HomeMy WebLinkAbout710328.tiff • RESOLUTION WHEREAS, a public hearing was held on Monday, June 14, 1971, in the chambers of the Board of County Commissioners of Weld County, Colorado, for the purpose of hearing the petition of DonaldDreyer, Route 1, Box 177, Brighton, Colorado, requesting permission for expansion of an existing cattle feed lot operation on the following descri- bed property, to-wit: A parcel of land located in the West 400 feet of the South 1600 feet of the Southeast-quarter (SE,) of Section Twenty-eight (28), Township One (1) North, Range Sixty-six (66) West and the East 400 feet of the South 1600 feet of the Southwest-quarter (SW4) of Section Twenty-eight (28), Township One (1) North, Range Sixty-six (66) West of the 6th P. M. , Weld County, Colorado, containing 29. 4 acres, more or less, and WHEREAS, the petitioner was present and represented by counsel, Melvin Dinner, and WHEREAS, there was some opposition to the request of petitioner for the expansion of an existing cattle feed lot operation, and WHEREAS, the said requested expansion of an existing cattle feed lot operation is located in an agricultural zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3(3)(c) of the Zoning Resolution of Weld County, said cattle feed lot operation or any expansion thereof may be authorized upon the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of Donald Dreyer, for expansion of an existing cattle feed lot operation on the premises indicated above be, and it hereby is granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That petitioner shall proceed with due diligence to expand said cattle feed lot operation. and that he shall have up to one year from date hereof to begin construction for the expansion thereof. 3. That when expansion of said cattle feed lot operation is com- pleted, same shall not contain more than 1500 head at any one time. 4. That petitioner shall construct a sealed retention pond and drain ditch to prevent pollution. 5. All applicable subdivision regulations and zoning regulations shall be followed and complied with in accordance with the Zoning ' Resolutions of Weld County, Colorado. Lorenson stated they are conducting an institute to which any of the members are invited . A letter was read regarding the study . . This is a research project funded by the National Science Foundation. It ' s goal . is to develop a total environmental community blueprint for migratory .and seasonal farm workers of the rural poor in the southwest. O SUBJECT: Feed lot definitions DISCUSSION : 4Mr . Lorenson presented definitions of feed lots as written by the Colorado Department of Health , by Adams County • and the Weld County existing regulations . Presented a proposed definition . • " A place of confinement for cattle , sheep and swine , corraled , penned •or otherwise caused to remain in pens or corrals where feeding is other than grazing , where the capcity is greater than 200 or more cattle , sheep or swine . " . This would fit in with the regulations for the new "A" zone. ' • It was agreed to insert 200 head of cattle , 200 hogs or 1000 sheep . This definition will be presented to the feeders be- fore being adopted . SUBJECT: Regional work program DISCUSSION : Mr. Lorenson stated the ,Planning Commission would make recommendation to the County Commissioners on which items on . .the work program be adopted . One of the items is to develop comprehensive plans around every incorporated town , these would be inserted in the county plans and then bond it together at the regional level . Larimer County feels we have to coordinate — 1' rather closely on the road plans . This is the work program • we are trying to get funding for from the State . Dated 7/21 /71 . • • 00 • • 7/20/71 668 Mr. Lorenson stated stated the applicants have presented an application for a change of zone for the multi -family area , however , the legal description has not been checked by Mr . Telep . This application will be discussed at the next Planning Commission meeting. He recommended that this case be tabled because the zoning and preliminary plat should be considered at the same time . The soils report indicates that 19 out of 31 lots pro- posed have moderate to severe limitations for home sites and and severe limitations for septic tank filter fields . Indicates soil borings should be performed . There now exists a 2 family dwelling on the site and recommended the zoning application be withheld until the violation is discontinued . The building per- mit was taken out for a single family dwelling . Recommended that a conditional contract be entered into between the develop- ers and the company supplying the water. Mr. Lorenson read a letter from the Windsor Town Council stating they are opposed to this subdivision as it is not in their Comprehensive Plan . MOTION : By Mr . Bowles to table the matter until the next meeting at which time the zone change application be considered . Second Mr . Watson . A vote of "Aye" by Heitman , Anderson , Watson , Nix and Bowles . LOCATION: W 400 ' of S 1600 ' SEa Sec 28 T1 R66 APPEARANCE: Mr . and Mrs . Dreyer DISCUSSION : Mr . Lorenson stated two members of the Planning Com- mission had investigated the site with Mr. Dreyer. A letter from the City of Brighton which stated they concured with the Brighton Planning Commission in endorsing the proposed feedlot expansion . Mr . Nix stated having viewed the area , felt that this is in a potential housing development area . Mr . Heitman stated the surrounding neighbors were under the impression at first that it meant moving the corrals of about 300 head in- stead of 1500 head . There is a petition now signed by the majority of these people opposing the proposed feedlot. Mr . Lorenson read the list of petitioners . Mr . John Willard appear- ed in opposition to the feedlot . Mr. Bowles stated the area is already fairly heavily populated . RESOLUTION : Be it therefore resolved to recommend denial to the Board of County Commissioners on the basis of what is there now. Second by Mr . Watson . A vote of "Aye" by Anderson , Watson , Nix and Bowles . Heitman abstained . Motion carried . An executive meeting of the Weld County Planning Commission was held at 6 :00 P . They plan to erect 12 buildings on the site , each building hous- ing 50 ,400 birds . The feeding , water , and egg gathering will be fully automated . Stated the manure would more than likely be removed once a week . Mr. Lorenson stated the Health Department recommended approval , also the Extension office , therefore he recommended approval . Dreyer - Melvin Dinner DISCUSSION : Mr. Lorenson recommended the application be denied , for the following reasons : Although the site could be de- veloped as a feed lot with a drain ditch and a retention pond , (sealed ) , it is within 134 miles of Brighton and in a potential growth area and feels it is more heavily populated than the areas in which feed lots are normally found . Did not feel that it is propriate . The Health Department has recommended approval 516 and the Extension office recommends approval . There is a letter from the City of Brighton which states there is no objection to the site . If the site is approved , it should i/be subject to 1500 head , a sealed retention pond and a drain .(/ditch to the retention pond . Construction should begin with- po in one year. A petition has been submitted , signed by people objecting to the feed lot . Mr . Dinner gave a resume of Mr. Dreyer ' s family and the use of the property. Mr. Dreyer explained the construction . MOTION : By Mr. Anderson to take the matter under advisement. Second by Mr . Watson . A vote of "Aye" by Anderson , Bowles , Nix , Watson and Heitman . Motion carried . MOTION : By Mr. Anderson , after further discussion , to table the matter until more information can be obtained . Second by Mr. Bowles . A unanimous vote of "Aye" by Anderson , Bowles , Nix , Watson and Heitman . Motion carried . A request for comments from the Brighton Planning Commission will be made . Mitze explained they were not -aware that they needed a permit and part of the pens are already constructed . Mr. Lorenson stated the Health Department had recommended that it be approved subject to building a lagoon , built to guide lines . A soil report was read from the' Soil Conservation Service. There was some question regarding the necessity for a lagoon for 40 head of cattle . Mr . Bowles suggested review- ing the matter when Mr. Mitze increases to 100 head . Mr . Lorenson suggested giving tentative approval and send an in- quiry to the Health Department on why they requested a lagoon . RESOLUTION : Be it therefore recommended for approval to the Board of County Commissioners subject to verification by the Health Department to their exact requirements on the lagoon , be con- structed if they say the lagoon is needed no matter what the capacity. Motion by Mr . Bowles , second by Mr. Watson . A vote of "Aye" by Anderson , Bowles , Nix , Watson and Heitman . Motion carried . Also no permanent structures to be placed within the set-back . Barton presented a preliminary plan for North- west Estates . The area would remain agriculture. The dev- opers will maintain the area . North Weld water is available . Mr. Foster stated the development would cover about 65 acres . Mr. Lorenson stated this type of_ development would be defeat- ing the purpose of the proposed regulations for agricultural ground . At this time Mr. Telep will you make the record. Mr. Telep: Thank you Mr. Chairman, Let the record show that this cause came on for a hearing this day, June 14, 1971, at 10:30 o'clock A. M. on the application of Donald Dreyer of Route 1 Box 177, Brighton, Colorado, for a Land Use Permit for a feed lot