Action of the Board Concerning Planned Unit Development Final Plan,
PUDF24-0001, for Second Filing of Beebe Draw Farms for 284 residential lots with
R-1 (Low -Density Residential) Zone District uses — REI, LLC, dba Investors, LLC
Whereas, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
Whereas, the Board of County Commissioners held a public hearing on the 20th day of
August, 2025, at the hour of 10:00 a.m., in the Chambers of the Board, for the purpose of
hearing the application of REI, LLC, dba Investors, LLC, 825 East Speer Boulevard,
Denver, Colorado 80218, requesting a Planned Unit Development Final Plan,
PUDF24-0001, for Second Filing of Beebe Draw Farms for 284 residential lots with
R-1 (Low -Density Residential) Zone District uses, on the following described real estate,
being more particularly described as follows:
All of Section 17 and parts of Sections 8, and 9; all located in
Township 3 North, Range 65 West of the 6th P.M., Weld County, Colorado
Whereas, at said hearing, the applicant was represented by Bruce O'Donnell,
825 East Speer Boulevard, Denver, Colorado 80218, and
Whereas, Section 27-3-10 of the Weld County Code provides standards for review of a
Planned Unit Development Final Plan, and
Whereas, the Board of County Commissioners heard all of the testimony and statements
of those present, studied the request of the applicant, the favorable recommendation of
the Weld County Planning Commission, and all of the exhibits and evidence presented in
this matter, and having been fully informed, finds that this request shall be denied for the
following reasons:
1. It is the opinion of the Board of County Commissioners that the applicant has not
shown compliance with Section 27-1-60 of the Weld County Code as follows:
A. Section 27-1-60.E — Criteria for approval. The PUD final plan must:
1) Be in general conformity with the Comprehensive Plan found
in Chapter 22 of this Code and any County -approved future
development plans for the area.
a. Section 22-2-30.A.2 states: "Limit the density and intensity of
development to maintain agricultural areas." The Board finds
that the proposed Final Plan does not comply with this
Section, due to the dense population that would be associated
with Filing No. 2, including additional and smaller lots, which
would significantly increase the residential density and,

therefore, does not maintain the agricultural areas in the way
it was described in the original PUDZ plan.
b. Section 22-2-30.C.2 states: "Establish residential
development options based on compatibility, proximity to
municipalities, and availability of services that reflect the
desired density and character of that location." The Board
finds that due to the lack of similarity in density to Filing No. 1,
lack of proximity to a municipality, and lack of sufficiently
necessary services, such as water and wastewater, the
application does not satisfy this criteria. Specifically, water is
a concern and there are not enough water taps available from
the Central Weld County Water District to provide each lot in
Filing No. 2 with water, as it is currently proposed.
2) Section 27-1-60.E.2 states: "Address to the satisfaction of the Board
of County Commissioners the requests and concerns of any referral
agency or mineral interest." The Board finds that the application does
not satisfy this criteria, as it does not adequately address concerns
from the referral agencies. Specifically, the comments from the Town
of Platteville regarding the impact to roads due to the extra traffic
created by the more intense development of Filing No. 2. The
applicant has not addressed how it will protect the roadways when
adding several thousand trips, per day, to the system. Additionally,
the referral response from Atmos Energy Corporation stated the
current natural gas system that serves the area is nearing, or at,
capacity and significant infrastructure would need to be built in order
to serve the new development. A plan for this was also not addressed
by the applicant.
Now, therefore, be it resolved by the Board of County Commissioners of Weld County,
Colorado, that the application of REI, LLC, dba Investors, LLC, for Planned Unit
Development Final Plan, PUD24-0001, for Second Filing of Beebe Draw Farms for 284
residential lots with R-1 (Low -Density Residential) Zone District uses, on the parcel of
land described above, be, and hereby is, denied.

The Board of County Commissioners of Weld County, Colorado, approved the above
and foregoing Resolution, on motion duly made and seconded, by the following vote on
the 20th day of August, A.D., 2025:
