HomeMy WebLinkAbout20252524.tiffRecord of Proceedings Minutes Board of County Commissioners Weld County, Colorado Wednesday, September 10, 2025 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, September 10, 2025, at the hour of 9:00 a.m. Roll Call: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Perry L. Buck, Chair Commissioner Scott K. James, Pro-Tem Commissioner Jason S. Maxey — Excused Commissioner Lynette Peppler Commissioner Kevin D. Ross — Excused Also present: Acting Clerk to the Board, Houstan Aragon County Attorney, Bruce Barker Chief Financial Officer, Cheryl Pattelli Minutes: Commissioner Peppler moved to approve the below listed Minutes of the Board of County Commissioners meeting, as printed. Commissioner James seconded the motion and it carried unanimously. 1. Minutes from August 27, 2025 Certification of Hearings: Commissioner James moved to approve the below listed Hearing Certificate. Commissioner Peppler seconded the motion, which carried unanimously. 1. USR25-0008 — Brian Rector Amendments to Agenda: There were no amendments to the Agenda. Consent Agenda: Commissioner Peppler moved to approve the Consent Agenda, as printed. Commissioner James seconded the motion and it carried unanimously. 2025-2524 BC0016 Page 2 Wednesday, September 10, 2025 www.weld.gov Presentations and Proclamations: 1. Recognition of Services, CSU Extension Service of Weld County — Cindy Nosko: Chair Buck read the certificate for the record. Cindy Nosko was present and indicated she enjoyed her time working for Weld County. Each Commissioner, in turn, extended their appreciation for her years of dedication to the citizens of Weld County and wished her well in her retirement. (Clerk's Note: The group gathered for a photo opportunity.) Warrants: 1. General Warrants: Commissioner Peppier moved to approve the General Warrants, as printed. Commissioner James seconded the motion and it carried unanimously. New Business — General: 1. Consider Contract ID #9889 Employment First Program Operator Plan for Federal Fiscal Year 2025-2026 and Authorize Department of Human Services to Sign: Jamie Ulrich, Director of the Department of Human Services, stated the Colorado Department of Human Services requires an annual plan with outlined expectations of engagement from the participants enrolled in the Employment First Program. Commissioner Peppier moved to approve said plan and authorize the Department of Human Services to sign. The motion was seconded by Commissioner James and it carried unanimously. New Business — Planning: 1. Consider Partial Vacation, VAC25-0016, of Use by Special Review Permit, USR-1160 — Coors Energy Company: Diana Aungst, Department of Planning Services, indicated staff received the applicant's request to partially vacate Use by Special Review Permit, USR-1160, pursuant to a Condition of Approval for USR24- 0027, approved May 21, 2025. She provided a historical overview and location of the property, stated the applicant received confirmation from the Division of Reclamation, Mining, and Safety (DRMS) approving their technical revision, and from the Colorado Department of Public Health and Safety (CDPHE) with no concerns regarding the status of the Certificate of Designation. Ms. Aungst stated staff is supportive of the applicant's request and recommends approval to ensure there are no overlapping USR's. Ben Moline, applicant representative, was present to answer question but had no additional comments. Commissioner James moved to approve said partial vacation. Consider Request to Temporarily Extend Hours of Operation for Amended Use by Special Review Permit, AMUSR-1102, for Mineral Resource Development including Open Pit Mining and Materials Processing (sand, gravel, and stone), including concrete and asphalt recycling and a concrete and asphalt batch plant facility in the A (Agricultural) Zone District — L.G. Everist, Inc.: Ms. Aungst indicated staff received the request from the applicant, L.G. Everist, Inc., dated September 2, 2025, to extend their hours of operation for the batch plant permitted by Amended Use by Special Review Permit, AMUSR-1102, to accommodate the 1-25 North Express Lane Project concrete pours for the Colorado Department of Transportation (CDOT). She shared the location, noted the requested dates for extended hours, and stated staff recommends approval as permitted in Section 23-4-290.6 of the Weld County Code. No public testimony was offered concerning this matter. Commissioner Peppler moved to approve said request for temporary extension of operation hours. Commissioner James extended his appreciation to the applicant for their compliance with the process regarding this matter and further seconded the motion, and it carried unanimously. Public Comment: No public comment was offered. Let the Minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board.