expansion located in the Southeast Quarter and part of the Southwest Quarter of Section 28, Township 1 North, Range 66 West of the 6th P. M., Weld County, Colorado, and containing 29.4 acres more or less. Let the record further show that this meeting this morning is duly advertised in the Greeley Booster on May 7th and June 4, 1971 respectively. Said legal description is described in metes and bounds and as contained in said legal publication. Let the record further show that there is on file many to the fact receipts signifying/that certified mail was sent to adjacent landowners advising them of this meeting thisrwrning giving them an opportunity to testify either in favor or against the granting of this land use permit. Let the record further show that Mr. Dreyer is here, present in person and represented by counsel Mr. Melvin Dinner. Mr. Chairman, I believe we are ready to proceed, perhaps counsel would like to make an opening statement. Mr. Anderson: At this time Mr. Dinner or Mr. Dryer would you like to make a statement. Mr. Dinner: Yes I would like to make an opening statement. For the purpose of the record Gentlemen, my name is Melvin Dinner, I am an Attorney at Law and my Offices are located 300 First National Bank Building, Greeley, Colorado. I am here representing the applicant Donald M. Dreyer, Route 1, Box 177, Brighton, Colorado. May I say first of all that I welcome this opportunity of presenting this information to the Board of County Commissioners r •.� :• 2 Lc'-, use Penult on behalf of Mr. Dreyer. A few things are very essential and very important for the basic understarding of this matter. I think we need to recognize number (1) that this is an "A" Zoning matter. The property on which Mr. Dreyer is concerned about is property which he owns located totally and solely within an agricultural zoning area. Now I mention this because we are not here today requesting the rezoning - that is not the purpose of our appearance here today. We are not here to present any change in classification but we are simply asking that the Board of County Commissioners allow Mr. Dreyer to continue the useage of his property. In effect in the same manner that it has been utilized by the Dreyer Family since before the turn of the century, which is an agricultural use. Now I think it is rather important to recognize the Dreyer Family has owned portions of this property since before 1900, as a matter of fact, Mr. Dreyer's grandfather, Herman Dreyer, obtained a patent to this property back on April 3, 1893. This was the Southwest Quarter of the Section 28, Township 1, North, Range 66 West. An additional 80 acres the West Half of the Southeast Quarter of this Section 28 was acquired in 1902 - so that it isn't as if this was something that was just recently occured or somebody who just recently purchased the property and said this would make a nice layout, for a feed lot. This is something which has occured and utilized by the Dreyer Family now - well in effect for over 70 some years. Now the whole waste that we refer to here - this which acerage - is shown on the zoning map/is a copy of the USGS map utilized by our Planning Commission for zoning purposes, which is blown up to demonstrate and visualize the area involved. This area is demonstrated by a red marking pencil - I assume it is visible to both of you - and you can see it - is that correct? You can follow my diagram. The exterior or - the interior red line - covers approximately 312 acres is the Dreyer Farm. As I indicated it was orginally acquired by Ur, Dreyer'a grandparents and in due course of time it was acquired by his parents. In 1964,. January 20, 1964 51 Mr. Dinners to be exact, Mr. Dreyer at that time proceeded with the conveyance of this property and has been utilizing, and farming the property since. Now please keep in mind they have farmed and used the property long before that time but this is when he in fact became the title owner of the property in question. Now out of the 312 acres approximately, 130 acres is dryland the balance is irrigated crop land - say 140 actual crop acres that are involved. Now the ground where the feedlot is actually pasture ground we are not deluding the so called crop or irrigated acerage in any way. I think it is also important that you also recognize that the feedlot which will be located is outlined on this map in the blue line. Now there are existing feedlots actually there are two of them which are now located on the premises. one There are/- perhaps it would be best if I pointed them out. This of course is the 312 acres that I referred to. The existing feedlot is located in approximately this area, very close in here to the highway - the county road. Since the time of this particular map was prepared I might mention that there is this lake here and the road now goes straight across. Mr. Dreyer still owns this little piece along the south and the road does go straight across. There is another feedlot which is basically more or less just for temporary use at, times but is utilized by him just to the east of this little lake. The proposed extension of the feedlot would be in this area here outlined in blue. Now that is not drawn to scale but simply for the purpose of presenting --it sematically where in fact the proposed feedlot would be located. Now basically another thing, which I might indicate, which is of relative importance is the location - topographically of the newly proposed feedlot, because if it were sitting on the other side of the hill with excellent drainage going down hill in a northerly direction. We will into this more later.. 1) 4 C.�.. _v,.� .... . Mr.Dinner: with discussion concerning design and construction of the feedlot particularly with reference to the design work which is done by the Soil Conservation Service in that regard, to provide retention ponds etc for the feedlot which make it such an ideally suited location. Now as I said there are exisitingfeedlots here - now this one here does not have a cement apron water - water has to be pumped out of the lake to provide water for the purpose of providing adequate water supply, for the cattle. In this particular pen - the other coral - this is 125 by 175 in demension and is one large coral I suppose I would say it is probably of the style or desing of what we would think was of some of the older style corals that were built in the county many years ago. Thus lacking any of the many of the efficient and suitable features which are now being designed into feedlot construction and features which are being placed into the newly designed feedlot. As an example the existing feedlot does not have the retention pond arrangement that holds for the newly designed feedlot. There is only a short concrete or cement apron designed for the old feedlot and in the new one there would be somewhere between 10 to 12 feet of concrete apron provided for better conservation practices in feedlot control. So that there are a great many of these factors and some of those as I said we will go into further detail as we go along. Now with regards to the location of the farm itself as you are probably are from aware/the description which Mr. Telep gave you a moment ago in giving you this information you are in what is described the south end of the County and I hold this other map here just simply to indicate on the - red marking its proxsimity to it location of the County map. You can see we lie fairly south in terms of its location of its County location. It is approximatdy three miles from the Town of Brighton. as Now it becomes rather elementary to our problem/to the location of the existing lot with present housing and the existance of housing with regard to the proposed and planned feedlot expansion here. I think that this is quite important of course to your concern here this morning. If we follow a circle of 660 feet from the existing 52 V Mr. Dinner; feedlot we find that there are approximately 5 residences located within that concentric circle. Mr. Dreyer's own home, a home owned by his father, Mr. Frank Dreyer and residence owned by Delventhal (Keith), August Delventhal, and a fifth one owned by a Martin Miller. This is apparently within 660 feet of the old coral as it now exists. Within the concentric circle of 660 of the newly proposed one there is no housing of any kind located within that area. We have to go a total plan or distance of of approximately 1600 feet from the newly proposed/feedlot expansion before we can touch any housing of any kind. The housing is then touched at that circle point - I mean at that point on the circle is housing of course which is utilized, as I understand it, within connection with other housing areas. Now I think I should point out a number of reasons why Mr. Dreyer is concerned about the construction of this new planned feedlot and the expansion of the existing lot to this location. It is quite apparent with our concern today in terms of conservation practices, our concern with pollution control, our concern with economic conditions, our concern with better marketing facilities, our concern with efficiency as a matter of fact and all of these things dictate to Mr. Dreyer the reason for the establishment of this new feedlot at this location as indicated on the map. It would provide here again a much more efficient and much more useable location from the present location which is being utilized. It will provide him with a greater ability and stability with the use of his feed supply. I need to take a moment to point out now being also that there are approximately five family farms which are/utilized in the Dreyer enterprise of which there are something around 1300 and total some acres/which comprise the five farming units - 620 