- RESOLUTION
WHEREAS, a public hearing-was held on Monday, May 8, 1972, in
the chambers of the Board of County Commissioners of Weld County,
Colorado, for the purpose of hearing the petition of Raymond P. Biros
and Wayne E. Biros, 4817 Julian Street, Denver, Colorado, requesting
approval of site for a dog kennel operation on the following described
property, to-wit:
The Southwest Quarter of, the Southeast Quarter (SW4SE-D
of Section Two (2)', Township One (1) North, Range
Sixty-six (66) West of the 6th P. M. , Weld County,
Colorado, containing 40 acres, more or less, and
- WHEREAS, the petitioners.were present, and
WHEREAS, there was no opposition to the request of petitioners
for the location of a dog kennel operation, and
•
WHEREAS, the said .requested location for a dog kennel operation
is located in an agricultural zone as set.forth by the Weld County Zoning
Resolution, and
WHEREAS, according to Section 3. 3(3) of the Zoning Resolution
of Weld County, said dog kennel operation may be authorized on the
approval of the Board of County Commissioners of Weld County, and
WHEREAS, the Board of County Commissioners heard all the
testimony and statements of those .present; has studied the request of
the petitioners and studied the recommendations of the Weld County
Planning Commission, and having been fully informed;
NOW,. THEREFORE, BE IT RESOLVED by the Board of County
• . Commissioners, that the application of Raymond P. Biros and Wayne E.
Biros, 4817 Julian Street, Denver, Colorado, to locate a dog kennel
operation on the premises indicated above be, 'and it hereby is granted
under the conditions following:
1. That any water and sanitation- facilities to be installed shall
be approved by the State Health Department.,
•
'2, That said dog kennel operation shall not contain more than
• one hundred twenty five dogs at any one time.
3. That petitioners shall proceed.with due diligence to effect
said dog kennel operation and that he, shall have up to one year from
date hereof to begin construction_of said,dog kennel operation.,
4. That petitioners shall provideadequate and proper fencing and
• that said fence shall be at least 100 feet from County Road No. 12,
5. That all applicable-subdivision and zoning regulations shall be
followed and complied with in adcordance`with the Zoning Resolutions of
Weld County, Colorado.

Tuesday , April 18 , 1972 at 3 :30 P. M. in the 4=H Building ,
Island Grove Park.

As a quorum was present , the Weld County Planning Commission was
ready to do business .
SUBJECT : Minutes
MOTION : By Mr. Watson to approve the minutes of the last regular
meeting as mailed . Second by Mr. Anderson . A unanimous vote
of "Aye" . Motion carried .
APPLICANT : Clarence Sitzman
SUBJECT : West Greeley Sanitation District Tape 421
DISCUSSION : Mr. Deyoe stated Mr. Sitzman owns property west of
Greeley and is proposing a West Greeley Sanitation District
and will open up about 600 acres that can be served . They have
been working with the City of Greeley. Mr. Sitzman stated the
City is willing to accept the sewage and the bids are out for
the engineering for the project . Mr. Sitzman stated Hilltop
Subdivision will be included in the project . This will be from
52nd Avenue east and include everything that is not served by
the Highland Hills Sanitation District. Mr. Paul stated the
Health Department is in favor of this project . Mr. Bowles
stated the Planning Commission will take the matter under ad-
visement and discuss it with the County Commissioners.

DISCUSSION : Mr. Deyoe statedMs located in dryland about 31/2 miles
east of Ft. Lupton and is recommended for approval . It is very
sparseley settled in the area . There were favorable reports from
the Health Department and Soil Conservation District. If approved
it should be subject to an adequate water supply , proper fencing
and a set-back of 100 ' instead of the normal 50' . The Biros
agreed to observe the 100 ' set-back .

ning staff and a maximum of 125 dogs . Motion by Mr. Anderson ,

DISCUSSION : Mr. Deyoe stated the land is well adapted for this use .
It is in keeping with the surrounding land use and zoning . It
has been approved by the Health Department and the Extension agent.
Application is for 100 milk cows and 50 replacement heifers .
RESOLUTION :
Be it therefore resolved to recommend approval to the Board
of County Commissioners subject to a maximum of 100 milk cows
and 50 replacement heifers . Motion by Mr. Clark , second by Mr .
Watson . A vote of "Aye" by Anderson , Bowles , Clark and Watson .

LOCATION : Sec 26 , 27 , 28 , 32, 33 , 34 , 35 T6 R67
APPEARANCE : James L . Cunningham, Hugh Burns , Clay Turk and Pete Jungst
DISCUSSION : Mr. Cunningham presented the proposed Planned Unit Develop-
ment. Mr. Cunningham stated the company ' s position was that the
exact location of the rights-of-way in question is not known at
this time and in order for the company to evaluate what the State
and the County would want to do , to impose it on the PUD at this
time , they didn ' t feel that the timing is right. Until they see
how everyone else along the line will be regarding the respective
ROW , the Company has agreed to sell this ROW at their cost, The
Company has agreed to limit it' s accesses to one access per half
mile at locations agreeable to the Highway Department. In respect
to the other items , the Company has gone along way in areas where
straight industrial zoning would certainly not have had to make
any commitment with respect to it. In respect to flood plain areas ,
they have agreed not to build structures within the 100 year flood
plain area and at this point they do not know what that is . There
is a gravel pit on the property and the Company has agreed to re-
habilitate that area and will not be used for a commercial gravel
pit. Other provisions of the PUD were reviewed by Mr. Cunningham.
Mr. Bowles asked why would Eastman Kodak not be willing to dedicate
the additional ROW that would be required of any other developer if
there are no plans to move highway 257? Mr. Cunningham stated in
meeting with the highway department there was no mention of it being
moved. There was some discussion of an interchange of some kind .
There was discussion regarding the railroad in the area . Mr. Deyoe
stated more than likely it would remain .
MOTION : By Mr. Watson to take the matter under advisement. Second by
Mr. Anderson . Mr. Deyoe explained the PUD is zoning case Z-198 ,
basically Z-194 and Z-195 were generally approved . However, there
is a letter of objection on Z-194, where the zoning is from " I " to

