Weld County Department of Public Health and Environment Second Floor Hearing Room 210 & via Microsoft Teams The Weld County Board of Health met on August 26, 2025, at 9:00 a.m. in the second -floor hearing room of the Weld County Department of Public Health and Environment and by via Microsoft Teams. Those present included: Board Members: Tom Cope, Joyce Smock, Anthony Gallardo, Aron Lam, Lonnie Ford, Michael Wailes, and Linda Kautz. Others: Katie Sall, Alex Clemments, Nick Trautner, Miguel Garcia, Dani Serna from Environmental Health, Weld County Department of Public Health and environment. Also, Robert McDonald, Community Health Director, Weld County Department of Public Health and environment. Claire Mack Denali Water Solutions representative was also present. APPROVAL OF AGENDA The meeting was called to order at 9:00 AM. A motion was made by Tom Cope to approve the agenda. Lonnie Ford seconded the motion, and the motion was carried unanimously. APPROVAL OF MINUTES The board approved the minutes of the July 22, 2025, meeting. A motion was made to approve by Joyce Smock, Tom Cope seconded the motion, and the motion was carried unanimously. ADMINISTRATIVE REPORT: No report given. Biosolids New: Denali Water Solutions- Katie Sall presented one new biosolid application. No public comments or concerns were received. Joyce Smock seconded the motion, and the motion was carried unanimously. PRESENTATIONS: Miguel Garcia, Environmental Health Specialist, NREMT, Weld County Department of Public Health and Environment. Miguel gave a presentation on Injection Well Program — underground injection control - Miguel explained that injection wells are used to place fluid underground into porous geologic formations, fluids can be semisolid, liquid, sludge, gas or other state of matter that flows. There is multiple iijection well classifications, classes range from class I up to class VI, class is determined by type and depth of injection activity. Also is determined by how endangering the activity is to USDWs, the deeper the well more hazardous the fluid. Injection wells have multiple uses like storing CO2, disposing of waste, increase oil production, and mining, and EPA has overall enforcement capacity unless a state or tribe has obtained primacy to enforce. Colorado currently has primacy over Class II UICs only. Class I-Hazardous/Non-Hazardous disposal well *EPA Primacy* Multiple subcategories of disposal well: hazardous waste disposal, Non -Hazardous industrial waste disposal, Municipal wastewater disposal, radioactive waste disposal, some examples of waste include treated sewage effluent, petroleum refining wastes (hazardous), non-toxic plastics, chemical solvents(hazardous) iron & steel production wastes (hazardous). All Hazardous wells require 'No Migration Petition" where operator shows that injected fluids will not migrate out of the injection zone for at least 10,000 years. Class II —Oil & Gas Injection Wells Tupes of class II wells are brine (salt water) disposal, Oil & Gas recovery, and Hydrocarbon Storage. Colorado has primacy over all Class II wells, Weld County currently has 26 Brine Disposal wells that are inspected by EH. Other types of class II wells (O&G recovery and hydrocarbon storage) are regulated by the Colorado Department of Natural Resources -Energy & Carbon Management Commission (ECMC) Class III — Injection Wells for Solution mining *EPA Primacy' Class II wells are used to mine Uranium, Salt, Copper, and Sulfur. The Majority of Class III wells are for extracting uranium. Fluid called lixiviant is injected to dissolve mineral bearing rocks, then extracted via nearby production well. Class IV — Shallow Hazardous and Radioactive Injection Wells *EPA Primacy' Class IV wells are shallow wells used to dispose of hazardous and/or radioactive waste into or above USDWs. Class IV wells have been banned since 1984, Only authorized use is for EPA/State ground water clean up actions (superfund sites), process is "pump and treat"- pump contaminated groundwater to surface, decontaminate, reinject fluid into same formation, rinse and repeat until concentrations are reduced. If concentrations are adequate (non -hazardous), could be reclassified as Class V well. If not, well is kept as Class IV well. Class V —Shallow Non -Hazardous injection wells into USDWs *EPA Primacy. Class V wells are defined as wells that inject non -hazardous fluids underground and/or don't' meet the classifications of the previous four classes, most class V wells are disposal systems that depend on gravity to drain fluids in the ground, some examples of class v wells are: stormwater drainage wells, septic system leach fields, agricultural drainage wells and large -capacity septic systems, EPA estimates there are over 650,000 class V wells in operation nationwide. Class VI — Wells used for Geologic Sequestration of CO2 *EPA Primacy. Class VI yells are used to inject CO2 into deep rock formations for long periods of time (geologic sequestrations or GS), Sources of CO2 for Gs include industrial facilities (e.g. steel and cement production), energy production (power plants), and direct capture from atmosphere. Colorado currently has two Class VI wells under review from EPA, but no operational class VI wells currently. He summarized saying that in 2023, the State Senate passed bills that expanded the State's authorityto include Class VI yells (pursue primacy over class VI wells from EPA), the final state rules over class VI wells were finished in December 2024 and ECMC has submitted the final application to the EPA i■ Spring 2025, and potentially will obtain primacy over Class VI wells by Spring 2026. Bob introduced himself to Board members and gave them a background of his previous job with Denver Public Health.