acres as I understand it - is that correct Mr. Dreyer - are utilized for irrigated crop production. At the present time he finds that he has excess feed supply by way of alfalfa U or hay an to some extent ensilage at various times. This would provide a far greater efficiency and a far., greater economical program to his farming enterprise to be able to utilize all of his supplies in his feeding program. It would also provide him the ability to utilize newer techniques and procedures such as, scales, weighing the feed supply, and proper and more direct ration control, in the newly designed feedlot. Also there is another factor the family program. As [ indicated a moment ago the Dreyer program here has been a family program since the turn of the century. Up until about 1926 it was utilized as a dairy operation, from 1926 on cattle in terms of a fed cattle - or feeding cattle program has been the goal or the object and what has been carried on as a part of the Dreyer farming enterprise. Mr. Dreyer has three sons it is his intention and he hopes at least two and possibly three of his children will eventually follow him in to the farming and feeding program and as of the present time at least two of them are prepared to enter into this program, participating with him. This would provide a far better drainage arrangement than what now exists with the existing lot near the house and certainly a fare better program than what exists in that other feedlot only used on a temporary basis. It would remove the feedlot in effect from all the existing housing within the 660 foot circle or radius. Now I am just going to comment briefly with regards to design and construction - Mr. Dreyer has maps here that were prepared already by Soil Conservation Service. I believe some of these maps have/been made available to you. :These maps were made available to the Weld County Planning Commission and I am going to let him describe them. I will simply say that there are 9 pens which are planned- five of which are smaller and four of which are larger. With regards to capacity we are talking about 1500 head. We are not talking about some gigantic giant operation. That is not what is intended, that is not what is planned, that is not what has been designed. Now I think we need to recognize a feedlot program of 1500 head of cattle is certainly in our way of thinking in this area and this part of the country is basically is a very small operation. Now there are very many economic factors I think that should be considered also by the Board of County Commissioners with regards to the granting of this application. At the present time Mr. Dreyer has either full time or part time - four people employed in this operation. If this feedlot expansion program goes through it will provide additional employment for a number of other individuals it will also provide a means of employment for at least two and possibly three of his children. It will also without any doubt increase the tax base of this property because of the construction - the improvements on this property because this is ground which is now utilized only as pasture ground and is assessed as such. It will provide a ready and suitable market for many other farmers in the area to provide additional feed supplies for the utilization in the Dreyer feeding. In addition the increase in terms of the capacity of the 1500 head feedlot as against 300 head feedlot which is now being utilized. It will also provide additional inventory and additional personal property tax to the county. All of which, of course, are extremely important and very vital to this county. Lets move on to the next step in the file should appear as I recall, a letter from the Mayor of the Town of Brighton. This. was a letter which was received by the Weld County Planning Commission. Mr. Telep is that letter in the file? Mr. Telep: I don't see it - I don't see it Mr. Chairman - yes it is in the file. Mr. Dinner: As I recall there should be a letter which appears - may I see that a moment - May I make a correction - I said the Town of Brighton may I correct that to read the City of Brighton - if I may read into the record I would like to read this letter of April 12, 1971. "April 12, 1971, Weld County Planning Commission, Weld County Services Building, Greeley, Colorado, 80631. Gentlemen: The City of Brighton Planning Commission again reviewed, on March 23, the request before your Planning Commission of Mr. Don Dreyer to reclocate his present- feedlots slightly to the northeast. The matter was also reviewed by the City Council at their regular meeting on A.pztl 6, 1971. I �3 �r The City Council concurs with the findings of the Planning Commission as follows: (1) Area is presently zoned agricultural: (2) Location is presently being used as a cattle feeding area. (3) There are existing dairies to the north and south (4) A permit was recently issued for a slaughter house to the east. (5) There are other compatible uses in the area withing- 12 miles, more or less, such as turkey farms. (6) Applicant has indicated a maximum capacity of 1500 head on a five year land use permit. In view of the above, it appears that Mr. Dreyer's proposed feedlot permit is presently compatible with the existing area land use. The City Council has also endorsed the recommendations of the Brighton Planning Commission, April 6, 1971. Yours truly, Kenneth Mitchell, Mayor and Mayo Hottman, Chairman, Brighton Planning Commission." And then the letter is then signed individually by both Kenneth Mitchell and Mayo Hottman. I particularly call your attention to this letter then which was received on April 13, 1971 by the Weld County Planning Commission. that I think it is also important to point out,/existing in the files there should also be a letter from the Health Department which has also given its approval to this site, for this location and to the construction of the feedlot as proposed and as outlined at this hearing. In addition I also wish to indicate that the Soil Conservation Service, which is an arm of the Federal Government, has spent considerable time and effort in the planning, design and the over-all consideration of the constuction of this feedlot in the area involved and as you will see the plans which they have proposed - in fact I would say that I am extremely pleased with - find it to .- be rather •comendable in terms of what they are providing to us in terms of the feedlot construction design - in terms of handling(' problems in conservation, handling problems in drainage, handling 4!€€' problems of pollution because all of these items have throughly covered by the Soil Conservation Report. Now many of the things which were indicated in the letter by the Mayor of the City of Brighton are also quite apparent to you gentlemen as County Commissioners of this County - this is a - this area now and for a good many years in the past and in Weld County - has been one of the leading livestock counties in the entire United States. Something instead of being ashamed or disturbed about something we should toot our horn about and to be very proud about. And to this extent the major influencing role of our agricultural area our agricultural community is our feedlots and the cattle production which occurs in this County. I don't think we have to take a back seat to anybody. What Mr. Dreyer has in mind is fundamentallalong these lines. Lets take a moment to examine what the exisitng zoning is in the area. If I may I would like to make reference to this map which appears on the board. It is quite apparent that there is no existing subdivision within the immediate area. We have to move down to this bottom part of the map to locate any portion of any subdivision. Way over here to locate any portion of any subdivision. All of you are familiar with the Kitayama Greenhouse location which is to the west over here. There are a number of existing feedlots, the Mancini Feed Lot and also the feedlot of the National Foods which lies down here on U. S. #85. This is not an area in which feedlots are unknown or unheard of. I might just mention also with regard to the matter of the drainage of pens that they flow apparently in this direction moving across in the area where the feedlot when they cross the area where the feedlot would be concerned. Within the past few weeks we have spent some time talking with Mr. Lorensen about another project totally distinct and totally different from this. Based upon the information which Mr. Lorensen gave me it is my understanding that within "A" that is agricultural zone it is the intention eventually to have zoned not less than 20 acres tracts within an agricultural zone. su Donald Dreyer Land Use Permit I think it is also importarttto point out that there is no water district - that is a domestic water district in this particular area. With regards to water supplies the purpose of making water available for these feed lots - tests have been run that provide that a shallow well is available to supply the water for the supplying supplies in terms of euppiy the feedlot in question. In connection with that matter there are soil tests that were made, ground control and they said they had to know that the water was at least 16 feet. They went down over 20 feet and no water was located in terms water table level to create any problem. As I indicated a moment ago there is no domestic water district within this area. Likewise there is no immediate sanitation district in this area. Now all of these factors would seriously prohibit any so called questionable subdivision grcwthor development within the area itself. Also based upon comments made to me by Mr. Lorensen it would appear that the County would be requiring that any so called subdivider