The Board of County Commissioners of Weld County, Colorado, met in regular session
in full conformity with the laws of the State of Colorado at the regular place of meeting in
the Weld County Administration Building, Greeley, Colorado, April 14, 2025, at the hour
of 9:00 a.m.
e Roll Call: The meeting was called to order by the Chair and on roll call the following
members were present, constituting a quorum of the members thereof:
Commissioner Perry L. Buck, Chair

Commissioner Kevin D. Ross

11E Minutes: Commissioner Ross moved to approve the below listed Minutes of the
Board of County Commissioners meeting, as printed. Commissioner James seconded
the motion and it carried unanimously.
1. Minutes from March 31, 2025
IR Amendments to Agenda: There were no amendments to the Agenda.
IE Consent Agenda: Commissioner Maxey moved to approve the Consent Agenda, as
printed. Commissioner Ross seconded the motion and it carried unanimously.
e Presentations and Proclamations:
1. National Public Safety Telecommunicators Week — April 13-19, 2025:
Commissioner Ross read the certificate for the record. Laurie Pfeiler, Deputy
Director of the Department of Public Safety Communications, shared Tina Powell,
Director of Department of Public Safety Communications, is currently at a
conference learning more information to bring back ideas to Weld County. She
reiterated the notion that 'it takes a village' for the team members of the Weld

County Regional Call Center (WCRCC), and took the opportunity to highlight the
facets behind the scenes that allow the 911 Dispatch to happen all over the county.
Staff who were present from the Learning and Development and Professional
Standards divisions, and new trainees introduced themselves for the record. The
Board extended their humbled gratitude to staff for their daily efforts being the
confident and calm voice for people who are experiencing traumatic events and
call 911, and expressed their admiration for the men and women who are the
frontline of first responders in Weld County. (Clerk's Note: The group gathered for
a photo opportunity.)
Warrants:
1. a General Warrants: Commissioner Ross moved to approve the General
Warrants, as printed. Commissioner James seconded the motion, and upon a roll
call vote of four (4) to zero (0), it carried with Commissioner Peppier abstained.
Bids:
1. lE9 Approve Bid #B2500031, Land Use Application and Building Permit Fee
Study — Department of Planning Services: Toby Taylor, Purchasing Department,
stated staff recommends selecting the lowest bidder who met specifications, Berry
Dunn McNeil and Parker, LLC, for a total amount of $49,140.00, for review of
Appendix 5-J and 5-K, with consulting fees excluding travel expenses which will
be billed, as needed, when in -person meetings occur. Commissioner Ross moved
to approve said bid. The motion was seconded by Commissioner James and it
carried unanimously.
2. IR Approve Bid #B2500035, Jail -1 East Hot Water Boilers and Storage Tank
Replacement — Facilities Department: Mr. Taylor stated staff recommends
selecting the lowest bidder who met specifications, Harper Mechanical, Inc., for a
total amount of $167,000.00. Commissioner Maxey moved to approve said bid.
The motion was seconded by Commissioner Ross and it carried unanimously.
3. a Present Bid #B2500044, Workforce Innovation and Opportunity Act
(WIOA) One -Stop Operator — County Attorney's Office: Mr. Taylor stated
one (1) bid was received and staff will make a recommendation on April 28, 2025.
4. a Present Bid #B2500049, Infoblox Maintenance and Support— Department
of Information Technology: Mr. Taylor stated four (4) bids were received and staff
will make a recommendation on April 21, 2025.
5. a Present Bid #62500058, Uninterrupted Power Supply (UPS) Preventative
Maintenance and Repairs — Facilities Department: Mr. Taylor stated two (2) bids
were received, with one (1) deemed as non -responsive, and staff will make a
recommendation on April 28, 2025.

