ross and it carried unanimously. Bruce Barker, County Attorney, read the title for the record. Dawn Anderson, Department of Planning Services, stated there are no additional proposed changes since Second Reading and staff recommends approval. No public testimony was offered concerning this matter. Commissioner Ross moved to approve Code Ordinance #2025-05 on Final Reading. The motion was seconded by Commissioner James and it carried unanimously. 2025-1649 BC0016 Page 5 Monday, June 16, 2025 www.weld.gov 2. a Final Reading of Code Ordinance #2025-06, In the Matter of Repealing and Reenacting, with Amendments, Chapter 5 Revenue and Finance of the Weld County Code (Mid -Year Fees): Commissioner Ross moved to read Code Ordinance #2025-06 by title only. The motion was seconded by Commissioner Maxey and it carried unanimously. Mr. Barker read the title for the record. Jennifer Oftelie, Budget Manager, reviewed the proposed changes and stated there are no additional proposed changes since Second Reading and staff recommends approval. No public testimony was offered concerning this matter. Commissioner Maxey moved to approve Code Ordinance #2025-06 on Final Reading. The motion was seconded by Commissioner Ross and it carried unanimously. 3. IE Final Reading of Code Ordinance #2025-07, In the Matter of Repealing and Reenacting, with Amendments, Chapter 2 Administration and Chapter 21 Areas and Activities of State Interest of the Weld County Code: Commissioner James moved to read Code Ordinance #2025-07 by title only. The motion was seconded by Commissioner Maxey and it carried unanimously. Mr. Barker read the title for the record. Jim Flesher, Department of Planning Services, reviewed the proposed changes, stated there are no additional proposed changes since Second Reading, and staff recommends approval. No public testimony was offered concerning this matter. Commissioner James moved to approve Code Ordinance #2025-07 on Final Reading. The motion was seconded by Commissioner Peppier and it carried unanimously. 4. El Second Reading of Code Ordinance #2025-09, In the Matter of Repealing and Reenacting, with Amendments, Chapter 2 Administration of the Weld County Code (Referral/Response Correspondence): Commissioner James moved to read Code Ordinance #2025-09 by title only. The motion was seconded by Commissioner Peppler and it carried unanimously. Mr. Barker read the title for the record and stated there is one (1) additional proposed change since First Reading regarding the inclusion of a disclaimer marked as subsection G, which states: "Nothing in this Section 2-1-60 shall create an expectation in the procedures set forth herein in any member of the public, nor create a right of action by any member of the public if any of the procedures set forth herein are not complied with." No public testimony was offered concerning this matter. Commissioner Ross moved to approve Code Ordinance #2025-09 on Second Reading, as amended. The motion was seconded by Commissioner Maxey and it carried unanimously. 5. lE9 First Reading of Code Ordinance #2025-08, In the Matter of Repealing and Reenacting, with Amendment, Chapter 23 and Chapter 24 of the Weld County Code (Miscellaneous): Mr. Flesher reviewed the proposed changes to Chapters 23 and 24 concerning the definitions of fourteen (14) terms, as well as the addition of the definition of poultry, and the removal of three (3) items no longer relevant. He indicated several clean-up items for better clarification throughout the 2025-1649 BC0016 Page 6 Monday, June 16, 2025 www.weId.gov chapters, and stated the Planning Commission heard and recommended adoption at their June 3, 2025, meeting. No public testimony was offered concerning this matter. Commissioner Maxey moved to approve Code Ordinance #2025-08 on First Reading. The motion was seconded by Commissioner Ross and it carried unanimously. 6. E First Reading of Code Ordinance #2025-10, In the Matter of Repealing and Reenacting, with Amendment, Chapter 3 Human Resources of the Weld County Code (Pay Practices and Payroll): Jill Scott, Director of the Department of Human Resources, reviewed the proposed changes to Chapter 3 concerning updates to pay practices and payroll in response to the recent updates to the compensation strategies. She detailed said proposed changes will provide clarity in Sections 3-1-30, 3-2-40, 3-2-110, and Articles X, XI, and XII of the Weld County Code. Ms. Scott indicated these changes codify the County's commitment to maintain an objective, transparent, and competitive compensation system that reflects the County's core values. No public testimony was offered concerning this matter. Commissioner James moved to approve Code Ordinance #2025-10 on First Reading. The motion was seconded by Commissioner Peppier and it carried unanimously. Public Comment: No public comment was offered. Let the Minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board.