would have to hard surface the road within the subdivision to the extent that they would have to meet the County specifications. All of this being very expensive for any potential subdivider. If we are going, to remain with this so called 20 acre pattern this would virtually make it prohibitative for somebody to consider a so called development subdivision/within the area. I think it behooves us to say that this is agricultural land, this is what the ground had always been used for . This is what it is now designed for and this is exactly what Mr. Dreyer has in mind use with regards to his `future and the future/of the property. Under these circumstances it seems to me in view of the Health Departments recommendation, in view of the design plans of the Soil Conservation Service, in view of the fact that the City of Brighton has indicated that they have no objection to this particular situation it seems logical that the only conclusion that anyone can come to ,is that this petition should be granted. Now I would like to have Mr. Dreyer go ahead and proceed and explain in detail to you so that if you have any questions concerning the actual feedlot construction programs he can give it to you. Don. 46 Mr. Dreyer: Do you have a copy of this County map? Well first of all Melvin didn't really leave me much to say. The feedlot - that was designed is on the topo map that you have of the retention ponds. The scale house and the scales - where that will be located is in the working area. The elevation is 112 on that and at the base of the retention pond it is 30 feet less or abour 82. So we have got 30 feet of fall and the ground - the reason this spot was picked was the ground slopes toward the middle from both sides. I can put cement aprons on the outside and the water - drain will run - will run more or less to the alley and from the alley-way to the retention pond. The Soil Conservation in designing this thing - they eliminated one pen that we did have in the design. The pit silo will be here which will be cemented and then there is a cement pad here at this point and the elevation of the cement pad is 12 feet higher than the bottom of the pit silo and the elevation of the ground above is 6 feet above the cement pad. I can dump trucks off onto the cement pad because I will utilize my elevator down at the - where it is at now. Then I will haul feed up and dump it - maybe a 2 days supply or a one day supply on the cement pad and at this point I am going to put a mixer on a Hopper scale and it will drop out the bottom to a feeder truck which will go into the feed bunks. Then with a small tractor with the cement wall with the way it is designed I can raise the feed probably three feet into the mixer and the truck will pick it up underneath and I can do - by making use of the hill I don't need any big equipment. There is going to be a lot of cement involved but with a - this is a map of more or less of the working area, scales on top of the hill, the scale house, this all drains towards the road this point is about 600 feet from the road. At this point the ground breaks and everything goes to the back to the north. So all the drainage r— will be to the north. Here is the pens and the water the water supply and that is pen construction, this is the cement pad it will be approximately 50 by 50 or something like that and then there will be a six inch drop here onto the pad, the dial scale you can read from the tractor, you dump into this hopper ti-, t is on the scales and after the batch is mixed it drops onto the feeder truck from there into the feed hunk . , ,�� 14 Li Mr. Dreyer: I think you have the map on the retention pond and the reason I came back to this point - I orginally wanted to go out on another farm east of Brighton but the Soil Conservation wouldn't approve that because there is a live stream running through and it would be polluting the water ways. The present corral drains into the Fulton Ditch and we are not - and very soon the pollution is going to get serious and they are going to stop that and the only thing to do is to find someplace that is compatible with their regulations. Mr. Ashley: Would you close down the other two pens Don ? Mr. Drever: I had a shed at the - I have a long cement shed at the barn and I intend to raise - I have a few small dairy calves to utilize that shed but as far as feeding cattle and big cattle there will never be a manure problem or in that corral down at the house. The one up at the lake will probably be eliminated altogether. Mr. Ashley: What do you use for water now? Mr. Dreyer: The new lot will have a well. We dug a test hole and there is water. Mr. Ashley: Is it good enough water? Mr. Dreyer: Yes it appears to be. Mr. Ashley: What do you use now the lake for water. Mr. Dreyer: Right now we are using - we are pumping out of one corral - we pump out of the lake into a tin water trough. Down below we use a seepage water and the system the way it was designed the water trought is at the bottom of the corral and always, the drainage from the rain run•.down to the water trough so consequently you have just got a bog hole down next to the corral creating an odor problem and the present corral down at the front or down below is 100 feedbunkd or 190 feet from my nearest neighbor. When it starts moving in a rainy spring it gets to be a problem and we discussed the matter four years ago and I indicated that I would do something about it and now I am trying to move it. We have a total of 13 houses - 13 families within 1750 foot radius of the 4. Mr. Dreyer: present corral down below. It is very heavily populated. Mr. Ashley: What do you use for water in your home? Mr. Dreyer: In my home? Mr. Ashley: Yes. Mr. Dreyer: I have a deep well. All the whole area is deep wells Mr. Ashley: That is what all the neighbors have. Mr. Dreyer: The whole area is all individual wells. There is no water district or no central supply of water. Mr. Dinner: I am more than happy at this time gentlemen if you wish to answer any further inquiries that you may have. I am sure Mr. Dreyer is likewise to answer questions. Mr. Anderson: At this time Mr. Dinner do you have anyone in support of this application that you would like to put on at this time? We will take the application first then you will have a chance to sum it up if you care to. Mr. Dinner: We have some others present but I don't feel it necessary • that they add any further comments at this point. Mr. Anderson: Alright at this time is there anyone in this room who has an objection to this application? If you would - would you please come forward and you can use this chair over here and we would like for you to state your name and address for the record we are on tape. So at this time is there anyone in the room who would like to speak against this application? Keith Delventhal: I have an additional list of names - I own the place right adjacent to Dreyers farm. The thing I am mainly concerned about is as it was brought out before all the feedlot we have around in the area now. It seems like anytime that anybody has visited us or anything why they say how do you stand it around here? Or if my kids say some night we are coming home and they are asleep in the back seat and they wake up - they say Dad I know we are close to home I can smell it. t mile 8 a hal: We have a feedlot a mile to the west of us, we've got a feedlot/to west the north/of us and there is another big one expanding a mile and a half to the north of us and now we seem to be getting one to the northeast of 43 Iti Mr. Delventahl: us and that make, us completely surrounded all except for one direction. As it stand now Dreyer's present feedlot is real close to my place in fact it is less than 200 feet from Dad's house, which I own, and as my Dad stated we put up with 30 or 40 years why we are 70 now we can put up with it, rather than start and enlarging a bigger operation. I think we have to' be concerned about - is how many people actually live in this area. It was stated that it was an agricultural area but it is a lot of little farms and I think we are going to have to finally put a limit as to how many people as we can get around in the area. We are just getting so surrounded that in the evening any more you have to keep your house closed up so you can breath. I've got a list of names on the petition I think that there are some other petitions and I think that everybody that lives within a mile and a half have signed it and I would like to submit this in addition to the rest of these. Mr. Anderson: Mark that as opposition number 1, Gil. Mr. Telep: Did you circulate this petition? Mr. Delventhal: I circulated this particular one. Mr. Telep: How many names do you have on there? Mr. Delventhal: Twelve names. Mr. Telep: Twelve names against this application. Mr. Delventhal: Yes, as it states here. Mr. Telep: I see. You have seen these people sign this petition. Mr. Dinner: Yes, Mr. Delventhal, your concern is basically with an odor problem from the existing feedlots - not the Dreyer Feed Lot is that correct? Mr. Delventhal: Well as I say - this Dreyer Feed Lot will be an expansion he is currently feeding---- Mr. Dinner: Yes but what you are complaining about is an existing situation that which you are referring to as the Mancini Lot and the 42 Donald Dreyer 15 1 Land Use Permit Mr. Dinner: and the National Tea Lot, is that correct? Mr. Delventhal: And then the big one north of us. Mr. Dinner: Right. So you are really complaining about another situation and somebody elses property rather than the Dreyer situation - isn't that correct? Mr. Delventhal: Well what I am complaining about is that we don't need another big feed lot - but I am real concerned Mr. Dinner: Do you classify