New Business — General:
1. a Consider Contract ID #9085 Acceptance of Intergovernmental Grant
Agreement Summary of Terms and Conditions for 2024-2025 Peace Officers
Behavioral Health Support and Community Partnerships Program:
Captain Matt Elbe, Weld County Sheriff's Office, stated the County received grant
funds, in the amount of $31,000.00, to provide behavioral health counseling,
therapy, or other mental health services for deputies and families resulting from
traumatic work -related events. Commissioner Ross moved to approve said
agreement and accept said funds. The motion was seconded by
Commissioner Peppler and it carried unanimously.
2. a Consider Local Public Health Agency (LPHA) Mini -Grant Opportunity
Application for Injury and Violence Prevention, and Authorize Department of
Public Health and Environment to Submit Electronically: Jason Chessher,
Director of the Department of Public Health and Environment, requested to submit
the mini -grant application for funding, in the amount of $9,500.00, to provide child
car seats and booster seats, and print educational materials for mothers in Weld
County to prevent injury. Commissioner Maxey moved to approve said application
and authorize the Department for Public Health and Environment to submit
electronically. The motion was seconded by Commissioner Peppier and it carried
unanimously.
3. le Consider Contract ID #9325 Memorandum of Agreement to Purchase
Property Interest for County Road 66 Corridor Project (RW-32 and RW-35)
and Authorize Chair to Sign — Hungenberg KHL Farms, LLLP: Clay Kimmi,
Department of Public Works, stated the agreement allows the County to purchase
right-of-way (ROW), in the amount of $700,000.00, plus closing costs, for the
County Road (CR) 66 Corridor Project. He indicated the cost is included in the
department's 2025 budget. Commissioner Peppler moved to approve said
agreement and authorize the Chair to sign. The motion was seconded by
Commissioner James and it carried unanimously.
4. a Consider Acceptance of Deed of Dedication for Purchase of Public Road
Right -of -Way for County Road 66 Corridor Project (RW-32 and RW-35) and
Authorize Chair to Sign — Hungenberg KHL Farms, LLLP: Mr. Kimmi stated the
deed is related to the agreement above and requested the Board's acceptance to
proceed with closing. Commissioner James moved to accept said deed and
authorize the Chair to sign. The motion was seconded by Commissioner Maxey
and it carried unanimously.
5. IE Consider Contract ID #9326 Memorandum of Agreement to Purchase
Property Interest for County Road 66 Corridor Project (RW-34) and Authorize
Chair to Sign — Hungenberg Produce, Inc.: Mr. Kimmi stated the agreement
allows the County to purchase a Recorded Exemption (RE) lot, in the amount of

$550,000.00, plus closing costs, for the CR 66 Corridor Project. He indicated the
cost is included in the department's 2025 budget. Commissioner Ross moved to
approve said agreement and authorize the Chair to sign. The motion was
seconded by Commissioner Peppler and it carried unanimously.
6. le Consider Acceptance of Deed of Dedication for Purchase of Public Road
Right -of -Way for County Road 66 Corridor Project (RW-34) and Authorize
Chair to Sign — Hungenberg Produce, Inc.: Mr. Kimmi stated the deed is related
to the agreement above and requested the Board's acceptance to proceed with
closing. Commissioner Ross moved to accept said deed and authorize the Chair
to sign. The motion was seconded by Commissioner Peppler and it carried
unanimously.
7. IIEl Consider Temporary Closure of County Road 37 Between County Road 8
and State Highway 52: Erich Green, Department of Public Works, stated the
closure will begin April 21, 2025, and go through May 30, 2025, for the County's
contractor, Coulson Excavating Company, for Phase Two (2) of mill and overlay
road work and paving operations. He further stated the detour route will utilize
CR 41, local access will be maintained, and he stated the surrounding property
owners (SPO) have been noticed. Commissioner James moved to approve said
temporary closure. The motion was seconded by Commissioner Maxey and it
carried unanimously.
New Business — Ordinances:
1. IE9 Final Reading of Code Ordinance #2025-02, in the Matter of Repealing
and Reenacting, with Amendments, Chapter 2 Administration of the Weld
County Code (Graywater Prohibition): Commissioner James moved to read
Code Ordinance #2025-02 by title only. The motion was seconded by
Commissioner Ross and it carried unanimously. Bruce Barker, County Attorney,
read the title for the record. David Eisenbraun, Director of the Department of
Planning Services, stated there have been no added changes for consideration
since Second Reading and staff recommends approval. No public testimony was
offered concerning this matter. Commissioner James moved to approve Code
Ordinance #2025-02 on Final Reading. The motion was seconded by
Commissioner Ross and it carried unanimously.
New Business — Planning:
1. El Consider Contract ID #9221 Partial Release of Collateral and Acceptance
of Warranty Collateral for Site Plan Review Permits, SPR18-0011
and SPR21-0007 — Great Western Railway of Colorado, LLC, and GWIP, LLC:
Jazmyn Trujillo -Martinez, Department of Planning Services, requested the partial
release of project collateral and acceptance of warranty collateral, in the amount
of $24,090.75, procured in the form of Maintenance Bond #830038, issued by

