MEMORANDUM TO: Diana Aungst, Planning Services FROM: Melissa J King, PE, CFM - DRE DATE: November 7, 2024 SUBJECT: COZ24-0007 West Greeley Conservation District The proposal has been reviewed on behalf of the Weld County Department of Public Works and Department of Planning Services. Staff comments made during this phase of the application process may not be all- inclusive, as other issues may arise during the remaining application process. COMMENTS: Parcels: 096115000059, 096110400029, 096115000065, 096115000068. The project proposes to: Change of Zone from to the R-1 (Low Density Residential) Zone District to A (Agricultural) Zone District. ACCESS: Weld County Development Review has reviewed the application materials related to access. Parcel 096110400029 has existing, unpermitted access onto E 18th Street (CR 58). This appears to be Greeley #3 Ditch road that supports agricultural traffic from this parcel, as well as the other parcels in this change of zone. An access permit is required for a location that meets the Minimum Access Spacing Criteria. Parcel 096115000065 has existing access onto US 34 Business. It is noted that this portion of US 34 Business is not included in the CDOT Access Control Plan for US 34. Per Sec. 8-14-30, an Access Permit is required for access to Weld County maintained roadways. Please refer to Chapter 8 of the Weld County Code for more information regarding access. The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to state highways. Please contact CDOT to verify the access permit or for any additional requirements that may be needed. (US 34). Please include all three representatives in your request. The applicant shall delineate on the plat the future and existing right-of-way and the physical location of the road. If the right-of-way cannot be verified it shall be dedicated. Pursuant to the definition of setback in the Weld County Code Sec. 23-1-90, the required setback is measured from the future right-of-way line. Be aware that physical roadways may not be centered in the right-of-way. This road is maintained by Weld County. The property is bounded by US 34. Contact the Colorado Department of Transportation (CDOT) to determine what right-of-way shall be shown on the submitted plat. Reference the documents creating the right-of-way. Sec.23-2-230.A.4 and .240.B.4 include standards for unpaved roads providing access to parcels proposed to undergo zoning changes. Both E.18th Street and US 34 are paved roads. Thus, the assessment of these standards is not triggered. MUNICIPAL SEPARATE STORM SEWER SYSTEM (MS4): A portion of this site (i.e. the northwestern corner of parcel 096110400029) is located in a Municipal Separate Storm Sewer System (MS4) Area which may trigger specific water quality requirements or other drainage improvements. In addition to compliance with applicable Weld County regulations, the property owner is required to be compliant with any additional MS4 requirements. Questions pertaining to the MS4 requirements should be directed to the Public Works Department 970-304- 6496. CONDITIONS OF APPROVAL: The plat shall be amended to delineate the following: 1. County Road E 18th Street (CR 58) is a paved road and is designated on the Weld County Functional Classification Map (Code Ordinance 2017-01) as a collector road, which requires 80 feet of right-of-way at full buildout. Show and label the existing access point onto E. 18th Street (CR 58). Include the access type. Development Review will review all access locations as a part of the plat submittal and review process. (Development Review) DEVELOPMENT STANDARDS (NOTES ON THE PLAT) 1. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant to Chapter 15, Article I and II, of the Weld County Code. (Development Review) 2. Access on the site shall be maintained to mitigate any impacts to the public roads including damages and/or offsite tracking. (Development Review) 3. The historical flow patterns and runoff amounts will be maintained on the site. (Development Review) 4. A portion of this site is located in the MS4 area and is subject to the regulations of the state - issued MS4 Permit. (Development Review) 5. If applicable, once any permanent control measure has passed final inspection by Public Works, the site shall be routinely inspected at a frequency determined by Public Works, usually on an annual basis unless otherwise noted, for the life of the control measure. Inspections occur to ensure the permanent control measure remains fully operational and is being adequately maintained according to the site's Operation and Maintenance Plan. Upon sale of the property, the responsibility of maintaining permanent control measures shall be transferred to the new owner. The parcels will be served by the City of Greeley for water and on -site wastewater treatment systems as necessary. A water bill from the City of Greeley was included with the application. There is an existing on -site wastewater treatment system on the east side of the entrance driveway near the residential home site. The system is not documented however the applicant indicates the residence is no longer being utilized and the District plans to demolish and remove the home. We recommend the following appear as notes on the resubdivision plat: 1. Water service may be obtained from the City of Greeley. 2. The parcels are currently not served by a municipal sanitary sewer system. Sewage disposal may be by on -site wastewater treatment systems (OWTS) designed in accordance with the regulations of the Colorado Department of Public Health and Environment, Water Quality Control Division, and the Weld County Code in effect at the time of construction, repair, replacement, or modification of the system. 3. Activity or use on the surface of the ground over any part of the OWTS must be restricted to that which shall allow the system to function as designed and which shall not contribute to compaction of the soil or to structural loading detrimental to the structural integrity or capability of the component to function as designed.