the Dreyer feedlot in the same capacity with lots which are now operated by National Tea and the Mancini Estate? Mr. Delventhal: No I don't. Mr. Dinner: Alright, it is quite apparent that it isn't the same classification is it? Mr. Delventhal: You put me in a very difficult situation because Don is a good friend of mine and I live right next to him and I - I want to remain friends - the thing I am concerned about - this thing could be put in and the place could be sold could be sold and it could be expanded and we don't need anymore expansion. Mr. Dinner: Before he does that - in order to get any further expansion it will require somebody else - whether it is Mr. Dreyer or someone else to come in and request such expansion - isn't that correct. Mr. Delventhal: Well he is requesting an expansion. Mr. Dinner: Right - but I am talking about the expansion beyond the amount that is requested with 1500 head. Mr. Delventhal: Well this is an expansion from what he had. Mr. Dinner: Yes, you missed thepoint - you were saying you were fearful: about what may occur in the future and that is what your fear is based upon not the construction of the 1500 head. Mr. Delventhal: No if we could have some guarantee that it wouldn't be any bigger than 1500 head why I am all for getting it out in front of my door. 41 su _ (1 It Mr. Dinner: Then what you are really saying/is that the guilt by association. In other words the other feedlot in the area that you are concerned about. Mr. Delventhal: Yes why add another one. Mr. Dinner: I have no particular questions of this particular witness. Mr. Dinner: May I ask also Mr. Delventhal what is the acerage you live on? Mr. Delventhal: You mean where it is located? Mr. Dinner: No the number of acres. Mr. Delventhal: I've got about 220 . Mr. Dinner: Is this all devoted to agricultural use? Mr. Delventhal: It is. Mr. Dinner: And do you have livestock Mr. Delventhal: Yes. Mr. Dinner: What type of livestock? Mr. Delventhal: I have a dairy farm. Mr. Dinner: How many head? Mr. Delventhal: I• have 30 head. Mr. Dinner: So you have mutual problems of conservation, drainage, pollution control, etc with regards to your area. • Mr. Delventhal: Right, but my dairy head is in a big corral with 30 head so there is really no problem. Mr. Dinner: tut you still have,the same identical problems. Mr. Delventhal: But the dairy association is so tight on the regulations on that - that if there is one puddle in the corral you have got to fix it or you don't ship milk. That is the way it is set up. 40 17 i.au Mr. Drever: With this much fall '' on the hill you might say that I will have a feedlot that will meet dairy specifications. Mr. Ashlev: Don, how many cattle do you feed now? Mr. Dreyer: It runs from 700 to 900 a year. Mr. Ashlev: At any one time what is its capacity? Mr. Drever: The total capacity on all the farms is about 1200. But they are seven miles apart and this just isn't working out. We got duplication of loaders, feeder boxes and if you have a big snow you've got problems maybe you can get to part of them but 'you can't get all of them. Mr. Ashlev: You would centralize all your operation to this one lot is that correct? Mr. Drever: Basically, yes, we have got our grass out east and we continue to run that corral out east in Adams County that the - we will keep that corral. The feeding of cattle is going to be centrally located here with the scales and equipment to handle them. The chutes to work cattle with and get away from so much - well get away from a lot of baling wire you might say. The present lot was remodled in - I don't know when it was built but it was remodeled, in 1939 and it is time to do something else with it again. And with the water trough at the bottom of the corral and all the drainage running down to that - that way - the drainage runs into the Fulton Ditch which is less that 100 feet away. It is an easy way to get rid of it as long as you can do it. But some day they are going to shut that off too. I want to get away from this water at the bottom of the corral. The cattle have to wade through water to get to the water trough well that not for good management practices. Mr. Anderson: I have a question would you rather the situation remain as it is or would you rather have it cleaned up and get it out of your front yard? Mr. Delventhal: The situation in the front yard - no I don't like this 1 ib \1(/ Mr. Delventhal: The thing that I am concerned about is the fact that fine this is - sure Mr. Dreyer is going to keep 1500 head/but - in fact Mr. Dreyer mentioned that himself that this place was going to be ok for sale. What is stopping him from saying/here is a good start and another feedlot moving in and eipanding it. It happened just north of us the O'Day Lots, I drove by there the other day and I so can see they are doubling the size of it. You get/surrounded by feedlots that you finally think I should just sell out and get away from it. Mr. Dreyer: I think he has mentioned the places for sale I think the neighbors have some ground for sale and it is a $2000.00 an acre and at that price I think I would sell the 280 acres. Mr. Anderson: Do you have anything else? Is there anyone else in the room who has any opposition to this application? James I Massey: I am part owner in the place right on the — adjoining on the east. Mr. Anderson: Would you give your name and address please. Mr. Massey: Howard A. Massey, brother of Jim. And I kind of go along with Keith, we have feedlots around there now and to add to them doesn't make it any better. If he gets a feedlot in there and say he does sell well he has to get a permit to expand, whoever buys it or something, but he has already established - you are going a feedlot to say well your already established/here - he want another 1500 to 2000 head added onto his herd, so you already have the smell and stuff there and I say there he is building up quite a bit and you are talking about no houses or something at the end of 1600 or 1700 feet. But 1500 head of cattle smell a little farther than that. And over on the south the County line there - there is probably 30 houses within a mile that have built up in the last few years. I think the area is lot better myself - to change up to residential rather than putting in something like this. One thing it will devalue your property - I mean one feed yard will be getting another one I mean what can you put in next to a feed yard but another feed yard. Jy Mr. Its like Don, I don't know, that dryland of his is like mine I have 80 acres that I live on next to him and 160 over there. For farming you can't make a living off of it---- Mr. Telep: Mr. Chairman - just to set the record straight we don't know who is doing the talking here. One time we have - which Massey are you Mr. Massey: James. Mr. Telep: And you are which one are you? Mr. Massey: Howard. Mr. Telep: It has been established that you live adjacent to the subject property on the east is that correct? Mr. Massey: I do not live there - I own it - we own it Mr. Telep: Where do you live? Mr. Massey: I live a mile north, my folks live adjacent to it Mr. Telep: Fine we are just trying to establish that. Now who are you sir and where do you live? Mr. Massey(Howard): I live in Lakewood, Colorado, but I am part-owner there are four boys who own the property. Mr. Telep: Alright I see, but you live in Lakewood, now who want to continue to do the talking and when he gets through then we will get the other one and if necessary I think Mr. Dinner would like to ask a few questions on examination Mr.. Massey: Alright I will finish this one statement - as far as making aliving off what Dons got there - his dryland or mine you can't hardly do it anymore. If he gets a feedlot then all my place is good for is a feedlot too. I mean if you wanted to try and find someone to put a feedlot in there. How deep is that well that you have to put down Don? Mr. Dreyer: Sixty-two feet Mr. Massey: Sixty-two - is it drawing all the water from down there or do they perforating from getting water up higher? tv-i) LV Nr. Dreyer: The water came up from 42 feet from the top of the ground. Mr..Massev: You have a pretty shallow well there and I don't know where you drill is going to have any effect on your water for when you start pumping up/that new cattle water. Mr. Dreyer: Well I don't know its - the well site is probably 1800 feet from where it is now. Mr. Massey: I don't know where that is. The only thing I would say is to put another feedlot purchasing the ground or anything like that - with the ground priced at 1,500.00 per acre or whatever the price is - we don't know what the price is. We are just picking these figures out of the blue but I am• sure that National Foods wouldn't move just one mile to eliminate the problem. And I am sure they would look for ground around two or three hundred dollars an acre that was closer to their feed supplies than they have now and so I am almost positive you wouldn't get an lookers for that as a feedlot. Mr. Anderson: One question that hasn't been brought out here Don approximately how much are you of this feed are you going to be able to produce 50 percent, 30 percent or 10 - roughage? Mr. Dreyer: I will probably be able to produce about 60 percent of the roughage. Do you own all these cattle Don or do you feed them out for anyone? Mr. Dreyer: I haven't any partners of any kind. Mr. Massey: Do you do any contract feeding then' - will put it that way Mr. Dreyer: Well I haven't got into the thing yet - up to this point CHANGE TAPES uonaiu ureyer 21 .ana use rt i,p, L Mr. Dreyer: At the present time I am feeding all my own cattle and I don't have any partners in mind but at the same time if I am fixed up this way and a rancher came to me; or