Harco National Insurance Company. She stated the collateral will be retained for
duration of the required two (2) -year warranty period. Commissioner Maxey moved
to approve said partial release and acceptance of said collateral. The motion was
seconded by Commissioner Ross and it carried unanimously.
2. 1E Consider Request to Temporarily Extend Hours of Operation for
Amended Use by Special Review Permit, AMUSR-1102, for Mineral Resource
Development Including Open Pit Mining and Materials Processing
(Sand, Gravel, and Stone), Including Concrete and Asphalt Recycling and a
Concrete and Asphalt Batch Plant Facility in the A (Agricultural) Zone
District — L.G. Everist, Inc.: Diana Aungst, Department of Planning Services,
stated staff received a request from the applicant to temporarily extend their hours
of operation associated with AMUSR-1102 to accommodate concrete pours on the
northbound express lanes on Interstate 25 (I-25). She indicated the project is
expected to begin at midnight on April 15, 2025, with a contingency of April 16,
2025. In response to Commissioner Maxey, Ms. Aungst clarified this request is for
one (1) night only, as they need eight (8) additional hours to accommodate the
needs of said project. Commissioner Maxey moved to approved said temporary
extension of operation hours. Commissioner Ross seconded the motion.
Commissioner James commended the operator's on -going compliance with the
temporary request process. There being no further discussion, the motion carried
unanimously.
3. ID Consider Two -Lot Family Farm Division, FFD24-0048 — JYJY, LLC,
c/o James Younger: Lindsey Oliver, Department of Planning Services, provided
a brief overview of the request for a Two -Lot Family Farm Division, FFD24-0048,
while she displayed aerial images depicting Lot A being twelve (12) acres, which
exceeds the ten (10) -acre maximum allowance, as cited in Section 24-7-20.D of
the Weld County Code; therefore, she indicated staff recommends denial.
James Younger, applicant, was present and explained he can no longer take care
of the buildings depicted on Lot A, due to health complications. He further stated
the tenant has rented the lot from him for the past decade and is interested in
purchasing the property from him, and he wants to ensure there is adequate space
to navigate around the existing layout of the buildings. Commissioner Maxey
thanked Mr. Younger for his explanation. Commissioner Ross concurred with
Commissioner Maxey and stated that there are instances where a waiver of the
Code is warranted and moved approve said request. Mr. Barker advised the Board
there is no waiver written into Code for the Board to override the 10 -acre limit, and
Commissioner Ross withdrew his previous motion. After discussion among the
Board and Ms. Aungst, Commissioner James moved to refer the matter back to
staff to further work with the applicant and adhere to the limitation written in Code.
Commissioner Ross seconded the motion and it carried unanimously.

IR Public Comment:
1. Lyn Tausan, City of Greeley resident, offered her comments to the Board with
responses from Commissioners James, Maxey, and Buck.
2. Edwin Grant, City of Greeley resident, offered his comments to the Board.
Let the Minutes reflect that the above and foregoing actions were attested to and
respectfully submitted by the Clerk to the Board. There being no further business, this
meeting was adjourned at 10:00 a.m.
The Board of County Commissioners of Weld County, Colorado, approved the above
and foregoing Minutes, on motion duly made and seconded, by the following vote on the
28th day of April, A.D., 2025:
