HomeMy WebLinkAbout20252094.tiffRecord of Proceedings Minutes Board of County Commissioners Weld County, Colorado Wednesday, July 23, 2025 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, July 23, 2025, at the hour of 9:00 a.m. Roll Call: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Perry L. Buck, Chair Commissioner Scott K. James, Pro-Tem Commissioner Jason S. Maxey Commissioner Lynette Peppler Commissioner Kevin D. Ross Also present: Acting Clerk to the Board, Houstan Aragon County Attorney, Bruce Barker Controller, Rusty Williams Minutes: Commissioner Ross moved to approve the below listed Minutes of the Board of County Commissioners meeting, as printed. Commissioner Peppier seconded the motion and it carried unanimously. 1. Minutes from July 9, 2025 Certification of Hearings: Commissioner Ross moved to approve the below listed Hearing Certificate. Commissioner James seconded the motion, which carried unanimously. 1. Public Input regarding changing the boundary lines of Commissioner Districts in Weld County, Colorado, as proposed by the Weld County Redistricting Advisory Committee, pursuant to Colorado Revised Statutes §§ 30-10-306 et. seq. — Weld County Amendments to Agenda: There were no amendments to the Agenda. Consent Agenda: Commissioner Maxey moved to approve the Consent Agenda, as printed. Commissioner Ross seconded the motion and it carried unanimously. 2025-2094 BC0016 Page 2 Wednesday, July 23, 2025 www.weld.gov Warrants: 1. General Warrants: Commissioner Maxey moved to approve the General Warrants, as printed. Commissioner James seconded the motion and upon a roll call vote of four (4) to zero (0), it carried with Commissioner Peppler abstained. Bids: 1. Approve Bid #B2500083, Elevator Modernization for Department of Public Health and Environment — Facilities Department: Toby Taylor, Purchasing Department, stated staff recommends selecting the lowest bidder who met specifications, TK Elevator, for a total amount of $167,021.60. Commissioner James moved to approve said bid. The motion was seconded by Commissioner Ross and it carried unanimously. New Business — General: 1. Consider Application for 2026 Victim Assistance and Law Enforcement (VALE) Grant for Victim Witness Assistance Unit, and Authorize Chair, 19th Judicial District Attorney's Office, and Controller to Sign: Robb Miller, 19th Judicial Assistant District Attorney, introduced Ermelinda Archibeque and Karol Patch from his Office, and requested to submit the 2026 VALE Grant application for grant funding, in the amount of $160,200.00. He noted the grant is the office's second largest funding source and assured the Board that staff is looking at all other possible funding options to maintain services to the citizens of Weld County. Commissioner James moved to approve said application and authorize the Chair, the 19th Judicial District Attorney's Office, and the Controller to sign. The motion was seconded by Commissioner Ross and it carried unanimously. 2. Consider Application for 2026 Victim Assistance and Law Enforcement (VALE) Grant for Law Enforcement Victim Services Unit, and Authorize Chair, Sheriff's Office, and Controller to Sign: Thanh Matthews, Sheriff's Office, requested to submit the 2026 VALE Grant application for funding, in the amount of $42,485.00. Commissioner Maxey moved to approve said application and authorize the Chair, the Sheriff's Office, and the Controller to sign. The motion was seconded by Commissioner James and it carried unanimously. 3. Consider Contract ID #9738 Intergovernmental Agreement for Provision of Home Water Audit Services for Eligible Residents and Authorize Chair to Sign — Town of Erie: Jamie Ulrich, Director of the Department of Human Services, stated the agreement allows for the Weld County Youth Conservation Corps (WCYCC) to provide home water auditing services to qualified residents in the Town of Erie, which includes replacement of toilets and shower aerators that do not meet the gallons -per -minute threshold. She stated the Town will reimburse the County at $500.00 per household, up to $25,000.00. Commissioner Ross moved 2025-2094 BC0016 Page 3 Wednesday, July 23, 2025 www.weld.gov to approve said agreement and authorize the Chair to sign. The motion, which was seconded by Commissioner Peppler carried unanimously. 4. Consider Contract ID #9744 Intergovernmental Agreement for 2025-2026 County Incentives Program and Authorize Chair to Sign: Ms. Ulrich stated the agreement provides performance -based benchmarks and deliverables, which allows the Department of Human Service (DHS) to achieve certain performance standards. She indicated Weld County can receive incentive funds up to $489,000.00, if the standards are met through June 30, 2026. Commissioner Peppler moved to approve said agreement and authorize the Chair to sign. The motion was seconded by Commissioner James and it carried unanimously. 