Ron Heitman or anybody came to me or you came to me and I have 50 cattle I would like - would you take and feed them for me - why I could weight the exact feed they eat everyday and charge you a yardage fee of so many cents a day - 6 -7 cents a day - I am not going to turn down a chance to make a dollar. like Audience: What I was wondering/if you were say that someone was furnishing a whole bunch of cattle - you say I will feed them for you. Mr. Dreyer: Regardless of what - if I can build a feedlot and keep it full I am not building a feedlot to let them set around. Regardless of who owns the battle. Audience: The way I look at it though if you build a feedlot out there and say feed for Farrs or something it is more of a commercial operation than going into agricultural for yourself. Mr. Anderson: Lets stick to the facts on this we have a tape here and it all has to be transcribed state your problem or your objections and we will continue with the hearing. So if you have some facts facts of we are getting beyond the point of/this hearing. So if you will state your facts why you are against it. Audience: I can't add much to that like I said before this will devalue the property out there in case you ever want to subdivide or whatever you might want to put - it isn't - you can't make a living on agriculture this dryland so it will have to be put to some use later on. Another thing I was wondering about if and when this feedlot might be built if there might be anything done screening the place with trees or anything or what about the feed. This ground feed it blows, when they get a windstorm, its an air pollutant along with we the odor that/have. I was wondering if there had been provisions put in there for this or rather it is going to be a wet feed or whatever 6" LL 1 ((y,e j or if you are going to stockpile a lot of it. I know a lot of times they will grind feed and pile it on a pile its subject to winds blows, its all over the place. Mr. Dreyer: This feed supply is going to be in this, I will call it a basement, which the cement pad is going to be about 6 to 8 feet depending upon how the elev;ttions work out below the level of the ground to get away from the blowing and to get away from the wind. The silage will be in the pit and 6ts for the trees the retention pond is lined with trees on the north, along the Brighton Lateral Ditch and there are already 210 trees planted on the south side. They were planted this spring I don't know how many are they are already - they are Ponderosa Pine and they teen are six/feet apart and the rows are about twenty-four feet apart. Mr. Anderson: Are there anymore questions? Do you have anything else? Do you have and questions on these Mel? Mr. Dinner: Mr. Massey, Howard Massey, what is your occupation? Mr. Massey: I make the at the Geological Survey not Mr. Dinner: May I inquire then you do/live on this property or nearby. You are only concerned in the way of being an owner as to the potential problems of the ability to make an investment by the way of a subdivision at some future date, is that correct? Mr. Massey: That and I might retire and live on the place. Mr. Dinner: And to this extent do you think it would be an economical to subdivide today into 20 acre tracts on your property having to put in hard surfaced county roads, providing domestic water supply and providing sanitation systems or sewer systems. Mr. Massey: This is - is this set for 20 acres now? that only applies to two I was thinking Mr. Dinner: Right, that is the problem we are dealing with based be upon a 20 acre tractage it would/economical. Mr. Massey: I don't know they are selling 10 acre tracts out there 34 Donald Dreyer 23 r_/and Use Permit Mr. Dinner: I am talking about 20 acre tracts. Mr. Massey: Ya, I think it would. Mr. Dinner: Do you have anything to support that? Mr. Massey: Notnecessarily - no - except land values. Mr. Dinner: You are not a real estate broker? Mr. Dinner: And you are soley concerned with the potential subdivision on this property - is that right? Mr. Massey: I live there also within a mile of the place - of the feedlot. I am more concerned with where I live than any other part of it. Mr. Dinner: I have no further questions. Mr. Anderson: Is there anyone else in opposition to this application? Mr. Laws: My name is Robert Laws of Route 2 Box47 Fort Lupton May I use your maps up here. Mr. Dinner: You surely can. Mr. Telep: Mr. Laws we would like to establish where you live from the location? Mr. Laws: East from the subject property. This isny house up here - right here - this is my house right here. Mr. Telep: What would that be about a mile and a half. Donald Dreyer 24 ' Land Use Permit Mr. Laws: About three quarters of a mile. Mr. Telep: Oh about three quarters. Mr. Laws: This is a half of a mile from here to here. I object to a feedlot there for the same reason that these other people have objected I think it would be primarily odor objection. The existing feedlot are an odor problem. We would hope that National and Mancini Lots for the future were eliminated because of the pollution problem, hopefully if they are eliminated we would be rid of a problem we don't want another problem added. These people have already stated that we don't believe that it would be maintained as a 1500 head lot We think that in the near future it would request permission to expand to a large commercial operation. This is indicated in the economic situation with Mr. Dreyers attorney stresses it. If a 1500 head lot is more economical than a 300 foot why then a 15,000 foot head lot is more economical than a 1500. We don't want a feedlot to go in there. We think that the area is better suited to residential as Mr. Massey says. We think that that is the way it will go. It already is - the attorney uses 660 feet - what is 660 feet with a feedlot - nothin. This is residential - these are expensive residences in here. He said that the prevailing winds are this way. That is all I have to say. Mr. Telep: Do you have any questions to ask him Mr. Dinner? Mr. Dinner: What is your occupation? Mr. Laws: My present occupation is a commercial pilot. Mr. Dinner: Your a pilot for United Airlines, is that correct? Mr. Laws: Correct. Mr. Dinner: You enjoy the country living out in the country? Mr. Laws: I do. Mr. Dinner: And out in the country is where crops and cattle are raised and feed isn't that correct? - LJ Mr. Laws: That is correct. Mr. Dinner: And those are the natural results of agricultural zoning and agricultural ground, isn't that correct? Mr. Laws: Thats correct. Mr. Dinner: I have no further questions. Mr. Laws: May I ask a questiontof you? Mr. Dinner: I am not on trial your honor. Mr. Telex: No he is counsel sir. Mr. Laws this is an administrative hearing and we stick as close as we can to our rules of civil procedure and anytime you come and testify before the Board of County Commissioners what they are trying to do is to acertain from the facts as to who is in favor of this feedlot expansion and who is against it and for what reason. And anytime you come to testify and you give your reasons you are subject to cross examination which is exactly what happened. Mr. Laws: I am going to make one further statement. I think that and this is just my opinion that the time has past when an individual and farmers have prided themselves in being individuals - independent individuals - regardless of the number of years that you have been at a farm that they can operate in opposition to a majority of the people that are nearby. Mr. Drever: (?) May I say one thing in regards to the question, I think it is going to be a big feedlot and I am having to assume more responsibility up in the Fort Collins area I am not going to have the time to run a big feedlot and I have no intention of it being that sir. But - I mean you have got to take my word for it. Mr. Anderson: Alright, is there anyone else in opposition to this application. Mr. Heitman: I am Ron Heitman of Route 2 Box 43, Fort Lupton, Colorado, I own the property - my brother and I own the property directly adjacent south of Mr. Dreyer. My wife's folks and us own another piece of property to the west which also lies adjacent to this. I am opposed to as a large of operation that is being. considered. Mr. Heitman: I have mixed emotions about it. I think that the people in the area who are adjacent to the existing lot need some relief there but I don't think that we need the expansion of the 5 or 6 times the operation that is there. There hasn't been cattle in that lot for nearly 2 years and so its not the problem then four prevailing that it had been/years ago. I think odor wise and/wind wise we would be subject to the pollution that has been stated here before. Also I think something that hasn't been considered is the dust problem in the evenings the existing lots that are around create a tremendous amount as the cattle move and of course the requirements for sprinkling is becoming fast on the docket for feedlots. I have three wells that are about the same strata that Mr. Dreyers well are and I question the availability for this type of control because the wells that I have will barley water the cattle and I question whether that well would provide enough water for 1500 head of cattle. The neighborhood had sort of a town meeting or whatever you call it before the Planning Commissions hearing and at that time there was a petition there which was is the same petition that Mr. Delventhal presented. I brought it up to the Planning Commission - with one exception and adjacent property owners signatures is on the petition in opposition to the feedlot. Mr, Teleo: Well, Mr. Heitman, I had marked this petition that you just referred to for identification purposes as