APPOINTING COMMISSIONER
TO CONVEY REAL PROPERTY:
Commissioner Anderson offered the following resolution and moved its
adoption:
WHEREAS, Weld County, Colorado, has acquired and is the owner of the
following described real property, duly recorded in the records of the County Clerk
and Recorder of the County of Weld, State of Colorado, as follows, to-wit:

WHEREAS, said property has been duly advertised for sale at a public
auction held on the 10th day of November 1971, at the hour of 11:30 A. M. in the
Office of the Board of County Commissioners, excepting therefrom the reservations
in the United States Patent and existing reservoir sites and irrigation ditches,
if any, existing rights-of-way for public highways and roads and any and all existing
easements of rights-of-way, however evidenced or acquired, and subject to existing
leases, and excepting therefrom all oil, gas and other minerals therein or thereunder,
together with the right to prospect for and remove the same; and all County owned
structures, if any on said property and all property used for County purposes; and
WHEREAS, William Newton Heiss of 3330 Thirteenth Street, Greeley, Colorado,
bid S100.00 as the purchase price for said property and being the highest and best
bidder, said property was sold.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners of
Weld County, Colorado, that Francis M. Loustalet, County Treasurer, be and he is
hereby constituted and appointed as Commissioner for Weld County, Colorado, and is
hereby ordered to convey, without covenants of warranty, to William Newton Heiss,
the aforementioned property, as above described, excepting therefrom the reservations
in favor of the Union Pacific Railroad Company; and excepting therefrom the reservations
in the United States Patent and existing reservoir sites and irrigation ditches; if
any, existing rights-of-way for public highways and roads, and any and all existing
easements of rights-of-way, however evidenced or acquired, and subject to existing
leases; and excepting therefrom oil, gas and other minerals therein or thereunder
together with the right to prospect for and remove the same; and all County owned
structures if any on said property; and
IT IS FURTHER RESOLVED, that as to such conveyance, Francis M. Loustalet
is authorized to affix the seal of Weld County and said conveyance shall have the
effect to transfer to said William Newton Heiss all right and interest which Weld
County has in and to the above described property subject to the exception and
reservations hereinabove mentioned or referred to. Weld County does not warrant title.
The motion was seconded by Commissioner Ashley and adopted by the following

--AND WHEREAS, the County Commissioners of the County of Weld did elect to sell said property as provided by law, and
did cause notice of sale at public auction of such real property to be advertised in two issues of Greeley Booster
a newspaper of general circulation in the said County of Weld; said newspaper notices having appeared one week apart and with-
in the thirty day; as provided by law, and did post said notice in a public place in the county court house for at�l asst thirty days
before the date of such sale and thereupon did offer such real property for sale at public auction on the 10th day
of Navemder........... .._____...., 19../.1-, in the County Commissioners Office, Court House, Greeley, Colorado, subject to
the exceptions and reservations hereinafter stated.
AND WHEREAS, William Newton Heiss
has paid the sum of One Hundred Dollars and No/100
in full payment of said bid fur said property-, with said exceptions and reservations.
NOW, THEREFORE, WELD COUNTY, by Francis M. Loustalet heretofore duly
t appointed by the Board of County Commissioners of Weld County, Colorado, as Commissioner to convey said real property and
to execute this deed, acting upon the direction of the Board of County Commissioners of Weld County in executing this deed,

and b virtue of the statutes in such case made and provided, by these presents does grant, bargain and sell the following described