"S" on the eastern edge . Letter was read by Mr. Deyoe from
Mr . Walter Powers who owns property to the east stating they
felt the zoning would materialy affect the value of their land
and the use of their property would be more restricted . No
action taken on motion. Mr. Watson and Mr. Anderson withdrew
their motion .
MOTION : By Mr. Watson to take zone cases Z-193 , Z-194 and Z-195
under advisement. Mr. Anderson seconded the motion . A vote of
"Aye" by Anderson , Bowles , Clark , Heitman and Watson. Motion
carried.
APPLICANT : Tom Tobin
SUBJECT : Dedication of ROWS
LOCATION : S2 SWa Sec 14 T6 R66 tape 422
DISCUSSION : Parcels have been sold without the benefit of a sub-
division plat. 65 ' of additional. ROW was requested before the
issuance of building permits . Three recorded dedications were
presented for recommendation of acceptance to the County Com-
missioners . Mr. Deyoe stated this would make a 95 ' ROW from
the middle of the road which is highway 392.
RESOLUTION :
Be it therefore resolved to the Board of County Commissioners
to accept the deeds of the additional ROW. Motion by Mr. Heitman ,
second by Mr. Anderson. A vote of "Aye" by Anderson , Bowles , Clark
and Heitman . "Nay" by Watson . A 4 to 1 vote. Motion carried .
SUBJECT: Parcels being sold for commercial development
LOCATION : SZ SW4 Sec 23 T1 R68 - owners Boyer and Althen tape 422
DISCUSSION : Mr. Deyoe stated a parcel of this property was zoned
commercial recently. There have been other inquiries regarding
business and commercial development on this property. There is
also a nursery and 3 mobile homes in the area . Mr. Deyoe stated
they needed to look at the whole area and establish some kind of
a plan . A sign is posted on the property saying "Lots for Salc" .
A :letter will be sent to the owners regarding this .
SUBJECT : Aristocrat Ranchettes

LOCATION : Sec 26-27 T2 R66
DISCUSSION : There was discussion regarding the Planning Commission
initiating the action to rezoning Aristocrat Ranchettes from
Agriculture to Mobile Home Subdivision .
MOTION : By Mr . Heitman that the Planning Commission initiate action
to rezone Aristocrat Ranchettes to a mobile home subdivision .
Second by Mr. Watson . A vote of "Aye" from Anderson , Bowles ,
Heitman , Clark and Watson. Motion carried.
An executive meeting was held at 6 :00 P . M. in the Ebony Room of
the American Legion .

SUBJECT: Highland Hills PUD
LOCATION : Sec 15 T5 R66
SUBJECT : Zone change R - H-UD
DISCUSSION : Mr. Deyoe read a report from Mr . Lorenson requesting
permission to place the item on the next agenda . A PUD has been
prepared on the west edge of Highland Hills . The Lundvalls have
agreed to the conditions of the PUD. The opinion of the City
Attorney will allow this change to a greater density without
violating the existing covenants . The basis of this zone change
is to gain ROW on 59th Avenue. There will be 110 units on approx-
imately 13 acres .
RESOLUTION:
Be it therefore resolved to recommend approval to the Board
of County Commissioners . Motion by Mr. Heitman , second by Mr .
Anderson . A vote of "Aye" by Anderson , Bowles , Heitman , Clark
and Watson . Motion carried.
SUBJECT : Flood Plain Study
REPORT: Mr. Deyoe read a progress report from Ken R. White Co . ,
requesting one survey man from each entity to obtain bridge
profiles . Marshall Anderson suggested the contract be checked
regarding furnishing help for the survey. The County Attorney
will check it also .
SUBJECT : Regional Transportation District
Mr. Deyoe read a letter from RTD stating part of the process is eval -
uating potential new transit systems . Four new systems will be
demonstrated at. Transpo ' 72, an exposition at Dulles International
Airport.

DISCUSSION: Mr. Bowles stated he didn ' t feel there is any legal basis
for asking that they give up to 120 ' of ROW. Mr . Bowles felt if
they were asked to give a total of 100' of ROW, they would be will -
ing to agree to this request.
RESOLUTION :
Be it therefore. resolved to recommend approval to the Board of
County Commissioners for zone cases Z-193 , Z-194 and Z-195 , subject
to a total of 100 ' of ROW and agree to accept their offer to sell an
addition ROW at their raw land cost on section lines when needed.
Motion by Mr. Heitman , second by Mr. Anderson . A vote of "Aye" by
Anderson , Bowles , Clark , Heitman and Watson . Motion carried.

DISCUSSION CON`T: It was the general consensus of opinion if a good
sanitation could be formed , the formulation of a district should

Mr. Raymond Biros has requested this office to furnish'you with the soils
interpretation for an area of land in the SW3/4SE'/4 Sec 2, TIN, R66W, Weld
County, Colorado. The land in question is to be used for dog kennels
plus a home with a septic tank filter field for on site sewage disposal.
The area is mapped as deep, well drained coarse textured soil. The
area has very little runoff, if any, and is not subject to flooding.
This area has only slight limitations for homesites with septic tanks.
I would anticipate no pollution in this area from a dog kennel.