Protestants Exhibit Number 2, how there are a number of signatures on here, did you circulate this petition? Mr. Heitman: Yes. Mr. Telep: Did you see these people sign this - they signed in your presence - is that correct? Mr. Heitman: Yes and it is also notarized. Mr. Telep: How many names are on this petition? Mr. Heitman: Fifteen • 30 I ' " GI Mr. Telep: Mr. Chairman, subject to Mr. Dinner checking this over I, I imagine you would like to introduce this as evidence, is that correct? As Petitioner Exhibit #2 Mr. Anderson: Accepted. Mn. One other thing I would like to add, we are all neighbors and we have to get along and we need to really fight one another but as one individual who owns property and many of us are concerned we feel that our property potentially is better than a feedlot and there is interest in the area - Mr. Dreyer referred to some property being offered by a commission firm now and my property i§ part of this block of land. We feel that the devaluation is surely there is this feedlot is permitted. It is an agricultural area but the particular part that has been referenced to is marginal agricultural area - it is sandy and not irrigatable - it just doesn't blend to agricultural land as other areas of the county. It is impossible as evidenced by the people that are here that they can't make enough living off of the dryland so they have to support it with other income. So the trend in the area is subdivisions, there are subdivisions east, there are subdivisions south and most recently 80 acres have been acquired for subdivders just a half of mile east of this and the owner of that name appears on this petition of Mr. Delventhal. That is about all I have. Mr. Anderson: Do you have any question Mr. Dinner? Mr. Dinner: Yes - Mr. Heitman, what is your occupation? Mr. Heitman: - Farmer. Mr. Dinner: And how many acres do you farm? Mr. Heitman: Two hundred and eighty. Mr. Dinner: And would you describe the type of farming that you engage in. Mr. Heitman: Irrigated. 2 x' • Mr. Dinner: And that joins some of this acerage here is that correct? Mr. Heitman: A quarter section of it joins Mr. Dreyer, right. Mr. Dinner: Do you have livestock on those premises? Mr. Heitman: I do. Mr. Dinner: And what is the quantity of livestock? Mr. Heitman: I run a calf operation in the fall and in the fall I have about 160 head of light calves that are not confined they are winter grazed. Mr. Dinner: You do not utilize a corral set up? Mr. Heitman: Only for a collection center thats about all. Mr. Dinner: Its quite apparent then isn't it then that the program the proposed feedlot here by Mr. Dreyer is a far more suitable system of operation than what he is now utilizing - is that correct? Mr. Heitman: I couldn't answer that - I don't know what he is Mr. Dinner: Well you were present during the day here to hear testimony don't you believe that the proposed feedlot will provide a far more efficient program of feeding cattle than what he is now engaged in? Mr. Heitman: I really cart answer that because I don't know what he has done. I haven't seen any cattle for over a year on the property. Mr. Dinner: Well if I told you that 268 heifers were marketed out of that lot in December of '70 that would entirely rebut what you said about cattle being there over two years wouldn't it? Mr. Heitman: I guess it would. I didn't say that Mr. Dinner: You really aren't/familiar with whats going on on the Dreyer farm are you? Mr. Heitman: Only what I see from the house. Mr. Dinner: You are a member of the County Planning Commission isn't that correct? Mr. Heitman: It irrevelent to the situation. that Mr. Dinner: And you believe simply/because land is marginal agricultural land that then next useage should be subdivisions? Mr. Heitman: Well the current trend thats the only way Mr. Dinner: In other words you think that simply because land has a margiaal value the only thing you should do with it is subdivide it? - Mr. Heitman: Realators are at our place everyday considering---- Mr. Dinner: Ya, but do you believe in the essence of only when you have marginal agricultural land - the only thing you should do with it is subdivide it? Mr. Heitman: I know of no other 3ecourse. Mr. Dinner: Regardless of its location? Mr. Heitman: Regardless of its location. Mr. Dinner: What you are really concerned about is the fear of some big giant block going in there - feedlot:isn't it? Mr. Heitman: Yes - No - I said 1500 head. What they are doing is moving it from one to another. Mr. Dinner: As a matter of fact, Mr. Heitman, there are some signatures on here of some people who do not live out there such as your brother Dean Heitman? Mr. Heitman: He lives there sir. Mr. Dinner: Does he? Mr. Dinner: And there are other people on there who actually are more than 500 feet away which is contrary to what your petition indicates isn't that correct? Mr. Stuck, Mr. Laws? Is that correct? 27 au 1 Mr. Hietman: I have already testified that the adjacent owners - other land owners - these are all people who don't border but they are within a half mile of Mr. Dreyer. Mr. Telep: For the record, do you accept Exhibit 2? Mr. Anderson: Let the record show that we accept Exhibit #2. Is there anyone else that has any opposition. Mr. Belts: I am Marvin Belts, Route 2, Box 48, Fort Lupton, Colorado. I reside north of Don Dreyer's just a half a mile, in the northwest corner of that section. I feel the same as the rest of the fellows here but as I understand there is supposed to be a settlement for a retaining pond. There has not been one word said, how large this retaining pond is - do you have any figures on this. Mr. Dreyer: You got the dimensions there, Marsh? Mr. Anderson: I have them but I don't know what they say. Mr. Dreyer: Is that a one inch scale. Mr. Telep: Can you enlighten the board on - Mr. Anderson: How big is it? Mr. Dinner: The exact dimensions are all indicated and shown on the map - I would have to check it out in terms of - it's drawn to scale - we can give you the exact dimensions. Mr. Telep: Mr. Chairman, I think anything having to do with a retention pond will most certainly have to comply with the Health Department. specifications. Mr. Dinner: Let me say, that the Health Department has given approval, Mr. Telep, likewise, Soil Conservation Service designed this retention pond not Mr. Dreyer and is based upon their recognition of the so-called management problem, conservation problem, pollution problems, etc. Consequently, all these things have been taken into account for the purpose of designing and constructing an adequate area to fill this purpose. Mr. Anderson: I think the rules and regulations on that is four inch rain, retaining pond for a four inch rain for the area. You may continue. Mr. Belts: I grant you this, without a doubt that it is built to specifi- cations for a four inch rain, that being the case. All right, fine, while its new, what happens ten years from now when the sediment fills in there and your weeds grow up. As a stockholder of Brighton Lateral Ditch Company which is right below us, we don't want this manure and stuff washed in it. I have a headgate within 500 feet of it - I may want to 26 31 Land Use Permit draw some water and fill it in. I very definitely think under the situation, I don't think any retaining pond coming off that hill, as Don spoke, we got a thirty foot drop there and that is where it is going to wind up. Thats all I have to say. Mr. Dreyer: The Soil Conservation Service of the Federal Center in Denver, the area supervisor designed a retention pond - as near as I can tell it is 460 by 40 feet wide. The criteria that the State Board of Health puts out - you cannot dump into these Brighton Lateral Ditches it has to be piped across into my field - utilized in my own field. The man did say the logical thing to do would be to dump it into the Brighton it is Lateral Ditch - it would also/sewage water to start with and it would increase the nutrients for the irrigating water and it would also seal the ditch. But he said I would have to get a petition signed by the lake - the people who own lakes below the retention pond and I said forget it. That wouldn't go over. So we are just going to dispose of it in our own field. But he said that was the logical thing for us to do - this settling pond, the way it is designed is the - it settles in there and then you drain off the water and then haul the solids out. And he also said the way the place where the feedlot, where its at, he says I doubt. that we will ever see anything in this retention pond. Mr. Anderson: Do You have any other questions. Is there anyone else in opposition to this application. Mr. Stoll: My name is Henry Stoll, my address is 5660 E. Amherst Avenue, Denver, Colorado 80222. I own 25 acres in the section just east of Mr. Dreyer's property. We bought this property a couple of years ago primarily for the purpose to build a home out there to live out there - we have four children - we live in Denver - maybe I should start out by saying, I was born and raised in Weld County on a farm. I can't make my living on a farm but I make my living in Denver. I want my kids brought up on a farm because of the turmoil of the schools in Denver, the turmoil in the neighborhood. I am in opposition to this feedlot, because, primarily of the odor. Mr. Dreyer has stated the property values out there - if this is true, I don't see how anyone can economically build a feed lot here. I think the thing to do would be to subdivide in acre, 2 acre, 5 acre, 10 acre regardless size of the plots - build homes. His attorney has stated how this will raise the tax base, if this is what he is interested in doing, I am sure 25 32 Land Use Permit homes being built out there would raise the tax base