Approve Acceptance of Quit Claim Deed for Public Road Right -of -Way for County
Road 44 and U.S. Highway 85 Peckham Interchange Project (West), and Authorize
Chair to Sign
Whereas, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
Whereas, the Colorado Department of Transportation (CDOT) contracted with Jalisco
International, Inc. (NHPP 0853-107), to construct flyover overpass roadway
improvements for the Peckham Interchange Project at the intersection of County Road 44
and U.S. Highway 85, and
Whereas, the Colorado Department of Transportation (CDOT) desires for Weld County
to maintain acquired public road right-of-way on two (2) parcels of land where the
overpass ties back into County Road 44 near County Road 33 on the west side of
U.S. Highway 85, and
Whereas, the Board has been presented with a Quit Claim Deed for Public Road
Right -of -Way to the County of Weld, State of Colorado, by and through the Board of
County Commissioners of Weld County, on behalf of the Department of Public Works,
from the Colorado Department of Transportation (CDOT), with further terms and
conditions being as stated in said deed and reflected in the attached Exhibit "A," and
Whereas, after review, the Board deems it advisable to approve and accept said deed, a
copy of which is attached hereto and incorporated herein by reference.
Now, therefore, be it resolved by the Board of County Commissioners of Weld County,
Colorado, that the Quit Claim Deed for Public Road Right -of -Way to the County of Weld,
State of Colorado, by and through the Board of County Commissioners of Weld County,
on behalf of the Department of Public Works, from the Colorado Department of
Transportation (CDOT), be, and hereby is, approved and accepted.
Be it further resolved by the Board that the Chair be, and hereby is, authorized to sign
said deed.

PASS -AROUND TITLE: Quitclaim Deeds for Public Road Right -of -Way (WCR 44 / US 85 Peckham Overpass
Improvements)

Brief description of the problem/issue:
Weld County has partnered with CDOT for the WCR 44 and US 85 Overpass Intersection Improvements
project in which WCR 44 goes over the top of US 85 with on and off ramps onto US 85 and WCR 44. CDOT
has designed, acquired Right -of -Way (ROW), and has contracted/managed the construction of the
improvements. On the east side of US 85 where the WCR 44 overpass starts to tie back into WCR 44 at
existing grade near Niobrara Blvd., CDOT acquired ROW which the County will maintain. On the west side
CDOT did the same thing and where WCR 44 ties back into existing grade CDOT acquired ROW which the
County will maintain. CDOT will Quitclaim Deed these parcels to Weld County to complete the project and
satisfy the limits of what ROW each organization will maintain. Both CDOT and Weld County staff have agreed
to these maintenance boundaries.
The two Quitclaim Deeds includes four (4) parcels of the project which require Weld County to control the
ROW acquired for future maintenance. CDOT has settled, closed, and paid the affected property owners, and
provided the attached Quitclaim Deeds.
• AP -1 REV (CDOT), 66,719 sqft, 1.532 acres
• RW-7 (CDOT), 1,472 sqft, 0.0338 acres
• RW-12REV (CDOT), 81,164 sqft, 1.863 acres
• AP-3AREV3 (CDOT), 118,229 sqft, 2.714 acres
The legal descriptions have been checked by Weld County Public Works Staff and no issues were found
What options exist for the Board?
1. Allow the Quitclaim Deeds to be placed on the next available BOCC Agenda.
2. Ask for a work session and additional information.
Consequences: If the Quitclaim Deeds are not placed on the BOCC Agenda and approved for
acceptance and recording, the project timeline may be lengthened.
Impacts: These property acquisitions directly impact the project completion timeline which CDOT is trying
to close out by June 2025.
Costs: CDOT paid the all the ROW costs.
Recommendation:
Public Works staff recommends placing the deeds on the next available BOCC Agenda for consideration.