5. Consider Contract ID #9756 Agreement for Professional Services for Foster Parent Training and Co -Facilitator Services, and Authorize Chair to Sign — Rachel Jasper: Ms. Ulrich stated the agreement provides foster parent training as a co -facilitator. Commissioner Peppler moved to approve said agreement and authorize the Chair to sign. The motion was seconded by Commissioner Maxey and it carried unanimously. 6. Consider Contract ID #9764 Agreement for Professional Services for Foster Parent Training and Co -Facilitator Services, and Authorize Chair to Sign — Hannah Cross: Ms. Ulrich stated the agreement provides foster parent training as a co -facilitator. Commissioner Peppler moved to approve said agreement and authorize the Chair to sign. The motion was seconded by Commissioner Maxey and it carried unanimously. 7. Consider Contract ID #9765 Amendment #2 to Agreement for Provision of Alternative Transportation Solutions and Authorize Chair to Sign — Alternative Logistics Technologies Holdings, Inc., dba EverDriven Technologies, LLC: Ms. Ulrich stated the amendment allows for the agency to provide safe transportation to and from school for foster youth in Weld County, which helps reduce school transfers, tardiness, and absenteeism Commissioner Ross moved to approve said amendment and authorize the Chair to sign. The motion was seconded by Commissioner James and it carried unanimously. 8. Consider Entry Upon Various Lands by Weld County Vegetation Management Specialist: Tina Booton, Department of Public Works, stated Patricia Nash and William Schneider, landowners, were notified by the Vegetation Management Specialist on July 9, and 10, 2025, to eradicate Scotch Thistle, identified as noxious weed. As a result of their non-compliance, she requested approval to enter upon the lands identified to carry out weed control measures. Commissioner James moved to approve said entry upon various lands. The motion was seconded by Commissioner Maxey and it carried unanimously. 2025-2094 BC0016 Page 4 Wednesday, July 23, 2025 www.weld.gov New Business — Planning: 1. Consider Consent to Enforcement of 2024 International Fire Code, with Amendments, Within Certain Areas of Unincorporated Weld County Lying Within Windsor -Severance Fire Protection District: Bruce Barker, County Attorney, explained, when a fire district operates in unincorporated Weld County and updates their fire codes, they must gain consent by the County Commissioners prior to enforcement. He indicated staff reviewed the changes and ensured there is nothing that conflicts with the County's building code requirements. Commissioner Maxey commended staff for their due diligence, and in response, Mr. Barker stated the installation fire suppression systems within homes and the access width of subdivision roads are two (2) items that are in conflict with the current County Code and the Windsor -Severance Fire Protection District addressed those concerns to be in alignment for acceptance. Commissioners Maxey and Ross discussed the requirement for wider roads within a subdivision to accommodate cars being parked on the roadways and still have room for emergency vehicles. Commissioner Maxey moved to approve said resolution. The motion was seconded by Commissioner James and it carried unanimously. 2. Consider Local Government Land Use Timeline Extension Agreement for Use by Special Review Permit, USR17-0043, Remand Proceedings and Authorize Chair to Sign — Cactus Hill Ranch Company and Simon Contractors, Inc.: Karin McDougal, Deputy County Attorney, on behalf of the Department of Planning Services, provided history of Use by Special Review Permit, USR17-0043, which began in 2018 for an asphalt batch plant facility for Cactus Hill Ranch Company and Simon Contractors, Inc. She explained, subsequent to the Board's initial approval of the USR, the case was challenged in a Rule 106 Appeal and was remanded back to the Board of Commissioner for further findings. Ms. McDougal indicated, due to the extended period of time that has passed, the applicant has been presented with the opportunity to annex into the Town of Severance and is looking into the viability of the offer. She requested the Board to consider the `standstill' agreement to preserve the applicant's rights from the original USR should the annexation process not be successful. Commissioner James moved to approve said agreement and authorize the Chair to sign. The motion was seconded by Commissioner Ross and it carried unanimously. Mr. Barker commended Ms. McDougal for her incredible work on this case she had inherited once it was remanded back to the County. Public Comment: 1.