much more than a feed lot. That's about my objection. Mr. Anderson: Is there any one else - Has anyone else got anything different than that that has been in the testimony. If there is, we will hear it. Mrs. Stoll: I am Mary Ellen Stoll and I just want it to go down on record that I agree with my husband - I am against this feedlot - because I would like to live out there. Mr. Anderson: Is there anyone else in here in opposition. Mrs. Kramer: I am Mrs. Kramer, Nora Mae Kramer, Route 1, Brighton, Box 171. And there are five families of us that live right along this line - right down here. And speaking of the number of generations that have farmed these grounds - I think most of us, not all of us, but most of us are third and fourth and we even have a fifth generation coming up that would like to live on the farm. So we try to maintain friendly relationships with the Dreyers. Although we do object to the odor because we all want to live out there. Mr. Telep: How far would you say that is and show this on the map - how far would you say that would be from subject property. Mrs. Kramer: Our family is right here, but there are other Kramers that live along this road, five families of us. Mr. Telep: About a half a mile? Mrs. Kramer: About a quarter of a mile. Mr. Telep: That's what I want, now it is in record. Mr. Dinner: I have some questions. Mrs. Kramer, the location of the new proposed feed lot would be considerably further away from your residence, would it not be. Mrs. Kramer: Yes, the way the winds carry Mr. Dinner: Mrs. Kramer, I asked a question. Isn't that correct. Mrs. Kramer: That's right. Mr. Dittmer: Probably about a half a mile. Mr. Dinner: Isn't it true that you are actually about a mile away, Mr. Dittmer. Mr. Dittmer: From the new feedlot Mr. Dinner: Yes Mr. Dreyer: You're 1750 feet from the present lot, Walt, we are moving the new feedlot 3/4 of a mile east. Mr. Dittmer: How far are you from the feedlot? Mr. Dreyer: 3/4 of a mile. 3/4 of a mile minus 500 feet. Mr. Dinner: You will be a mile away from the new proposed lot, isn't that correct. Brighton Mr. Dittmer: 3/4 of a mile. I think actually, is on the verge of expanding. That's true, with a contractor buying some land right close there - actually, there is going to be building going on there and I feel that this is going to revalue the land and this will not be available for this housing if the feedlot is put in. Mr. Anderson: Is there anyone else in the room that has anything to add to this hearing, other than what has been said. Audience: I don't think the problem of rodents has been brought up, isn't rodents a factor when there is this much feed handy - is there a program or a method of killing them? Mr. Anderson: That's come under the jurisdiction of Health Department, we have no control over that. Audience: But I mean with a feed yard, this would probably _ -• them up, I would think. Mr. Anderson: All right, at this time we will have a showing of hands of the opposition of the feedlot, one vote per family, I believe, would be in order. 34 Mr. Telep: I counted thirteen. Mr. Anderson: Now those in favor of. Mr. Telep: Did you say family or persons. Mr. Anderson: All right, let's go persons instead of everybody. Against. Mr. Telep: Now we have fifteen, Mr. Chairman. Mr. Anderson: Now for the feedlot. You going to vote, Donald. Mr. Dreyer: I guess I have as much right to vote as anybody. Mr. Telep: Let the records show that 6 persons have voted in favor including counsel. Mr. Dreyer: Thank you. I just for a popularity contest. Mr. Anderson: All right, is there anything else to come before this hearing. Mr. Dinner: Yes, I would like to. If you examine in detail, the comments made by the protestants - they are worried about the problem of associating this lot with a condition which may or may not exist on a series of large highly and densely populated feedlots. Such as the Mancini lot, the National food lot and another lot they referred to. This is what they are worried about, not the fear of this lot. The second item is the fear of the future. They said, as Mr. Delventhal said, I am not worried about this or the 1500 head here,, what I am worried about is what may occur in the future. That is not the problems of this commission to worry about what occurs in the future. The problem is this particular application dealing with the facts at hand that involve you concerning this relevant matter. Not something in terms of potentials or hypotheticals or theoreticals a year, 2 years or 10 years in the future. No one indicated any proof that there was any devaluation of the property. No one indicated that there were existing subdivisions coming in. And no one indicated that this area was going to drastically change immediately in the future. Any number of people raise a concern about an older objection but no one indicated there would be one from this particular lot based upon conservation practices which are set down by the soil conservation service. So once again we are dealing with hypotheticals. The next thing we are dealing with is once again, a situation with hypotheticals. Of somebody saying I can't make enough profit on the ground as a farm, therefore, it should be subdivision usage but without any criteria for saying when where why or how. This is agricultural land. This is what it is there for. Some of these people say yes I want to come out and build. They want the benefits of living out in the country. cam 35 And they need to understand that by living out in the country they are living with livestock and they are living with crops. This is what is meant by living out in the country. Now, it is perfectly logical to understand - here is an existing lot that Mr. Dreyer has. He is trying to use good management procedure. So what is happening, someone is trying to kick him in the teeth. He is trying to use good conservation procedures he is trying to use good pollution standards and controls - he is trying to provide a far more efficient and manageable operation than he now has and then somebody comes along, and says no - we are going to kick you in they the teeth again. Quite to the contrary, should be very pleased and happy at the change that he is proposing here. A change which is probably useful to them - and beneficial to this county. It seems therefore that this application should be granted. Mr. Anderson: Does the opposition have anything to answer to that. Mr.Stoll: I have one thing. My name is Henry Stoll. My objection is to this feed lot right here - 1500 head feed lot - I said nothing about anything Audience: What is the Planning Commission's attitude on this. Mr. Anderson: We will get to that in just a minute. Audience: He stated that the Commissioners are just dealing with this now and not in the future. I think it is about time that the Planning Commission and the County Commissioners too looked at the future of the development of the ground. Audience: I was going to say the same thing as Jim did. It is your responsibility to consider the future. And he uses the term we are kicking Don in the teeth - I can say he is kicking us in the teeth. But the future is important to the Commissioner. Mr. Anderson: All right, at this time, Burman, let's hear what the Planning Commission has got to say. Mr. Lorenson: Mr. Chairman, I would like to elaborate on one single point before I read the recommendation. And this in my judgment from what I saw at the Planning Commission was a hairline decision. in their recommenda- tion. And the reason that the decision was made the way it was is that this is an intense agricultural use that has obvious problems, the oder problems, pollution problems, etc. And it was felt by the Planning Commission that when you have intense agricultural uses this close to anurbanizing area that it would be better placed a little further away, and apparently ,position of this is the reason why the County Commissioners havehe review and approval n'�. a.. 36 of these kind of things. You have an urbanized development or you can call it a rural subdivision development coming closer and closer to these uses and inevitably there is conflict. I believe the Planning Commission was trying to ward off this. I will read the recommendations now. The Planning Commission recommended unfavorably to the Board of County Commissioners for the following reasons: the site is approximatley one and a quarter miles north of Brighton within a potential growth area.of Brighton. It is also an area more heavily populated than is normally found near feed lots seeking approval. There was comment in here that the county agent and the health department have approved it however. Brighton also had no objections - the approval - or if it is approved, it should be subject to a maximum of 1500 head - sealed retention pond and drainage ditch and construction begin within one year. That concludes my comments. Mr. Anderson: You have any questions, gentlemen. Is there anything else to come before this hearing. If not, there is a motion in order. The matter was also reviewed by the City Council at their regular meeting on April 6, 1971. The City Council concurs with the findings of the Planning Commission as follows : (1 ) Area is presently zoned agricultural. (2 ) Location is presently being used as a cattle feeding area. (3 ) There are existing dairies to the north & south. (4) A permit was recently issued for a slaughter house to the east. (5) There are other compatible uses-in the area within11 miles, more or less, such as turkey farms. (6 ) Applicant has indicated a maximum capacity of 1500 head on a 5-year land use permit. In view of the above, it appears that Mr. Dreyer' s proposed feed lot permit is presently compatible with the existing area land use.
